ORDER VACATING ORDER OF DISMISSAL

ORDER REINSTATING CASE

The Tribunal has considered the file in this case and finds that it entered an Order of

Dismissal on October 23, 2024. The Tribunal erred in the entry of this Order because

the evidence submitted demonstrates that the petition was timely postmarked within the

35-day appeal period to the Tribunal at the correct address. The appeal was therefore

timely filed and is properly pending under MCL 205.735a(6). As such, the Tribunal finds

good cause to vacate the Order and reinstate the case. Therefore,

IT IS ORDERED that the Order of Dismissal is VACATED.

IT IS FURTHER ORDERED that the case is REINSTATED.

IT IS FURTHER ORDERED that Respondent shall file an answer within 28 days of this

Order.

ORDER OF DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that:

The petition was not filed by July 31 or the next business day after the Tribunal offices

were closed. See MCL 205.735a(6).

Therefore,

IT IS ORDERED that the case is DISMISSED.

This Order resolves all pending issues and closes the case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

record on appeal. There is no certification fee.

The purpose of this appeal has to do with The recently received property taxes far 2024 for my Staepef property purchased in July 2023. My Summer property aves by itseff went

up three times the amaunt of my entire 2023 property taxes. When

| compare it ta other properties that have sold in the area In 2023-2024 (see below), the sales price ranged

from $140,000 lo $482,000 within a mile radius of my property. Based on the properties sold below at the average cost of $64.44 per sq feet, for

a 2,944 sq ft property, the

estimated True Cash Value should have bean $189,711 instead of the $325,458 as shown on my Natice of Assessment, Since the Taxable Value should be half of the

estimated True Cash Value of the $189,716, the Taxable Value should have been $94,858 instead of $125,500 as shown on the denial letter from the 2024 March Board of
