NOTICE OF FILING

TAKE NOTICE that a Small Claims answer has been filed and the electronic copy of the

answer can be reviewed by utilizing the Docket Lookup on the Tribunal’s website.

Unless Respondent was defaulted, this case is ready to be scheduled for a Small

Claims hearing and will be scheduled in the normal course of scheduling. You will

receive a Notice of Hearing from the Tribunal by e-mail if you have identified an email

address in the petition or other documentation. The Notice of Hearing will inform you of

the date, time, and location of your hearing (note that your hearing will likely be

conducted by telephone). Please read the Notice of Hearing as it includes important

information.

EVIDENCE: Parties are required to submit all evidence to the Tribunal and send a copy

to the opposing party at least 21 days before the hearing date even if the documents

had been submitted to the local Board of Review or the Michigan Department of

Treasury. If the documents are not timely submitted to the Tribunal and served on the

opposing party, the documents may be excluded. Documents may be filed with the

Tribunal by mail or through the Tribunal’s e-filing system. Documents may be sent to the

opposing party by mail or by e-mail, if the parties agree to service by e-mail.

Alternate Dispute Resolution Options

INFORMAL SETTLEMENT CONFERENCE: Parties have the option of handling this

case through an informal settlement conference. An informal settlement conference

is a meeting between the parties and/or their representatives to discuss the issues in a

case in an effort to settle the case. This process may be an alternative to a hearing with

a judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent

Judgment. Visit the Tribunal’s ADR webpage for more information.

NOTE: The parties may not request an informal settlement conference to discuss an

appeal of a principal residence exemption that was denied by either the Michigan

Department of Treasury or a County. Also, state taxes levied by the Michigan

Department of Treasury, such as income taxes, are not subject to the informal

settlement conference process.

MEDIATION: Parties have the option of handling this case through mediation.

Mediation is a voluntary process where a mediator facilitates communication between

the parties, assists in identifying issues, and helps explore solutions to promote a

mutually acceptable settlement. This process may be an alternative to a hearing with a

judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent

Judgment. Visit the Tribunal’s ADR webpage for more information.

Assessed Value (also known as State Equalized Value) established

| Taxable Value established by the Board of Review:

Page 4

SECTION 4: ANSWER TO APPEAL 26-001071

A 2026 record card is attached. The total 2026 property Assessed Value is $246,100 and the

total 2026 property Taxable Value is $240,844.

The home is new construction that began in 2024 and was completed in 2025. Pictures are

included for 2024 and 2025.

The assessed and taxable values in 2025 included 45% of the

completed new home construction.

The 2026 assessed and taxable values contain the

completed structure value.

The 2026 values were determined

by analyzing sales

in

Buchanan Township. The comparable sales provided by the Petitioner were not located in

Buchanan Township. Outside sales were not needed to complete the sales studies. Land

Values were determined first. The 2026 land value analysis is attached.

Sales were then

analyzed to determine the appropriate economic condition factor (ECF) needed to apply to

the structure values at their level of completion.

The ECF spreadsheet showing how the

economic condition factor was determined is also attached.

Lastly the remaining new

construction value was added to arrive at the final 2026 values of $246,100 assessed value

and $240,844 taxable value.

Per Petitioner’s un-dated building contract, the original “cost to build” was $293,000.

Cost

does not equal value.

A building permit was issued by the local building inspector on

6/24/2024 with

a home value of $426,000. The building permit was paid for by the contractor

on 7/24/2024 with a home value of $426,000.

The building permit application states a

permit fee is $6.00 per thousand dollars in value. The building permit lists the permit fee as

$2,556.00.

(2,556/6=425X 1,000 = $426,000). A copy of the building permit application,

building permit, and building permit receipt are attached.

Petitioner's Appeal Sheet does contain an error on the subject property under “Values per

Mindy Cole-Crocker”.

Petitioner used the attached record card to obtain values for the

analysis. See below:

“VALUES PER MINDY COLE-CROCKER”

Subject Property

Values stated by Petitioner

Actual Values Per Mindy

Cole-Crocker

Land Value

$70,000

$70,000

Page 5

The subject property exterior concrete size

is 5,776 square feet (see record card). The cash

value

of the concrete is $43,744. This error in value changes the petitioner’s subject property

Fair Market Value from $401,790 to $439,759 and the petitioner’s subject property Fair

Assessed

Section 5: Explain the Reason for this Appeal

My wife and

| purchased 6 acres in 2021 to build our retirement home. We completed

construction in March, 2025. The lot cost $56,000 and the contract to build was

$293,000, for a total cost of $349,000. Our house is assessed at $246,000 or a market

value of $492,200. Our appeal to the Board was denied saying it reflected the state cost

manual. We disagree and presented facts to the contrary. We searched for a local

builder and found one that builds a nice house at a fair price. They have built our exact

house multiple times in a rural subdivision 4.5 miles from our house. They have cost

efficiencies by building only 3 models; a small ranch (ours), the same ranch with a

larger footprint, and a 2-story. They completed building on all of the lots in 2025 and we

gave the Board the most recent 2 comps. These were the larger ranches, so after

adjusting for the difference in square footage and lot sizes, and using the most recent

comp, came up with a Fair Market Value of $401,790 or Fair Assessed Value of

$200,895. (Summary attached) Our Assessor said the manual was an average of all

new homes built in MI. We feel that the actual cost to build should take priority over the

state manual and are being penalized for being able to build below the average.
