Denise Shelton,

Petitioner, MICHIGAN TAX TRIBUNAL

 SMALL CLAIMS DIVISION

v

 MTT Docket No. 24-004051

City of Detroit,

Respondent.

ORDER OF DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that:

The issue in this case is already pending in another case and, as such, this appeal is

duplicative and shall be dismissed.

Therefore,

IT IS ORDERED that the case is DISMISSED.

This Order resolves all pending issues and closes the case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

Page 2

MTT Docket No. 24-004051

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

Section 4: Issues Being Appealed (check all that apply)

Poverty Exemption, Taxable Value Only (calculation)

Section 5: Explain the Reason for this Appeal

I. The city of Detroit accessors office said they sent a survey for years 2022 and 2023 for homestead property to my home, and that I didn't return it in a timely

manner. They actually sent it to a former home and I didn't receive it, until a month or two later. Upon receiving the survey, I immediately contacted the assessor's

office to explain why I hadn't responded to the survey and asked for consideration to respond.

I applied for property homestead tax in 2021 when I purchased my home and then again in 2022, 2023, and 2024, because I noticed I had not received one yet.

II. I was never given a denial for any of the years 2022 or 2023 until December 2023, of which I appealed within the 35 days required. The denial stated the reason

was that did not occupy the property and I have occupied the home for 2 years and 8 months now.

Then in January of 2024 I received a 10,000.00 bill, for each year 2023, 2024 at the same time from the Wayne County treasurer's office saying that I owed back

taxes.

II. The denial is unfair and egregious, because the form for the assessor's offices was sent to an incorrect address, and they had my correct address. Tax valuation is

too high and doesn't line up with similar properties on the same block. The tax for the property when I bought it was$1400.00 that's why I bought it, I could afford it.

I was denied a homestead property tax exemption, because they said I didn't live in the property, and I do.

I wanted a quiet neighborhood to retire in and this was affordable. My taxes is higher than any one in my community, and there is no justification for it. he city put a

20,000.00 tax lien on my property because I didn't fill out a survey they never sent me, but instead sent it to a former address. I am appealing theses reasons.

If No, explain why:

The city of Detroit accessors office said they sent a surey for years 2022 and 2023 for homestead property to my

home, and that I didnt return it in a timely manner. They actually sent it to a former home and I didnt recieve it, until a

month or two later. Upon reieving the survey I immediately contacted the assessors office to explain why I hadnt

responded to the survey and asked for consideration to respond.

I applied for property homestead tax in 2021 when I purchased my home and then again in 2022, 2023, and 2024,

because I noticed I had not recieved one yet. The denial stated the reason was that did not occupy the home and I

have occupied the home for 2 years now. I was never given a denial for for any of the years 2022 or 2023 until

December 2023, of which I appealed within the 35 days required. Then in january of 2024 I recieved a 10,000.00 bill,

for each year 2023, 2024 at the same time from the wayne County treasurue'rs office saying that Iowed back taxes.

The denial is unfair and ergriuos , becuse the form for the assessr's offices was sent to an inncorrect address and

they had my correct address. Tax valuation is too high and dosnt line up with similar proerties on the same block. The

tax for the property when I bought it was$1400.00 thats why I bought it, I could afford it. I was denied a homestead

property tax exemtion, becuause they said I didnt live in the property, and I do.

I wanted a quiet neighborhood to retire in and this was affordable. My taxes is higher than any one in my community,

and there is no justification for it. he city put a 20,000.00 tax lien on my property becuase I didnt fill out a survey they

never sent me, but instead sent it to a former address. I am appealing theses reasons.
