Petitioner,

SMALL CLAIMS DIVISION

v

MTT Docket No. 25-003171

City of Detroit,

Presiding Judge

Respondent.

Patricia L. Halm

ORDER OF DISMISSAL

On October 31, 2025, Petitioner filed a response to the Order of Default issued on

October 14, 2025.

The Tribunal has considered the file in this case and finds that Petitioner was held in

default for failing to pay the filing fee required for the filing of the petition and failing to

file a copy of the notice giving rise to the appeal. While Petitioner responded with the

proper filing fee, Petitioner’s attempt to set aside the default is incomplete because the

response lacked a copy of the notice giving rise to the appeal.

Further, the Tribunal finds that Petitioner is seeking reimbursement for overpayment of

taxes associated with the denial of a principal residence exemption, extending beyond

the three proceeding tax years. However, Petitioner’s appeal is premature, as such

requests must first be filed with the Michigan Department of Treasury pursuant to MCL

211.7cc(20), which states:

An owner who owned and occupied a principal residence within the time

period prescribed in subsection (2) in any year before the 3 immediately

preceding tax years for which the exemption was not on the tax roll as a

result of a qualified error on the part of the local tax collecting unit may file

a request for the exemption for those tax years with the department of

treasury.

As such, and inasmuch as Petitioner failed to exhaust their administrative remedies, the

Tribunal has no jurisdiction to consider the request. The Tribunal’s authority is limited to

“a proceeding for direct review of a final decision, finding, ruling, determination, or order

of an agency relating to assessment, valuation, rates, special assessments, allocation,

or equalization, under the property tax laws of this state.”1 If there is no final decision,

finding, ruling, determination or order, the Tribunal has no jurisdiction to consider the

petitioner’s appeal. Therefore,

IT IS ORDERED that the case is DISMISSED.

1 MCL 205.731(a).

Page 2

MTT Docket No. 25-003171

This order resolves all pending claims in this matter and closes this case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

information.

EVIDENCE: Parties are required to submit all evidence to the Tribunal and send a copy

to the opposing party at least 21 days before the hearing date even if the documents

had been submitted to the local Board of Review or the Michigan Department of

Treasury. If the documents are not timely submitted to the Tribunal and served on the

submitting a Request for Redactions. The Request for Redactions form will be

available on the Entire Tribunal and Small Claims pages of our website.

Alternate Dispute Resolution Options

INFORMAL SETTLEMENT CONFERENCE: Parties have the option of handling this

case through an informal settlement conference. An informal settlement conference

is a meeting between the parties and/or their representatives to discuss the issues in a

case in an effort to settle the case. This process may be an alternative to a hearing with

a judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent

Judgment. Visit the Tribunal’s ADR webpage for more information.

NOTE: The parties may not request an informal settlement conference to discuss an

appeal of a principal residence exemption that was denied by either the Michigan

Department of Treasury or a County. Also, state taxes levied by the Michigan

Department of Treasury, such as income taxes, are not subject to the informal

settlement conference process.

MEDIATION: Parties have the option of handling this case through mediation.

Mediation is a voluntary process where a mediator facilitates communication between

the parties, assists in identifying issues, and helps explore solutions to promote a

mutually acceptable settlement. This process may be an alternative to a hearing with a

judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent

Judgment. Visit the Tribunal’s ADR webpage for more information.

If you have any questions, please contact the Tribunal by phone at (517) 335-9760 or

email taxtrib@michigan.gov.

Section 4: Explain Your Answer to this Appeal

The petitioner did not have a PRE on the property. When the application was submitted to us, we applied the PRE at 100% for the current year and three years prior,

which is as far as we can go back per state law.

Our records indicate that it there were several transfers since 1999, including Property Transfer Affidavit filed on 02/07/2007 with a purchase price of $194,000

from Walter Stevenson to Gwendolyn, another PTA filed 06/28/2013 for 30,000 from Bank of America to Walter Stevenson.

Ms. Lila Sareini never told the petitioner that there was a glitch in the system, because there was none. He was told that the ownness and responsibility was on the

taxpayer to inform of any errors that may be on the assessment notice and/or tax bill, in which he admittedly does not read.

Section 5: Explain the Reason for this Appeal

I am appealing the decision of the City of Detroit Tax/Treasurer to only give me a refund for overpayment for up to 3 years. However, the overpayment of my

property taxes was longer than their 3 year limit.

I have lived in my home as the Primary Residence since I purchased the house in July, 1999. I registered the house as my primary residence for the Homestead tax

incentive. However, I recently found that this designation was changed without my doing – some years ago. When I inquired about the change in primary

residence/homestead status – the representative (Lila – with the city of Detroit Assessor’s Office) I was told that there was likely some kind of computer glitch that

removed me from Primary Residence status – but the refund due me could only go back to 3 years.

I believe that this decision is not fair. I had nothing to do with any glitch or other systems malfunction or mishandled scenario that happened with the city’s assessment

department. I believe that as a tax-payer in the city since 1999 – I am entitled to be reimbursed for all years that I was over-taxed – due to a mishap not caused by my

actions. I have faithfully lived in my home since purchase and I am appealing to this Tribunal for remedy.
