MTT Docket No. 24-003379

Dear Sir/Madam:

This letter, and the documentation that follow, serve as Respondent’s evidence submission

relative to the above noted small claims appeal.

The Property at Issue

The sole tax parcel at issue in this case, 15-28-201-044, contains a single family residence

located at 10122 Margaret Drive, Hamburg Township (“Subject Property”). 1 The property is

located at the end of a residential cul-de-sac and, on the eastern side of the property, has frontage

on Bass Lake.2 The Subject Property and multiple other parcels in the area also have frontage on

an L-shaped canal that feeds into Bass Lake.3 The subject’s frontage is on the south side of the

parcel.4 Using Livingston County GIS the Subject Property appears to have roughly 115 feet of

frontage on Bass Lake and 253 feet of frontage on the canal for a total frontage of 368.5

The Special Assessment District

On or around February 2024, Hamburg Township received a voter signed Petition

requesting that the Township establish a “canal dredging special assessment district” to dredge the

L-shaped canal between Margaret Drive and Kress Road.6 The proposed district would include a

total of sixteen lots and contain every single parcel that had land frontage on the canal.7 Of the

4.88 acres in the proposed district the owners of 4.18 acres, or 85.60% of the total, signed the

petition requesting the Township enact the Special Assessment District (“SAD”).8

A timeline of the SAD establishment is as follows:

• On March 5, 2024 the Township adopted a resolution to proceed with the project and

prepare an estimate of costs.9 A second resolution was adopted to schedule the first public

hearing on the SAD for April 2, 2025 and send notice to all parcels in the proposed

district;10

• The cost estimate indicated that the total amount for dredging would be $113,810 or

$7,113.12 per parcel.11

• On March 20, 2024 notice was sent to all parcels in the proposed SAD as to a public hearing

on the matter to occur on April 2, 2024;12

• On March 26, 2024 Petitioner filed a letter protest regarding the proposed SAD;13

• A hearing was held on April 2, 2024 and, at its April 16, 2024 meeting, the Township

approved the SAD petition, estimate, the proposed roll, and directed that notice be issued

of a second public hearing to hear additional protests, if any, and vote on the matter.14

• On April 24, 2024 notice was sent to all parcels in the proposed SAD alerting them of a

May 7, 2024 public hearing where the SAD would be voted on;15

• Petitioner appeared and submitted a written protest at the May 7, 2024 hearing. Following

public comment, the Township approved the SAD on the same day in the total of $113,810

or $7,133.12 per parcel.16

In short, the Township approved a dredging special assessment under the Township Public

Improvement Act, MCL 41.721 et seq. Dredging is specifically identified as a permissible SAD

purpose by MCL 41.722(1)(n)(“ The construction, improvement, and maintenance of a lake, pond,

river, stream, lagoon, or other body of water or of an improvement to the body of water. This

subdivision includes, but is not limited to, dredging.”) All statutory steps were followed and the

SAD was legally established.

The valuation component

As to the issue of value, “a special assessment will be declared invalid only when the party

challenging the assessment demonstrates that there is a substantial or unreasonable

disproportionality between the amount assessed and the value which accrues to the land as a result

of the improvements.”17 “[I]t is not the task of courts to determine whether there is a rigid dollar-

for-dollar balance between the amount of the special assessment and the amount of the benefit . .

. ."18 The burden of proof is on Petitioner as “to effectively challenge special assessments,

plaintiffs, at a minimum, must present credible evidence to rebut the presumption that the

assessments are valid. Without such evidence, a tax tribunal has no basis to strike down special

assessments.”19 Failure to rebut the presumption of validity is determinative and Respondent’s

proofs need not be considered.

