ORDER DENYING PETITIONER’S MOTION FOR RECONSIDERATION

On January 17, 2026, Petitioner filed a motion requesting that the Tribunal reconsider

the Order of Dismissal entered in this case on January 8, 2026. In the motion,

Petitioner states that their computer was hacked in late September and they lost a lot of

information that was not recently saved. Petitioner is still trying to retrieve as much as

they can remember; this was very upsetting to them and their main focus.

The Tribunal has considered the motion and the case file and finds that Petitioner failed

to demonstrate a palpable error relative to the Order of Dismissal that misled the

Tribunal and the parties and that would have resulted in a different disposition if the

error was corrected.1 Dismissal was proper due to Petitioner’s failure to appear at the

December 11, 2025 hearing and the default order that was subsequently entered on

December 12, 2025. The hearing notice and default order were properly sent to

Petitioner at their email address of record and Petitioner does not contend that it did not

receive the hearing notice. It appears that Petitioner received the dismissal order given

the timely filing of the instant motion requesting reconsideration of that order, which was

sent to the same email address. Unfortunately, personal issues and disruptions do not

constitute good cause for failing to properly prosecute an appeal or otherwise establish

palpable error in the entry of the default and dismissal orders. Thus, there are no

grounds for granting reconsideration or reinstating the case. Therefore,

IT IS ORDERED that Petitioner’s Motion for Reconsideration is DENIED.

This order resolves all pending claims in this matter and closes this case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a claim of appeal with

the Michigan Court of Appeals. If the claim is filed within 21 days of the entry of the final

decision, it is an “appeal of right.” If the claim is filed more than 21 days after the entry

1 See MCR 2.119(F)(3). A palpable error is one that is “easily perceptible, plain, obvious, readily visible,

noticeable, patent, distinct, or manifest.” Luckow v Luckow, 291 Mich App 417, 426 (2011) (quotation

marks and citation omitted).

of the final decision, it is an “appeal by leave.” A copy of the claim of appeal must be

filed with the Tribunal to certify the record on appeal. There is no certification fee.

ORDER OF DISMISSAL

The Tribunal has considered the file in the above-captioned case and finds that

Petitioner was placed in default on December 12, 2025, for failing to appear at a duly-

scheduled hearing. Even though Petitioner failed to comply with the order, the Tribunal

must consider Grimm v Dep’t of Treasury1 prior to the dismissal of this case. In Grimm,

the Michigan Court of Appeals summarized factors that the Tribunal must consider

before imposing the sanction of dismissal. Those factors are:

(1) whether the violation was wilful or accidental; (2) the party's history of

refusing to comply with previous court orders; (3) the prejudice to the

opposing party; (4) whether there exists a history of deliberate delay; (5)

the degree of compliance with other parts of the court's orders; (6)

attempts to cure the defect; and (7) whether a lesser sanction would better

serve the interests of justice.2

Petitioner’s failure to appear at the hearing and failure to comply with the Order of

Default has established a history of deliberate delay. As a result, giving careful

consideration to the factors involved and considering all options in determining what

sanction is just and proper, the Tribunal finds that dismissal is appropriate, and a lesser

sanction would not be appropriate.

Therefore,

IT IS ORDERED that this case is DISMISSED.

This order resolves all pending claims in this matter and closes this case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

MTT Docket No. 24-003379

Dear Sir/Madam:

This letter, and the documentation that follow, serve as Respondent’s evidence submission

relative to the above noted small claims appeal.

