ORDER GRANTING JOINT STIPULATION FOR ENTRY OF CONSENT JUDGMENT

CONSENT JUDGMENT

The Tribunal has reviewed the Stipulation and finds that it comports with the mandates

of State law.1 As a result, the Tribunal shall enter the parties’ Stipulation. Therefore,

IT IS ORDERED that the Joint Stipulation for Entry of Consent Judgment including all

attachments, terms and conditions is GRANTED and ADOPTED, unless otherwise

indicated.

IT IS FURTHER ORDERED that the officer charged with maintaining the assessment

rolls for the tax years at issue shall correct or cause the assessment rolls to be

corrected to reflect the property’s true cash and taxable values as provided in this

Consent Judgment within 20 days of the entry of the Consent Judgment.2

IT IS FURTHER ORDERED that the officer charged with collecting or refunding the

affected taxes shall collect taxes and any applicable interest or issue a refund as

required by the Consent Judgment within 28 days of the entry of the Consent

Judgment. If a refund is warranted, it shall, unless otherwise indicated, include a

proportionate share of any property tax administration fees paid and of penalty and

refunded. A sum determined by the Tribunal to have been unlawfully paid shall, unless

otherwise indicated, bear interest from the date of payment to the date of judgment and

the judgment shall bear interest to the date of its payment. A sum determined by the

Tribunal to have been underpaid shall not bear interest for any time period prior to 28

days after the issuance of this Consent Judgment. Pursuant to MCL 205.737, interest

Re: Docket 24-003390

MICHIGAN TAX TRIBUNAL

2070 Cartier, Flint, MI 48504

Petitioner: Danish Cooper Retirement LLC

Agent -—Joen Bodtker

History:

The property was purchased on the open market for $48,700 on Jan 26, 2024.

The City of Flint assessed the property at $49,500. This infers a market value of $99,000.

Grievance:

The petitioner maintains the selling price on the open market is the market value. Given the

condition of the property, it is considered a fair valuation for that location and time. The

petitioner contends the assessed value should be no more than $25,000 at the time of

purchase.

Appended Argument:

The property was acquired to be used as a rental. To bring it up to a condition that would

attract good citizens, $21,500 in repairs were made. The total cost to acquire and prepare

the property is $70,200. The petitioner asserts the property would have been worth no

more than $70,000 if the repairs werent needed. The property is now registered with the

City as a rental and has passed rental inspection.

Appraisal Format Comparisons

When considering

the condition and size of the house, the assessor’s calculation appears

to be overestimated. This comparison applies after the repairs were made to 2070 Cartier.

Conclusion:

The assessor's office based it’s ruling on the sales prices of “similar” properties in the area.

Comparing homes sold in the area of like condition from the prior 12 months, the $70,000

market value is supported only after repairs were made. Given the condition of 2070

Seller’s realtor: Katie White, Katie White Real Estate Group

Buyer’s realtor: Alyssa Pillsbury, Crown Realty

The City of Flint assessed the property at $49,500. This infers a market value of $99,000.

Grievance:

The petitioner maintains the selling price on the open market is the market value. Given the

condition of the property; it is considered a fair valuation for that location and time. The

"petitioner contends the assessed value should be no more than $25,000 at the time of

The property was acquired to be used as a rental. To bring it up to a condition that would

the property is $71,200. The petitioner asserts the property would have been worth no

more than $70,000 if the repairs weren't needed. The property is now registered with the

Of the above listed comparison properties, 817 Frank is closest in sales price and condition

but it has an additional bedroom. 2524 Thomas was in superior condition compared to

2070 Cartier. 2453 Norbert is also in superior condition and has more living space.

Conclusion:

The assessor’s office based it’s ruling on the sales prices of “similar” properties in the area.

Comparing homes sold in the area of like condition from the prior 12 months, the $70,000

market value is supported only after repairs were made. Given the condition of 2070

Cartier at purchase and adding the abnormal repairs, the petitioner maintains the

assessed value in the first quarter of 2024 should not exceed $32,000. The market value of

Section 5: Explain the Reason for this Appeal

The property was purchased in February 2024 for $48,700.00

The City of Flint rated the assessed value at $49,500.00

This would imply the property value was $99,000.00.

The price paid for the property was on the open market and above other bids.

The condition of the house and property warranted the sales price.

We are requesting the City of Flint reduce the assessed value to $24,350 (50% of the

purchase price) in accordance with Michigan Law.
