ORDER GRANTING JOINT STIPULATION FOR ENTRY OF CONSENT JUDGMENT

CONSENT JUDGMENT

The Tribunal has reviewed the Stipulation and finds that it comports with the mandates

of State law.1 As a result, the Tribunal shall enter the parties’ Stipulation. Therefore,

IT IS ORDERED that the Joint Stipulation for Entry of Consent Judgment including all

attachments, terms and conditions is GRANTED and ADOPTED, unless otherwise

indicated.

IT IS FURTHER ORDERED that the officer charged with maintaining the assessment

rolls for the tax years at issue shall correct or cause the assessment rolls to be

corrected to reflect the property’s true cash and taxable values as provided in this

Consent Judgment within 20 days of the entry of the Consent Judgment.2

IT IS FURTHER ORDERED that the officer charged with collecting or refunding the

affected taxes shall collect taxes and any applicable interest or issue a refund as

required by the Consent Judgment within 28 days of the entry of the Consent

proportionate share of any property tax administration fees paid and of penalty and

interest paid on delinquent taxes. The refund shall also, unless otherwise indicated,

separately indicate the amount of the taxes, fees, penalties, and interest being

refunded. A sum determined by the Tribunal to have been unlawfully paid shall, unless

otherwise indicated, bear interest from the date of payment to the date of judgment and

the judgment shall bear interest to the date of its payment. A sum determined by the

Tribunal to have been underpaid shall not bear interest for any time period prior to 28

days after the issuance of this Consent Judgment. Pursuant to MCL 205.737, interest

case through an informal settlement conference. An informal settlement conference

is a meeting between the parties and/or their representatives to discuss the issues in a

case in an effort to settle the case. This process may be an alternative to a hearing with

a judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent

Judgment. Visit the Tribunal’s ADR webpage for more information.

NOTE: The parties may not request an informal settlement conference to discuss an

appeal of a principal residence exemption that was denied by either the Michigan

Department of Treasury or a County. Also, state taxes levied by the Michigan

Department of Treasury, such as income taxes, are not subject to the informal

settlement conference process.

Respondent has reviewed the Judgement of 23-000691 and properly changed the 2023 SEV and Taxable Value.

The 2024 taxable value was corrected to reflect the 2023 judgement and the CPI of 1.05 for the 2024 tax year. (2023 taxable value of 175,515 x CPI 1.05 = 2024

taxable value of 184,290) The 2024 SEV was based on the 2021 through 2023 market study done by the assessing department. The SEV does not/did not increase by

the CPI. Therefore, the 2024 SEV was determined to be 50% of true cash value or market value for the property.

Respondent holds clear that all numbers for 2024 are correct as stated.

2024 SEV: 213,400

2024 Taxable Value: 184,290

January 4, 2024

Pinckney, MI 48169

Michigan Tax Tribunal, Small Claims Division

611 W. Ottawa St.

Lansing, MI 48933

RE: SEVERED 2024 TAX YEAR DOCKET NUMBER 24-004188

To Whom It May Concern:

I believe that my 2024 taxes were inflated and I am seeking a retroactive reduction in

the 2024 SEV and Taxable Value and a refund based on a reduced taxable amount.

I argued a case (MTT Docket# 23-000691-R ) to reduce my 2023 property taxes which were

based on an SEV of $205,123, which I believed was inaccurate since I bought the home on

December 8, 2024 for $351,031. The sales was an arm’s length agreement in a competitive

market, with competing bids. I argued my case on May 7, 2024 and on December 20, 2024 I

received word that I was granted my request for a reduction. The reduced SEV for 2023 was

$175,515.

Based on the reduction, I believe that my 2024 taxes should be reduced also, to an SEV of

$175,515 x the inflation multiplier of 1.05, which would give me a 2024 SEV of $184,291 (an

approximate TCV of $368,582). This would have automatically been the case had the original

2023 value been properly assessed. (SEE PDF PG 7 FOR 2024 ASSESSMENT)

Regarding the question of what I believe my home is worth—a question asked on the Property

Tax petition form—it is asking what I think it’s worth AT THIS TIME.

Based on the Notice of Assessment, Taxable Valuation and Property Classification form for

2024, the SEV is noted at $213,400, which would assume a TCV of $416,800. As I stated

above, I think that the figure of $368,582 is closer to current value.

To further argue for my opinion of current TCV, I have attached information from two larger

homes on Fairwood Rd. (my street) that sold within the past six months. Both homes not only

have more square footage, but were also listed as recently renovated or “modernized.” Both

sold for prices under $400k. (SEE PDF PGS 8-14))

My home has the original bath fixtures, shower stalls, etc. (save for a walk-in tub installed by

the previous elderly owners) and the kitchen has the original 1980’s cabinets. Since kitchens

and baths are considered extremely important to assuring a higher sales price, (therefore a

higher home value), I believe I have a case for stating that my home is certainly worth no more

than either of the larger homes. And, considering the outdated kitchen and baths, it can be

argued that may be worth considerably less. (SEE PDF PG 15 )

I thank the Tax Tribunal for its time and consideration of this matter.

Sincerely,

Lauren Crane

SUMMARY OF JUDGMENT

The subject property’s true cash value (TCV), state equalized value (SEV), and

taxable value (TV), for the tax year at issue, shall be as follows:

Parcel Number: 4714-22-405-008

TV

2023

$351,031

$175,515

$175,515

The 2024 tax year shall be severed and assigned a new docket number.

PROCEDURAL HISTORY

Petitioner was required to protest the subject property’s assessment to the Board

of Review (BOR). Petitioner protested the subject property’s assessment to the 2023

March BOR. Petitioner filed a Petition with the Tribunal on April 13, 2023, and

Respondent filed an Answer on May 10, 2023.

MTT Docket No. 23-000691-R

The amount of SEV or TV in dispute, as set forth in the pleadings, for all tax

years at issue is within the jurisdictional limits of the Small Claims Division.1 Further,

the property’s assessment for subsequent tax years is included in this proceeding.2

ISSUES AND APPLICABLE LAW

The issues in this matter are:

1. Whether the subject property is assessed in excess of 50% of its TCV.

The assessment of real property in Michigan shall not exceed 50% of its TCV.3

“True cash value” means “the usual selling price . . . .”4 “True cash value” means “fair

market value.”5 “The petitioner has the burden of proof in establishing the true cash

value of the property.”6

The Tribunal is required to make an independent determination of TCV.7 “[T]he

tribunal is not bound to accept either of the parties’ theories of valuation. It may accept

one theory and reject the other, it may reject both theories, or it may utilize a

combination of both in arriving at its determination.”8 The Tribunal is required to select

the valuation methodology that is accurate and bears a reasonable relationship to the

property’s TCV.9

2. Whether the TV exceeds the amount provided by MCL 211.27a.

MCL 211.27a provides that a property’s TV is the lesser of the property’s SEV or

capped TV, and a property’s capped TV is, absent a transfer of ownership, determined

mathematically by taking into consideration the prior tax year’s TV, statutory losses, the

lesser of the rate of inflation or 5%, and statutory additions, including omitted property

(i.e., property not previously assessed).10

Petitioner contends the following based on the pleadings, admitted exhibits, and

sworn testimony. Petitioner stated that she purchased the subject property on

December 8, 2022, for $351,000. It was a seller’s market at the time. The subject had

multiple bidders and was an arms-length transaction. Petitioner considered comparable

sales and had an appraisal that found a value of $352,000. The BOR lowered the TV to
