ORDER DENYING PETITIONER’S MOTION FOR RECONSIDERATION

On October 2, 2025, Petitioner filed a motion requesting that the Tribunal reconsider the

Order of Dismissal entered in this case on September 16, 2025. In the motion,

Petitioner states that the Tribunal erred in dismissing the appeal because Respondent

has a history of mailing documents to the wrong address and they did not receive the

principal residence exemption (PRE) audit questionnaire.

The Tribunal has considered the motion and the case file and finds that Petitioner has

failed to demonstrate a palpable error relative to the Order of Dismissal that misled the

Tribunal and the parties and that would have resulted in a different disposition if the

error was corrected.1 The Tribunal properly concluded that it has no authority over

Petitioner’s appeal because it was not filed within 35 days of the PRE denial, as

required by MCL 211.7cc and MCL 205.735a.2 Although Petitioner contends that they

did not receive the PRE denial,3 the Michigan Supreme Court recently reaffirmed that

the Tribunal lacks any equitable authority to assume jurisdiction in cases presenting

potential due-process violations when the statutory requirements for filing an appeal

under MCL 205.735a have not been met, and that jurisdiction in such cases may only

be vested upon the Tribunal by a judicial body with powers of equity.4 The same

reasoning applies to the filing and protest requirements of MCL 211.7cc.

Therefore,

IT IS ORDERED that Petitioner’s Motion for Reconsideration is DENIED.

1 See MCR 2.119(F)(3). A palpable error is one that is “easily perceptible, plain, obvious, readily visible,

noticeable, patent, distinct, or manifest.” Luckow v Luckow, 291 Mich App 417, 426 (2011) (quotation

marks and citation omitted).

2 The PRE denial is dated January 2, 2024, and Petitioner did not file this appeal until September 24,

2024.

3 Although the Motion for Reconsideration only references the PRE Audit Questionnaire, Petitioner filed a

letter with the Tribunal on November 1, 2024, indicating that they did not receive the PRE denial.

4 Sixarp, LLC v Byron Twp, __Mich__ (2025). See also Federal-Mogul Corp v Dep’t of Treasury, 161

Mich App 346 (1987), Elec Data Sys Corp v Flint Twp, 253 Mich App 538 (2002), and VanderWerp v

Plainfield Twp, 278 Mich App 624 (2008), noting that the Tribunal’s powers are limited to those authorized

by statute and do not include powers of equity.

ORDER OF DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that:

The petition was not filed within 35 days after the final decision, ruling, or determination.

See MCL 205.735a(6). As such, and inasmuch as the Tribunal has no equitable power

This order resolves all pending issues and closes the case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Page 2

MTT Docket No. 24-003532

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

a judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent

Judgment. Visit the Tribunal’s ADR webpage for more information.

NOTE: The parties may not request an informal settlement conference to discuss an

appeal of a principal residence exemption that was denied by either the Michigan

Department of Treasury or a County. Also, state taxes levied by the Michigan

Department of Treasury, such as income taxes, are not subject to the informal

settlement conference process.

RE: MTT Docket No. 24-003532

I am writing to address a matter regarding my property taxes and to clarify my situation concerning the

delinquency notice I received.

To date, I have not received a Pre-Denial Letter from the State of Michigan or the City of Detroit. The

only correspondence I have received is a Notice of Property Tax Delinquency from the Wayne County

Treasurer, indicating that "according to their records, the 2023 and/or prior year’s property taxes remain

unpaid."

In response to this notice, I contacted the Wayne County Treasurer’s Office to discuss the delinquency

and to clarify that I have resided in my home since its purchase on August 17, 2017. Throughout this

period, my property taxes have been consistently paid through my mortgage company’s escrow account.

During this call, I was advised to reach out to the Assessor’s Office for further assistance.

Upon contacting the Assessor’s Office, I discovered that my mailing address was incorrectly recorded in

Warren, MI, where I lived at the time of purchase. I requested a correction to my address, which has

since been updated. The Treasurer’s Office then advised me to contact the Michigan Tax Tribunal (MTT)

to explain my situation. Following their guidance, I submitted a Property Appeal Form for Principal

Residence/Qualified Agricultural Exemption on September 24, 2024. Additionally, I filed a PRE Affidavit

and a PRE Prior Year Adjustment Supporting Documentation Request with the Assessor’s Office on

September 26, 2024.

Most recently, I received a Notice of Docket Number on October 31, 2024, and an Order of Default from

the MTT on November 1, 2024. I am eager to resolve this matter and look forward to your ruling.

Thank you for your attention to this issue. Please do not hesitate to reach out if you require any further

information.

Sincerely,

Treena Guy

By state law, all delinquent taxes are payable to the Wayne County Treasurer’s Office. According to our records, the 2023 and/or prior year’s property

taxes for the listed property remain unpaid. If these taxes are not paid before March 1, 2025, this property will be FORFEITED to the Wayne

County Treasurer for non-payment of taxes and any person holding a legal interest may lose that interest as a result of the forfeiture and subsequent

foreclosure proceedings.

If the property is forfeited, a $175 title search fee and a $30.00 recording fee will be added to the delinquent taxes on March 1, 2025. In

addition, the interest rate will be increased from 1% to 1.5% per month, 18% per year, retroactive to March

1, 2024, and interest will continue to

accrue at the rate of 1.5% per month until paid. Partial payments will be accepted, however, in order to avoid foreclosure, all forfeited
