seq. The Michigan Rules of Evidence and the Michigan Court Rules may be applicable. Parties are expected

to exercise proper respect and courtesy toward other parties, witnesses, and administrative law judges, which

includes attending the hearing on time, silencing cell phones, and choosing a quiet, private location to

participate in the hearing to limit distractions and ensure minimal background noise. The hearing may be

ORDER GRANTING RESPONDENT’S MOTION TO SET ASIDE DEFAULT

ORDER OF PARTIAL DISMISSAL

On January 29, 2026, Respondent filed an answer and a motion requesting the Tribunal

set aside the default entered in this case on December 10, 2025.

Petitioner has not filed a response to the motion.

The Tribunal has considered the motion and the case file and finds that Respondent

was held in default because they failed to file an answer. Respondent failed to respond

and the Tribunal entered an order extending the time to cure on January 13, 2026.

Having now filed the answer and requisite motion, Respondent has complied with the

Tribunal’s orders as required by TTR 237. As such, the Tribunal finds good cause to

grant the motion and set aside the default.

Further, the Tribunal finds that Petitioner’s appeal includes an appeal of the

classification of the subject property. The Tribunal has no jurisdiction over Petitioner’s

classification claim because Petitioner was required to “notify the assessor and []

protest the assigned classification to the March board of review.” Additionally, “[a]n

owner . . . may appeal the decision of the March board of review by filing a petition with

the state tax commission not later than June 30 in that tax year.” As such, the Tribunal

is not the proper venue for a classification claim brought forward by a property owner.

Therefore,

IT IS ORDERED that Respondent’s Motion to Set Aside Default is GRANTED.

IT IS FURTHER ORDERED that Petitioner’s classification appeal only is DISMISSED.

holding Respondent in default on December 10, 2025, because they failed to file an

answer.1 Respondent was required to cure the default within 14 days, has had ample

time to comply, yet has failed to respond or submit the required filings.2 Though the

Tribunal finds an extension of time to cure the default appropriate, Respondent’s failure

to comply with Tribunal orders and its Rules of Practice and Procedure has established

a history of deliberate delay that would justify the scheduling of a default hearing for

failure to timely comply with this order.3 Therefore,

IT IS ORDERED that the time for Respondent to cure the default is EXTENDED.

IT IS FURTHER ORDERED that Respondent must complete the following to cure the

default: (1) file an answer, (2) file a Motion to Set Aside Default, (3) pay the $25.00 fee

required for the filing of the motion, and (4) file proof the motion was served on

Petitioner. The foregoing must be filed with the Tribunal within 14 days of the entry of

this order.4

1 The order further stated, “Failure to comply with this order will result in the defaulted party being

required to file a motion to set aside the default (with appropriate filing fee).”

2 A list of Tribunal rules and forms are available online at www.michigan.gov/taxtrib.

3 See Grimm v Dep’t of Treasury, 291 Mich App 140 (2010).

4 “A submission by mail is considered filed on the date indicated by the United States Postal Service

postmark on the envelope containing the submission. A submission without a postmark or with an illegible

postmark is considered filed on the date the submission is received by the tribunal. A submission by

commercial delivery service is considered filed on the date the submission is given to the commercial

service for delivery to the tribunal as indicated by the receipt date on the package containing the

submission. A submission by personal service is considered filed on the date the submission is received.

A submission through the tribunal’s e-filing system by 11:59 p.m. on a business day is considered filed on

that business day. A submission by email to the email address designated by the tribunal by 11:59 p.m.

on a business day is considered filed on that business day. A submission on a Saturday, a Sunday, or a

holiday is considered filed on the following business day, as provided by section 35a of the tax tribunal

act, MCL 205.735a.” TTR 225(5).