A paired sales analysis using a property within the SAD provides the best evidence of the

impact of the special assessment on value. Parcel 4715-28-201-003, a single family residence

located at 10024 Kress Drive, sold on January 21, 2022, before the SAD was levied, for $295,000

in an arm’s length transaction.20 The property sold again on June 27, 2025, after the SAD was

levied, in an arm’s length transaction for $405,000.21 In the 41 months between the sales dates, the

value of the residence increased 37%. According to RedFin, the average home sale price in

Livingston County, where the subject was located, was $299,894 in January 2022 and $405,000

in June 2025.22 That indicates a total market conditions increase of 26% or .6% per month using

41 months. When applied to the comparable sale, if only market conditions are accounted for, the

indicated value in June 2025 is $361,000.23 However, the property had a roof replaced in December

2023.24 If $10,000 of value is added for a roof in 2023 and the same market conditions are applied,

the indicated value in June 2025 is $372,000. This property is located east of the subject and only

fronts on the canal.

Even accounting for the roof and market conditions, there is a $33,000 difference that is

attributable to the special assessment work, which was billed at $7,133.12 per parcel.

When applied to the subject property, the value before the assessment was $654,000.25 If the

$33,000 value increase indicated by the paired sales analysis is reduced by 31% to account for the

fact that only 69% of the subject’s water frontage is on the canal, the indicated benefit is $22,770

indicating a post-improvement value of $676,770. That is proof that the $7,133.12 per parcel

amount assessed as part of the SAD is reasonable proportionate to the increase in value.

The SAD was correctly established, legal, and the assessment is supported by a paired sales

analysis. The Tribunal must affirm the assessment.

PETITION FOR THE MARGARET DRIVE

CANAL DREDGING PROJECT

Hamburg Township, Livingston County, Michigan

We the undersigned, as the record owners of land constituting more than 50% of the total

land area in a proposed special assessment district described in the attached Appendix B, hereby

respectively PETITION THE HAMBURG TOWNSHIP BOARD

for certain waterway

improvements as described below (the “Project”) under authority of the Township Public

Improvements Act (Act No. 188, Public Acts of Michigan, 1954, as amended), for the Margaret

Drive area located

in Hamburg Township.

The property owners request that method of

assessment assigned for the costs associated with the proposed improvement project be assessed

on a per parcel basis.

Project Description:

The project consists of establishing a canal dredging special

assessment district to benefit those property owners having use of the canal to access their

properties located between Margaret Drive and Kress Road.

Waterway improvements shall consist of:

1)

Homeowners shall be responsible

to request and obtain all necessary permits from

Michigan Department of Environment, Great Lakes and Energy (EGLE). Permits are

required for dredging submerged areas pursuant to Parts 301, Inland Lakes and Streams,

Part 303, Wetlands Protection, and/or Part 325, Great Lakes Submerged Lands, of the

Natural Resources and Environmental Protection Act, 1994 PA 451, as amended;

2)

The Contractor shall dredge Area #1- approx. 35°x 125° of the canal with a Floating

Dredge as far as can be reached from shore. Removal of approx. 3-ft. of muck. Spoils will

be pumped into dewatering bag. Area #2 — Contractor shall dredge approx. 75° x 50° of

the canal with a Floating Dredge as far as can be reached by shore. Removal of approx. 3°

of muck. Spoils shall be pumped into a dewatering bag. Homeowners shall be responsible

to move/grade spoils when dry from Area #1

and Area #2. Homeowners shall be

responsible for all costs for any soil erosion control measures required by permits.

Contractor is to provide a dewatering bag (903 cubic yards) as well as a turbidity curtain

during dredging activities;

Exhibit 2: 2 of 55

3)

4.)

5)

6.)

Exhibit 2: 2 of 55

The canal dredging spoils shall be transported and graded by a second Contractor selected

by the Homeowners.

The Contractor shall load and remove approx. 550 yards of

somewhat dry spoils off site to a nearby area not more than 15 miles, the location to be

determined at the time of the canal dredging. Contractor will re-grade the disturbed area

where dewatering bag sits for project, and will seed and mulch the complete area.

