RE: Re-filing Property Tax Appeal — Docket #25 - 003 §p4

Parcel No: 64-006-320-018-00

Petitioner: Andrew Petersen

Dear Tribunal Clerk,

I'am re-submitting my property tax appeal petition, which

I previously mailed prior to the July

31 deadline. Although my check was dated July 20, 2025, and successfully deposited on August

6,2025, I did not obtain a USPS postmark at the time of mailing.

I also did not have the date

written on my tax appeal petition form. I now understand that this resulted in my original petition

being marked late.

I have enclosed a completed appeal form, all supporting documentation, and the required $25

late fee check for processing.

I respectfully ask that the Tribunal accept this petition and allow

my appeal to proceed.

Thank you for your consideration.

Sincerely,

Clr fir

ORDER OF DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that:

The petition was not filed by July 31 or the next business day after the Tribunal offices

were closed. See MCL 205.735a(6). As such, and inasmuch as the Tribunal has no

equitable power to waive or otherwise disregard statutory filing requirements and

deadlines, it has no authority to hear the appeal or grant the relief requested. See

Sixarp, LLC v Byron Twp, __Mich__;

_ NW3d__ (2025).

ie

Therefore,

IT IS ORDERED that the case is DISMISSED.

This order resolves all pending issues and closes the case.

APPEAL RIGHTS

1

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

em

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

;

system; it must be filed by mail or personal service. The fee for the filing of such

Je

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals.

If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.”

If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

ORDER DENYING PETITIONER’S MOTION FOR RECONSIDERATION

On October 24, 2025, Petitioner filed a motion requesting that the Tribunal reconsider

the Order of Dismissal entered in this case on October 9, 2025. In the motion,

Petitioner states they are resubmitting the petition that was previously mailed prior to

the July 31 deadline.

The Tribunal has considered the motion and the case file and finds that Petitioner is

appealing a decision of Respondent’s 2025 March Board of Review. Given that the

subject property is classified as residential real property, the petition was required to be

filed by July 31, 2025. In this case, the petition was filed on August 5, 2025. Petitioner

claims the petition was mailed prior to the deadline; however, the envelope containing

the petition was not postmarked by the post office. Therefore, according to TTR 225(5),

“[a] submission without a postmark or with an illegible postmark is considered filed on

the date the submission is received by the tribunal.” The petition was received by the

State of Michigan on August 5, 2025, as evidenced by the money stamp imprinted on

page one of the petition. Therefore, Petitioner’s petition was not timely filed. Given the

above, Petitioner failed to demonstrate a palpable error relative to the dismissal that

misled the Tribunal and the parties and that would have resulted in a different

disposition if the error was corrected.1 Therefore,

IT IS ORDERED that Petitioner’s Motion for Reconsideration is DENIED.

This order resolves all pending claims in this matter and closes this case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a claim of appeal with

the Michigan Court of Appeals. If the claim is filed within 21 days of the entry of the final

decision, it is an “appeal of right.” If the claim is filed more than 21 days after the entry

1 See MCR 2.119(F)(3). A palpable error is one that is “easily perceptible, plain, obvious, readily visible,

noticeable, patent, distinct, or manifest.” Luckow v Luckow, 291 Mich App 417, 426 (2011) (quotation

marks and citation omitted).

of the final decision, it is an “appeal by leave.” A copy of the claim of appeal must be

filed with the Tribunal to certify the record on appeal. There is no certification fee.

Subject: Explanation of Late Proof of Service — Docket No. 25-003564

Dear Clerk of the Tribunal,

Fam writing to provide the enclosed Proof of Service form and to explain the delay in submitting

this required item in relation to my appeal for the property located at 713 N Golden Sands Dr.

Mears, MI 49436

; Parcel No. 64-006-320-018-00.

After receiving the Notice of Docket dated October 9, 2025, I regretfully did not realize that 1

,

was required to notify Golden Township by mail at that time. I take responsibility for this

oversight. I also understand that a reminder notice was later issued by the Tribunal, but I did not

[

receive it due to a clerical address error: the notice was sent to "Chicago, MI" instead of

"Chicago, IL," and as a result, it never reached me.

In January 2026, upon contacting the Tribunal by phone,

I learned for the first time that my

appeal was being delayed due to the missing Proof of Service. Your office kindly advised that a

corrected notice would be reissued and my address updated, which

I appreciate. In February

2026, I am still having an issue with mail delivery sent from the Tax Tribunal since my address

remains Chicago, MI in the system.

3

As of today, I have now mailed a copy of the petition and docket notice to Barbie Eaton at

Golden Township in Mears, MI as required. The signed Proof of Service form is enclosed with

5

this letter.

:

Thank you for your attention to this matter, and I respectfully ask that my appeal be allowed to

proceed.