CORRECTED ORDER HOLDING PETITIONER IN DEFAULT

The Tribunal has reviewed the file in this case and finds that an order holding Petitioner

in default was issued on September 23, 2025, because Petitioner failed to use an

updated Tribunal petition form, failed to include a copy of each of the notice giving rise

to the appeal for each parcel number under appeal, i.e. Board of Review (BOR) results,

and failed to pay the required filing fee for the filing of the petition.1 The Tribunal erred

in the entry of this order as a copy of all the BOR results for the parcel numbers under

appeal were submitted. Further, the Tribunal failed to include that the petition indicates

that the properties at issue are not contiguous. As such, Petitioner must file separate

petitions (including an amended petition for the above-captioned case) and pay

separate filing fees for each non-contiguous parcel or file proof of contiguity within 14

days of the entry of this order.2 A list of Tribunal rules and forms can be found online at

www.michigan.gov/taxtrib. Additionally, in the instant case, Petitioner identified its

representative as “Logical Property Management LLC”, even though the submission

was sent by the Law Offices of George W. Schmidt, PLLC. When the petition was

processed, neither Petitioner nor Petitioner’s alleged authorized representatives signed

the petition as required by MCR 1.109(E), thus Petitioner’s alleged authorized

representative was never added to the docket, preventing proper service of the Order of

Default. As such, the Tribunal finds it necessary to reissue the September 23, 2025

Order of Default. Therefore,

IT IS ORDERED that Petitioner is held in DEFAULT.

IT IS FURTHER ORDERED that Petitioner must complete the following to cure the

default: (1) if the parcel numbers are not contiguous, file current, signed Petitions for

Valuation Appeal, for each parcel number under appeal, identifying Petitioner’s

authorized representative; or if the parcel numbers are contiguous, file a current,

signed, Petition for Valuation Appeal, with proof of contiguity, identifying Petitioner’s

authorized representative, and the requisite multiparcel form; and (2) if the parcel

numbers are not contiguous, pay the required $125.00 petition filing fee for each petition

1 Although the petition indicates a $325.00 filing fee was paid with the filing of the petition, no filing fee

has been received.

2 TTR 201 and 227.

being filed, or if providing proof of contiguity, pay the required $125.00 petition filing fee

plus the $75.00 contiguous parcel fee. The foregoing must be filed with the Tribunal

within 14 days of the entry of this Order.3

IT IS FURTHER ORDERED the amended petition shall note the docket number

previously assigned by the Tribunal. Unfortunately, the petition filing fees may not be

made via e-filing.

Failure to comply with this order will result in Petitioner being required to file a motion to

set

ORDER OF DEFAULT

The Tribunal has reviewed the file in the above-captioned case and finds that:

Petitioner did not pay the required fee for the filing of the petition. See TTR 269.

Because of this, the appeal is not properly pending. Petitioner must pay the required

fee for the filing of the petition within 14 days of the entry of this order. A filing fee

calculator can be found on our website at www.michigan.gov/taxtrib. Unfortunately, the

payment may not be made via e-filing.

Furthermore,

Petitioner failed to file an updated Tribunal petition form. As such, the petition is not

properly pending. Petitioner must complete and return a current petition form within 14

days of the entry of this order. The petition shall note the docket number assigned by

the Tribunal and if filed utilizing the Tribunal’s e-filing system, must be filed on the

assigned docket number as an “amended petition.” Small Claims petition forms can be

found on our website at www.michigan.gov/taxtrib.

Furthermore,

Petitioner is appealing multiple parcels and did not submit a copy of all notices giving

rise to the appeal (i.e., notice of action taken by Board of Review, uncapping notice,

PRE denial notice, final assessment notice, etc.), as required by TTR 279. As such,

Petitioner must submit the missing notices within 14 days of the entry of this order.

Therefore,

IT IS ORDERED that Petitioner is HELD IN DEFAULT.

IT IS FURTHER ORDERED that the defaulted party shall cure the default, as indicated

above, within 14 days of the entry of this order.i

Failure to comply with this order will result in the defaulted party being required to file a

motion to set aside the default (with appropriate filing fee).
