ORDER OF DISMISSAL

The Tribunal has considered the file in the above-captioned case and finds that

Petitioner was placed in default on January 21, 2026, for failing to appear at a duly

scheduled hearing. On February 3, 2026, Petitioner filed a response, however they

failed to provide proof evidencing service of the response on Respondent. On February

12, 2026, the Tribunal issued a Notice of No Action indicating the Tribunal will not take

action on the filing unless Petitioner files a proof of service within 14 days of entry of the

notice. Petitioner failed to respond. Although Petitioner failed to comply with the order,

the Tribunal must consider Grimm v Dep’t of Treasury1 prior to the dismissal of this

case. In Grimm, the Michigan Court of Appeals summarized factors that the Tribunal

must consider before imposing the sanction of dismissal. Those factors are:

(1) whether the violation was wilful or accidental; (2) the party's history of

refusing to comply with previous court orders; (3) the prejudice to the

opposing party; (4) whether there exists a history of deliberate delay; (5) the

degree of compliance with other parts of the court's orders; (6) attempts to

cure the defect; and (7) whether a lesser sanction would better serve the

interests of justice.2

Petitioner’s failure to appear at the hearing and failure to comply with the Order of

Default has established a history of deliberate delay. As a result, after giving careful

consideration to the factors involved and considering all options in determining what

sanction is just and proper, the Tribunal finds that dismissal is appropriate, and a lesser

sanction would not be appropriate.

Therefore,

IT IS ORDERED that this case is DISMISSED.

This order resolves all pending claims in this matter and closes this case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after

Dear Ms. Halm,

I hope this message finds you well. Thank you for your correspondence dated January 21, 2026,

regarding my petition before the Michigan Tax Tribunal.

I respectfully state that I did not receive any notice of a scheduled hearing date and was unaware

that a hearing had been set for January 21, 2026. The only information I received pertained to

valuation disclosure requirements for proceedings before the Tribunal. That correspondence did

not include any notice of a hearing date. Please see the attached cover letter and table of contents

for reference.

Because I did not receive proper notice of the hearing, I was unable to appear. I respectfully

request that the Tribunal reconsider this matter and grant me another opportunity for a hearing so

that my petition may be properly addressed on the merits.

I will be traveling overseas during the period February 16 to April 30, 2026. Please contact me

by email if you need further information.

Thank you for your time and consideration of this request.

Section 5: Explain the Reason for this Appeal

I hope this letter finds you well. My name is Adnan Hammad, a 67-year-old retired

senior citizen and wife Safia Saker. We are writing to appeal the recent increase in the

property tax assessment for my residential home, located at 1715 HERON VIEW Court

in West Bloomfield, Michigan.

| purchased my home in a high exaggerated seler market

environment back in September 2023, at which time the annual property tax was

$2,800. However, in February 2024,

| received a notice from West Bloomfield indicating

that my property tax had nearly doubled to $5,900, nore than 100% increase. This

significant increase will create a financial burden that

| am unable to bear. In March

2024,

| appealed this decion to the West Bloomfield Township Assessment Board.

Unfortunately, the board decided not to grant my request, leaving the tax assessment

unchanged. As a retiree, my income is solely dependent on my Social Security check

and a modest 401 (k) contribution. The current tax amount represents almost three

months of my SS income, which is unsustainable for me.

| have multiple chronic

diseases, including a heart condition, and living in this area is essential for me to access