Property owners understand that the proposed canal dredging project will be designed,

scheduled and completed by their designated Contractor(s). The Township shall not be

liable for nor insure, warrant or guarantee the quality or longevity of the proposed

waterway improvements. Hamburg Township shall act only in the capacity of collecting

funds from the property owners within the designated special assessment district (SAD)

to pay for the proposed canal dredging.

Property owners understand and agree to the conditions contained within the bid provided

by their designated Contractor(s).

The Township will not intervene in disputes between

the property owners and the Contractor(s).

Property owners request that the canal dredging project be established for a ten (10) year

period with the initial payment of the special assessment district to be collected on the

December 1%, 2024 winter tax bill,

We, the petitioners, further understand that the costs of the Project (including any related

engineering and legal costs) may be assessed against all lands in the proposed district.

In the

event that the Special Assessment District (S.A.D.) is not created, the undersigned agree to

reimburse the Township for all such costs that the Township may reasonably assess against our

property. Such assessed costs may be divided in equal annual installments payable over a period

to be determined by the Township Board in accordance with such Act.

Re:

Margaret Drive Area — Canal Dredging Special Assessment District

Notice of First Public Hearing

Dear Property Owner,

Enclosed is a copy of the Notice of Improvement Hearing to establish the Margaret Drive

Area canal dredging special assessment district (SAD). Details of the proposed dredging work is

described

in

the enclosed

Notice.

The proposed waterway

rehabilitation

project

will

be

designed, scheduled and constructed by the property owner's designated Contractors.

The Township Board has scheduled the first public hearing for Tuesday, April 2", 2024

to begin at 3:30 p.m. at the Township Offices located at 10405 Merrill Road.

The purpose of

the meeting is to discuss the desire to establish the district, the district boundaries and the

estimated

cost

of the

project.

The

estimated

waterway improvement

project

cost

is

$113,810.00 which will be split equally among 16 parcels in an assessment of $7,113.12 per

parcel plus interest charges under a ten (10) year bond re-payment schedule. Please be advised

that the estimated cost per parcel may increase if any property owner(s) requests to combine

their separate parcels into a single parcel.

At this time, the interest rate has been estimated at

5.50% at the advice of our bond counsel based on current market conditions, however, this is

only an estimate and the final interest rate will not be known until the bond to finance the

special assessment districts has been sold this summer.

Any property owner or owners who wish to object to the SAD or to remove their

support for the project must submit

a letter in writing to the Township by the first public

hearing on April 2".

Requests to rescind your signature(s) from the petition must also be

received in writing prior to the end of the public hearing. Letters may be addressed to me or

the Township Clerk, Michael Dolan, and mailed to Hamburg Township, P.O. Box 157, Hamburg.

MI 48139.

If after the first public hearing there is still enough support to move forward with

establishing the special assessment district the Board will pass a resolution to schedule the 2"

public hearing for the purpose of discussing the Assessment Roll and adoption by the Township

Board which will authorize the collection of the special assessments that will first appear on the

December 1, 2024 tax bill.

If you would like to discuss the canal dredging project before the public hearing please

feel free to contact the Township Supervisor, Patrick J. Hohl, at (810) 231-1000 Ext. 202 or his

direct line at (810) 222-1116 or via email at pathohl@hamburg.mi.us.

Re: Margaret Dr Area - Canal Dredging Special Assessment District

Dear Hamburg Township,

I'm submitting this letter to the Township Board so that

| may submit my

appeal to the MTT with my right to remove my support from this project.

| attended all the meetings and my undestanding of dredging the canal

was the sole purpose for those who live on the canal to have access to the

lake.

| do not live on the canal,

| live on the lake as my property is considered

lakefront, although

| do have some property that runs along the canal.

| do not

have a need of the canal to get onto the lake by boat or use the canal for

docking my boat.

At our last association meeting it was pointed out to me that my property

was determined lakefront and that

| would not be comsidered to be part of the

canal dredging process, so therefore, taking this all into consideration,

| would

like to remove myself from this project.

Sincerely,

Sharon Wietecha