The Property at Issue

The sole tax parcel at issue in this case, 15-28-201-044, contains a single family residence

located at 10122 Margaret Drive, Hamburg Township (“Subject Property”). 1 The property is

located at the end of a residential cul-de-sac and, on the eastern side of the property, has frontage

on Bass Lake.2 The Subject Property and multiple other parcels in the area also have frontage on

an L-shaped canal that feeds into Bass Lake.3 The subject’s frontage is on the south side of the

parcel.4 Using Livingston County GIS the Subject Property appears to have roughly 115 feet of

frontage on Bass Lake and 253 feet of frontage on the canal for a total frontage of 368.5

The Special Assessment District

On or around February 2024, Hamburg Township received a voter signed Petition

requesting that the Township establish a “canal dredging special assessment district” to dredge the

L-shaped canal between Margaret Drive and Kress Road.6 The proposed district would include a

total of sixteen lots and contain every single parcel that had land frontage on the canal.7 Of the

4.88 acres in the proposed district the owners of 4.18 acres, or 85.60% of the total, signed the

petition requesting the Township enact the Special Assessment District (“SAD”).8

A timeline of the SAD establishment is as follows:

• On March 5, 2024 the Township adopted a resolution to proceed with the project and

prepare an estimate of costs.9 A second resolution was adopted to schedule the first public

hearing on the SAD for April 2, 2025 and send notice to all parcels in the proposed

district;10

• The cost estimate indicated that the total amount for dredging would be $113,810 or

$7,113.12 per parcel.11

• On March 20, 2024 notice was sent to all parcels in the proposed SAD as to a public hearing

on the matter to occur on April 2, 2024;12

• On March 26, 2024 Petitioner filed a letter protest regarding the proposed SAD;13

• A hearing was held on April 2, 2024 and, at its April 16, 2024 meeting, the Township

approved the SAD petition, estimate, the proposed roll, and directed that notice be issued

of a second public hearing to hear additional protests, if any, and vote on the matter.14

• On April 24, 2024 notice was sent to all parcels in the proposed SAD alerting them of a

May 7, 2024 public hearing where the SAD would be voted on;15

• Petitioner appeared and submitted a written protest at the May 7, 2024 hearing. Following

public comment, the Township approved the SAD on the same day in the total of $113,810

or $7,133.12 per parcel.16

In short, the Township approved a dredging special assessment under the Township Public

Improvement Act, MCL 41.721 et seq. Dredging is specifically identified as a permissible SAD

purpose by MCL 41.722(1)(n)(“ The construction, improvement, and maintenance of a lake, pond,

river, stream, lagoon, or other body of water or of an improvement to the body of water. This

subdivision includes, but is not limited to, dredging.”) All statutory steps were followed and the

SAD was legally established.

disproportionality between the amount assessed and

Re: Margaret Dr. Area Canal Dredging Project

Explaination for the Reason for this Appeal

As a homeowner,

| have been a part of the Campbell Subdivision Association

since 1977.

Over the past several years our Association has had many meeting in reference

to dredging the canal. This has been an ongoing problem for homeowners on

Section 4: Explain the Reason for this Appeal

The sole purpose of dredging the canal is so that those who live on the canal have

access to the lake.

I'm considered lake front property. Although

| have property on the canal

| do not use or

need access of the canal to get onto the lake.

My dock is on the lake and

| have a paddleboat and a small fishing boat. The part of the

canal that is being dredge is 18' from my seawall, and the problem isn't so much the

canal but beyond the canal opening which go into the lake.

Taking this into consideration, the non usage of the canal to access the lake and the

financial burden

it would have on me as a retired single person homeowner, I'm

requesting to withdraw my name/property from this special Assessment.

Re: Margaret Dr Area - Canal Dredging Special Assessment District

Dear Hamburg Township,

I'm submitting this letter to the Township Board so that

| may submit my

appeal to the MTT with my right to remove my support from this project.

| attended all the meetings and my undestanding of dredging the canal

was the sole purpose for those who live on the canal to have access to the

lake.

| do not live on the canal,

| live on the lake as my property is considered

lakefront, although

| do have some property that runs along the canal.

| do not

have a need of the canal to get onto the lake by boat or use the canal for

docking my boat.

At our last association meeting it was pointed out to me that my property

was determined lakefront and that

| would not be comsidered to be part of the

canal dredging process, so therefore, taking this all into consideration,

| would

like to remove myself from this project.

Sincerely,
