Assessed Value (also known as State Equalized Value) established
| Taxable Value established by the Board of Review:Page 3
Section 4 Answer. Petitioner appealed to the MBOR. Petitioner purchased for 8/13/2025 $550,00 . Assessed Value is at 50% of market value based upon sales provided by the Respondent Sales Study of Lake Fenton Canal properties. Homes on Lake Fenton canals have NOT sold for $400,000. The range is from $485,000 (with issues reflected in sale price) to $800,000. Petitioner provided 3 sales comparable to the MBOR. The sales provided were the only the ones lower than petitioners sale price in the sales between 4/2023 and 12/31/2025. Tax day for 2026 assessments is December 31, 2025 NOT December 31, 2026. March Board of Review reviewed and found the following on supplied comparable by petitioner. There were 15 sales within the sales study time frame used by Assessor. All homes below not comparable due to construction type and condition compared to subject property. These were only 3 lower than subject sale price and were supported in the market as such. 1. 13386 Fenton Road sold $485,000. This sale included a damaged home under partial construction for the entire basement level, smoke damage in the main level and sever! other issues with the home. Assessor walked through the home with the new owners. 2. 1365 Blue Water Home sold for $488,000 with no updates and home very outdated from the 1970's. Home currently re sold with no changes at $500,000 3. 2414 Cranewood again home is out dated with no updates sold for $525,000 Subject property although a smaller home on the lake has a nice size yard and almost double the frontage as comparable provided by petitioner at 100ft. Home is of brick construction on all 4 sides and 1008 sf is utilized for valuation as comparable are not. Home has been updated including a custom kitchen and both bathrooms. Also noted that the record card states recreational finish of 504 s.f., after reviewing it appears the basement finish has been updated to include finishes and wetbar which should be moved to living finish. Seller provided a home warranty on the home with the sale

MICHIGAN TAX TRIBUNAL
Holly Michelle Manssur,
Petitioner, Pro Per
v.
Charter Township of Fenton,
Respondent
MTT Docket No. 26-000436
PETITIONER'S PREHEARING BRIEF IN SUPPORT OF A TRUE CASH VALUE OF
$500,000
I. INTRODUCTION
Petitioner, Holly Michelle Manssur ("Petitioner"), respectfully submits this Prehearing
Brief in support of her opinion that the subject property's 2026 True Cash Value is
$500,000.
Petitioner does not dispute that the recent arm's-length purchase is relevant evidence of
value. However, the purchase price alone does not establish the property's True Cash
Value. Petitioner respectfully submits that the evidence presented in this appeal
supports a True Cash Value of $500,000.
II. FACTUAL BACKGROUND
The subject property is a single-family ranch residence located on a canal connected to
Lake Fenton within Fenton Township, Genesee County, Michigan.
According to the property's MLS listing, the home contains approximately 1,008 square
feet of above-grade living area, two bedrooms, two full bathrooms, and a walkout
basement. (Exhibit C) The residence was originally constructed in 1968 and is situated
on approximately 0.21 acres with approximately 100 feet of canal frontage.
The property was listed for sale on April 30, 2025 with an original asking price of
$639,500. After exposure to the open market, the property ultimately sold on August 13,
2025 for $550,000 in what both parties acknowledge was an arm's-length transaction.
(Exhibits A and B)Page 2
2 For the 2026 tax year, Respondent determined that the property had a True Cash Value of $589,800, resulting in an assessed value and taxable value of $294,900. Petitioner's protest before the March Board of Review was denied, after which this appeal was timely filed. Throughout these proceedings, Petitioner has consistently maintained that the property's True Cash Value is $500,000, based upon the comparable market sales and the subject property's overall market position. III. OVERVIEW OF THE PARTIES' POSITIONS The parties do not substantially disagree regarding the relevant facts surrounding the purchase of the property. Rather, the dispute centers upon the weight that should be given to the valuation evidence. Respondent's Answer relies principally upon three points in support of its opinion of value: (1) Petitioner's recent arm's-length purchase of the subject property; (2) Respondent's review of fifteen comparable sales; and (3) Respondent's criticisms of Petitioner's comparable sales. Petitioner respectfully submits that Respondent's conclusion is not sufficiently supported by the evidence presented in this proceeding. While Respondent references a review of fifteen comparable sales, Respondent has not provided the underlying sales analysis, market adjustments, or valuation methodology necessary to evaluate how those sales support the asserted value. Petitioner has instead presented comparable market sales that support a True Cash Value of $500,000 and respectfully submits that those sales, considered together with the subject property's characteristics, provide the more persuasive indication of market value. IV. ANALYSIS OF RESPONDENT'S VALUATION EVIDENCE Respondent concludes that the subject property's 2026 True Cash Value is $589,800. Petitioner respectfully submits that the evidence presented does not adequately explain or support that conclusion. Respondent's Answer relies upon three primary points: 1. Petitioner's recent purchase of the property for $550,000; (Exhibits A and B) 2. An internal review of fifteen comparable sales; and 3. Respondent's opinion that Petitioner's comparable sales are less persuasive than Respondent's valuation.
Page 3
3 Petitioner respectfully addresses each point below. A. The Recent Purchase Is Relevant Evidence, But It Does Not Independently Establish a True Cash Value of $589,800. Petitioner does not dispute that the August 2025 purchase was an arm's-length transaction and represents relevant evidence of market value. However, Respondent's valuation is not $550,000. Respondent determined that the property's True Cash Value as of December 31, 2025, was $589,800, $39,800 higher than Petitioner's purchase price only a few months earlier. The issue before the Tribunal is therefore not whether Petitioner's purchase is relevant. Rather, the issue is whether the record contains sufficient evidence supporting Respondent's conclusion that the property's market value increased to $589,800 during that relatively short period. Petitioner respectfully submits that Respondent's Answer does not explain how that conclusion was reached. B. Respondent References a Fifteen-Sale Analysis but Does Not Present the Supporting Data. Respondent states that fifteen comparable sales were reviewed in determining the subject property's assessed value. Petitioner does not question that such an analysis may have been performed. However,

The subject property was purchased recently and reflects current market conditions. Comparable homes in the area are selling closer to the mid-$400,000 range. The subject property is smaller, has fewer bedrooms and upgrades, and only a partially finished walkout basement compared to these properties. STATE OF MICHIGAN GRETCHEN WHITMER GOVERNOR DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS LANSING ORLENE HAWKS DIRECTOR Fenton Michigan 48430 Taxing Authority (City or Township) Township Of Fenton (GENESEE) County Genesee Section 4: Issues Being Appealed (check all that apply) True Cash and Taxable Value Section 5: Explain the Reason for this Appeal The assessed value exceeds the property’s true cash value and is not supported by recent comparable sales. The subject property was purchased recently and reflects current market conditions. Comparable homes in the area are selling closer to the mid-$400,000 range. The subject property is smaller, has fewer bedrooms and upgrades, and only a partially finished walkout basement compared to these properties. Therefore, the current assessment does not accurately reflect fair market value and should be reduced accordingly. I purchased my home last fall.
