MTT Docket No: 26-002384

_______________________________________________________________________________

SUBMISSION TO CURE DEFAULT AND SUPPLEMENTAL EVIDENCE

________________________________________________________________________________

Dear Tribunal Clerk and Respondent,

Pursuant to the Order of Default entered on September 16, 2026, in the above-captioned

matter, Petitioner respectfully submits this document to CURE the default within the

mandated 14-day period.

1. CURE OF DEFAULT: Attached hereto as Exhibit A is a true and correct copy of the 2026 L-

4400 Notice of Assessment, Taxable Valuation, and Property Classification. This is the final

assessment notice giving rise to this appeal, satisfying the requirement of Tribunal Rule 279

(TTR 279).

2. SUPPLEMENTAL EVIDENCE: Concurrently, Petitioner is submitting supplemental

evidence to further support the petition, including:

 - Exhibit B: Email Correspondence and Appeal Appointment. This document

demonstrates that the Assessor’s office acknowledged the appeal, requested evidence,

Page 2

and later retroactively claimed no written appeal was filed, establishing equitable

estoppel.

 - Exhibit C: Current MLS Listing and Tax History Volatility. This document proves the

property is actively marketed as "gutted" for $14,950, and demonstrates wild, unexplained

tax assessment swings (e.g., $185 in 2023 to $1,857 in 2025) with zero physical

improvements made to the structure.

This submission fully complies with the Tribunal’s September 16, 2026 Order. Petitioner

requests that the default be lifted and the case proceed to the merits based on the

overwhelming evidence of severe overvaluation and administrative inconsistency.

Respectfully submitted,

PART 1: CURRENT MARKET REALITY (MLS LISTING) & REALTOR.COM

=========================================================================

Current Listing Price: $14,950 (Recently increased from $10,000)

Property Details: 2 Bed | 1 Bath | 926 sqft | 0.53 Acre Lot | Built in 1934

PROPERTY DESCRIPTION:

"Perfect for an investor or DIY buyer.

[HIGHLIGHT IN YELLOW]: Home is currently gutted and will need to be refinished. Home will be

sold As Is."

=========================================================================

PART 2: HISTORICAL TAX VOLATILITY

=========================================================================

Year | Taxes | Total Assessment | Notes

----------|------------|------------------|--------------------------------------------------

2022 | $1,568 | $15,600 |

[HIGHLIGHT IN YELLOW]: 2023 | $185 | $19,100 "No physical improvements made.

630% tax increase in one year on a gutted house."

2024 | $1,353 | $26,800 |

[HIGHLIGHT IN YELLOW]: 2025 | $1,857 | $30,000 "Assessment jumped 57% while house

remained gutted."

Page 2

=========================================================================

SUMMARY OF DISCREPANCY

=========================================================================

1. The Township assesses this "gutted" property at a True Cash Value of $60,000 (SEV $30,000).

2. The open real estate market actively lists this exact same gutted property for $14,950.

3. The tax history proves administrative inconsistency: taxes swung from $185 (2023) to $1,857

(2025) with ZERO physical improvements made to the structure.

This demonstrates that the current assessment is arbitrary, capricious, and disconnected from

market reality.
