 MTT Docket No. 24-004238

City of Ovid,

Respondent.

ORDER OF DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that:

The petition was not filed by May 31 or the next business day after the Tribunal offices

were closed. See MCL 205.735a(6).

Therefore,

IT IS ORDERED that the case is DISMISSED.

This Order resolves all pending issues and closes the case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

Page 2

MTT Docket No. 24-004238

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

NOTICE OF FILING

TAKE NOTICE that a Small Claims answer has been filed and the electronic copy of the

answer can be reviewed by utilizing the Docket Lookup on the Tribunal’s website.

Unless Respondent was defaulted, this case is ready to be scheduled for a Small

Claims hearing and will be scheduled in the normal course of scheduling. You will

receive a Notice of Hearing from the Tribunal by e-mail if you have identified an email

address in the petition or other documentation. The Notice of Hearing will inform you of

the date, time, and location of your hearing (note that your hearing will likely be

conducted by telephone). Please read the Notice of Hearing as it includes important

information.

EVIDENCE: Parties are required to submit all evidence to the Tribunal and send a copy

to the opposing party at least 21 days before the hearing date even if the documents

had been submitted to the local Board of Review or the Michigan Department of

Treasury. If the documents are not timely submitted to the Tribunal and served on the

opposing party, the documents may be excluded. Documents may be filed with the

Tribunal by mail or through the Tribunal’s e-filing system. Documents may be sent to the

opposing party by mail or by e-mail, if the parties agree to service by e-mail.

Alternate Dispute Resolution Options

INFORMAL SETTLEMENT CONFERENCE: Parties have the option of handling this

case through an informal settlement conference. An informal settlement conference

is a meeting between the parties and/or their representatives to discuss the issues in a

case in an effort to settle the case. This process may be an alternative to a hearing with

a judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent

Judgment. Visit the Tribunal’s ADR webpage for more information.

NOTE: The parties may not request an informal settlement conference to discuss an

appeal of a principal residence exemption that was denied by either the Michigan

Department of Treasury or a County. Also, state taxes levied by the Michigan

Department of Treasury, such as income taxes, are not subject to the informal

settlement conference process.

Section 4: Explain Your Answer to this Appeal

| am uncertain whether the Michigan Tax Tribunal has jurisdiction in this case as the Petitioner missed the

filing deadline. MCL 205.735a(6) indicates that

“The jurisdiction of the tribunal in an assessment dispute

as to property classified under section 34c of the general property tax act, 1893 PA 206, MCL 211.34c, as

commercial real property +++ is invoked by a party in interest, as petitioner, filing a written petition on or

before May 31 of the tax year involved.”

This did not occur. It appears that the petition was received by

the Tribunal on January 7, 2025, although 2024 was erroneously stamped on the form.

If the Michigan Tax Tribunal rules that they do have jurisdiction, the facts of the case are as follows. The

subject property consists of 3 parcels, two commercial store fronts and a large second story storage area.

The parcels were assessed correctly as individual commercial units in 2024. A clerical error was not

made. Assessment change notices (See attached) were mailed to the Petitioner in February of 2024 to

the address listed on this petition by KCI (a commercial printing and mailing company). The Petitioner did

not protest to the March Board

ORDER GRANTING PETITIONER’S MOTION TO SET ASIDE DEFAULT

ORDER PLACING RESPONDENT IN DEFAULT

On February 24, 2025, Petitioner filed a motion requesting the Tribunal set aside the

default entered in this case on January 21, 2025.

Respondent has not filed a response to the motion.

The Tribunal has considered the motion and the case file and finds that Petitioner was

held in default because they filed the wrong petition, did not pay the full required filing

fee, and did not submit a multi-parcel petition form. Petitioner timely responded but

failed to cure the default, and the Tribunal entered an order extending the time to cure

on February 14, 2025. The Tribunal partly erred in the entry of the February 14, 2025

order because Petitioner paid the fee on February 5, 2025. The fee simply had not

been processed as of the entry of that order. Having now filed the petition, multi-parcel

petition form, petition fee, motion, motion fee, and proof of service of the motion,

Petitioner has complied with the Tribunal’s orders as required by TTR 237. As such, the

Tribunal finds good cause to grant the motion and set aside the default.

The Tribunal further finds that it entered a Notice of Docket Number on January 17,

2025. That notice indicated in pertinent part that Respondent was required to file an

answer to the petition within 28 days. Sufficient time to respond was allowed, but no

response was received. Respondent is therefore subject to default under Tribunal

rules.1 Therefore,

IT IS ORDERED that Petitioner’s Motion to Set Aside Default is GRANTED.

