v

MTT Docket No.24-003882

City Of Milan,

Respondent.

ORDER OF DISMISSAL

The Tribunal has considered the file in the above-captioned case and finds that

Petitioner was placed in default on April 8, 2026, for failing to appear at a duly-

scheduled hearing. Even though Petitioner failed to comply with the order, the Tribunal

must consider Grimm v Dep’t of Treasury1 prior to the dismissal of this case. In Grimm,

the Michigan Court of Appeals summarized factors that the Tribunal must consider

before imposing the sanction of dismissal. Those factors are:

(1) whether the violation was wilful or accidental; (2) the party's history of

refusing to comply with previous court orders; (3) the prejudice to the

opposing party; (4) whether there exists a history of deliberate delay; (5)

the degree of compliance with other parts of the court's orders; (6)

attempts to cure the defect; and (7) whether a lesser sanction would better

serve the interests of justice.2

Petitioner’s failure to appear at the hearing and failure to comply with the Order of

Default has established a history of deliberate delay. As a result, giving careful

consideration to the factors involved and considering all options in determining what

sanction is just and proper, the Tribunal finds that dismissal is appropriate, and a lesser

sanction would not be appropriate.

Therefore,

IT IS ORDERED that this case is DISMISSED.

This order resolves all pending claims in this matter and closes this case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

Re: MTT Docket 24-003882,

Oak Tree Residential LLC v City of Milan

Dear Honorable Tribunal,

Please accept the following as the respondent’s evidence in the above reference docket number

scheduled to be heard April 8, 2026 at 2:30 PM. Included in the evidence is the sales comparison

analysis with map, 2024, 2025, 2026 record cards and valuation reports for subject property,

ECF and Land analysis for neighborhood in which subject is located for 2024, 2025, and 2026.

These documents are to support the respondent’s sales comparison approach and cost approach

in which was used in determining the market value for the subject property.

Subject property is a 1,752 square foot two story home built in 1890 (estimated). It sits on a

platted lot just west of downtown Milan. There is 1 full bath and one half bath. The

Respondent’s True Cash Value for 2024 is 243,800 ($139.21 / sqft). The 2024 Assessed Value

and Taxable Value is 121,900.

Comparable sales one through three are all within the valuation time period for 2024 values. All

are similar in view, design, style, quality, condition, exterior, and have exterior garages.

Comparable #1 is 115 First Street. This property is just 0.12 of a mile away from the subject

property and located 0.1 of a mile northwest of downtown Milan. This property was estimated to

have been built within the same time period as the subject property and is a two story home of

1,636 square feet on a Michigan basement and crawlspace foundation. This property sold in May

of 2022 for $239,000 – approximately $146 per square foot. I applied a conservative time

adjustment of 2.5% per year (0.2083% per month). This added $4 per square foot and bringing

the market adjusted value to $150/SF. This building has one bath, so a $1,500 adjustment was

applied. Because this property sits on a Michigan basement and crawl, a $2,000 adjustment was

applied. After the total adjustments were applied, the adjusted dollar per square foot was brought

to $152 and an adjusted sale price of $248,475.

Comparable #2 is 320 Wabash. This property sits on the West side of Wabash, just .3 of a mile

South of downtown Milan. This is a two story; 1,728 square foot residential home built in 1950.

This has two full bathrooms and sits on a basement foundation. This sold in May of 2023 for

$260,000; or at $150 per square foot. Because of the sale date, there was no market (time)

adjustment for this sale. Because this home was built newer than the subject, a negative $5,000

Page 2

PAGE 2 OF 2 PAGES

adjustment was made. There was also a -$3,000 adjustment made for an extra full bath. After

making all adjustments, the adjusted price per square foot was $146 / Sqft – bringing the

adjusted sale price to $252,000.

Comparable #3 is 8 Ann St. This is a 1,584 square foot two story home located in a residential

neighborhood just 0.2 of a mile north of downtown Milan. This sits on a Michigan basement and

has one full bath. This was built in 1918. This home sold July of 2021 for $230,000 ($145 per

square foot). After the market (time) adjustment was made, the adjusted market rate was $152

per square foot. There was an adjustment of $1,500 for only having one full bath. There was a

$2,000 adjustment for the Michigan basement foundation. There was a net adjustment of $2

bringing the adjusted price per square foot to $154 per square foot.

After reviewing all of the comparable sales, the most weight was given to comparable #1 being

the most similar to the subject property. Being as the subject property was valued at $139 per

square foot, respondent respectfully requests the Honorable Tribunal to uphold the True Cash

Value of 243,800, and an assessed value of 121,900. The taxable value would remain the same at

121,900.

Respondent’s 2024 TCV: 243,800

Respondent’s 2024 AV: 121,900

Respondent’s 2024 TV: 121,900

Based on the ECF analysis for 2025, there was a 4.266% increase to the assessed value. With the

market adjustment applied, the assessed value increased to 127,100. The taxable value increased

by the rate of

ORDER OF PARTIAL DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that Petitioner

is appealing assessments for prior tax years and the Tribunal has no authority over

those assessments under MCL 205.735a, as the petition was not timely filed.1 Further,

the Tribunal also has no authority over those assessments, as the facts alleged do not

establish that the assessments were the result of a clerical error (i.e., “an error of a

transpositional, typographical, or mathematical nature”) or a mutual mistake of fact (i.e.,

“an erroneous belief, which is shared and relied on by both parties”).2 Rather, the facts

alleged indicate a valuation dispute that does not involve the correction of a clerical

error or mutual mistake of fact. Therefore,

IT IS ORDERED that Petitioner’s assessment appeal is PARTIALLY DISMISSED. The

appeal shall continue for the 2024 tax year(s) only.