IT IS FURTHER ORDERED that Respondent is held in DEFAULT.

IT IS FURTHER ORDERED that Respondent must complete the following to cure the

default: file an answer to the petition. The foregoing must be filed with the Tribunal

1 TTR 237.

Page 2

MTT Docket No. 24-004238

within 14 days of entry of this Order.2

Failure to comply with this Order will result in Respondent being required to file a motion

to set aside the default (with appropriate filing fee).

ORDER OF PARTIAL DISMISSAL

ORDER EXTENDING TIME FOR PETITIONER TO CURE DEFAULT

The Tribunal has considered the file in this case and finds that Petitioner filed this

appeal on December 27, 2024, disputing the true cash and taxable values of Parcel

Nos. 580-000-018-010-01, 580-000-018-011-00, and 580-000-018-011-01 for the 2023

and 2024 tax years. However, the Tribunal has no authority over the 2023 tax year as

the petition was not filed prior to the deadline set forth in MCL 205.735a(6).! Although

the petition indicated a purported data entry error with regard to the property's taxable

value, Petitioner's clerical error allegations relate to the 2024 tax year and not the 2023

tax year. As a result, the Tribunal also has no authority under MCL 211.53a, as the

facts alleged do not establish that the subject property's 2023 assessment was the

result of a clerical error (i.e., “an error of a transpositional, typographical, or

mathematical nature”) or a mutual mistake of fact (i.e., “an erroneous belief, which is

shared and relied on by both parties”).2 And though MCL 211.53b provides July and

December Boards of Review with the authority to correct qualified errors, Petitioner did

not appear before Respondent's 2023 July or December Board of Review or appeal an

action taken by any such board.

For the 2024 tax year, even though Petitioner failed to

timely file the appeal by the deadline set forth in MCL 205.735a, the petition indicated

that there is as a question of fact as to whether the jurisdiction of the Tribunal has been

properly invoked. As such,

it is appropriate for the 2024 appeal to move forward with

the Tribunals jurisdiction being a question of fact for hearing.

Furthermore, the Tribunal notes that Petitioner was held in default on January 21, 2025,

1 MCL 205.735a(6) provides that “[t]he jurisdiction of the tribunal in an assessment dispute as to property

classified...as commercial real property, industrial real property, developmental real property, commercial

for failing to file the proper petition form, failing to file a muitiple-parcel valuation form,

and for failing to pay the full, required petition filing fee.® On January 24, 2025,

Petitioner filed the correct valuation appeal petition form and a multiple parcel

attachment to a valuation petition form in

ORDER OF PARTIAL DISMISSAL

ORDER EXTENDING TIME FOR PETITIONER TO CURE DEFAULT

The Tribunal has considered the file in this case and finds that Petitioner filed this

appeal on December 27, 2024, disputing the true cash and taxable values of Parcel

Nos. 580-000-018-010-01, 580-000-018-011-00, and 580-000-018-011-01 for the 2023

and 2024 tax years. However, the Tribunal has no authority over the 2023 tax year as

the petition was not filed prior to the deadline set forth in MCL 205.735a(6).1 Although

the petition indicated a purported data entry error with regard to the property’s taxable

value, Petitioner’s clerical error allegations relate to the 2024 tax year and not the 2023

tax year. As a result, the Tribunal also has no authority under MCL 211.53a, as the

facts alleged do not establish that the subject property’s 2023 assessment was the

result of a clerical error (i.e., “an error of a transpositional, typographical, or

mathematical nature”) or a mutual mistake of fact (i.e., “an erroneous belief, which is

shared and relied on by both parties”).2 And though MCL 211.53b provides July and

December Boards of Review with the authority to correct qualified errors, Petitioner did

not appear before Respondent’s 2023 July or December Board of Review or appeal an

action taken by any such board. For the 2024 tax year, even though Petitioner failed to

timely file the appeal by the deadline set forth in MCL 205.735a, the petition indicated

that there is as a question of fact as to whether the jurisdiction of the Tribunal has been

properly invoked. As such, it is appropriate for the 2024 appeal to move forward with

the Tribunal’s jurisdiction being a question of fact for hearing.

Furthermore, the Tribunal notes that Petitioner was held in default on January 21, 2025,

1 MCL 205.735a(6) provides that “[t]he jurisdiction of the tribunal in an assessment dispute as to property

classified…as commercial real property, industrial real property, developmental real property, commercial

personal property, industrial personal property, or utility personal property is invoked by a party in interest,

as petitioner, filing a written petition on or before May 31 of the tax year involved.
