STATE OF MICHIGAN GRETCHEN WHITMER GOVERNOR DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS LANSING MARLON I. BROWN, DPA DIRECTOR MICHIGAN TAX TRIBUNAL · 611 W. OTTAWA ST., LANSING, MI 48933 · 517-335-9760 PO BOX 30232, LANSING, MI 48909 · Other Carriers: 2407 N. GRAND RIVER AVE., LANSING, MI 48906 Kloha Family LLC, Petitioner, MICHIGAN TAX TRIBUNAL SMALL CLAIMS DIVISION v MTT Docket No.25-001612 Township Of Saginaw, Respondent. ORDER OF DISMISSAL The Tribunal has considered the file in this case and finds that Petitioner was placed in default on September 1, 2026, for failing to appear at a duly-scheduled hearing. Even though Petitioner failed to comply with the order, the Tribunal must consider Grimm v Dep’t of Treasury1 prior to the dismissal of this case. In Grimm, the Michigan Court of Appeals summarized factors that the Tribunal must consider before imposing the sanction of dismissal. Those factors are: (1) whether the violation was wilful or accidental; (2) the party's history of refusing to comply with previous court orders; (3) the prejudice to the opposing party; (4) whether there exists a history of deliberate delay; (5) the degree of compliance with other parts of the court's orders; (6) attempts to cure the defect; and (7) whether a lesser sanction would better serve the interests of justice.2 Petitioner’s failure to appear at the hearing and failure to comply with the Order of Default has established a history of deliberate delay. As a result, giving careful consideration to the factors involved and considering all options in determining what sanction is just and proper, the Tribunal finds that dismissal is appropriate, and a lesser sanction would not be appropriate. Therefore, IT IS ORDERED that this case is DISMISSED. This order resolves all pending claims in this matter and closes this case. 1 Grimm v Dep’t of Treasury, 291 Mich App 140 (2010). 2 Id. at 149.

MTT Docket No. 25-001612 Page 2 of 2 APPEAL RIGHTS If you disagree with the final decision in this case, you may file a motion for reconsideration with the Tribunal or a claim of appeal with the Michigan Court of Appeals. A motion for reconsideration must be filed with the Tribunal with the required filing fee within 21 days from the date of entry of the final decision. Because the final decision closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing system; it must be filed by mail or personal service. The fee for the filing of such motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless the Small Claims decision relates to the valuation of property and the property had a principal residence exemption of at least 50% at the time the petition was filed or the decision relates to the grant or denial of a poverty or disabled veterans exemption and, if so, there is no filing fee. You are required to serve a copy of the motion on the opposing party by mail or personal service or by email if the opposing party agrees to electronic service, and proof demonstrating that service must be submitted with the motion. Responses to motions for reconsideration are prohibited and there are no oral arguments unless otherwise ordered by the Tribunal. Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If the claim is filed more than 21 days after the entry of the final decision, it is an “appeal by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the record on appeal. There is no certification fee. By: /s/ Patricia L. Halm Entered: September 23, 2026 PROOF OF SERVICE I

The response must be filed with the Tribunal and served on the opposing party or the opposing party’s authorized representative within 14 days of entry of this order.2 Failure to comply with this order may result in dismissal of this case or the scheduling of a default hearing, as provided by TTR 237. Sale Price $293,540 $169.68/SF Average of Comps $278,768 $151.31/SF Using the sales comparison approach, I adjusted the sale prices of comparable duplexes according to differences between them and the subject properties. There were five sales that occurred within my study. I used the same comparable sales for each subject. There was a minor difference in value due to subject property 12-4-19-1029-000 having a slightly larger lot size of 87x150. Subject property 12-4-19-1027-005 lot size is 86x150. A time adjustment of .02% per day was made to each property to account for the market condition differences between the sale price and the appraisal date. Because the subject properties are newer construction, an adjustment of $1,500 a year was made to each property for the difference in effective age instead of adjusting the year built. Land improvements and land value was adjusted to properties based on value contributed. A square foot (SF) adjustment of $25/ SF was made to all of the properties for the difference in size. The properties that had basements were adjusted down by $2.50/SF and the property with basement finish was adjusted down by $5/SF. Two comparable properties had a 5% adjustment for the quality of construction. The difference in value for a full bath was $2,500 each and half baths were $1,000 each. Once adjustments were made, adjusted sale prices ranged from $257,593-$293,629. Comparable one had the lowest percentage of adjustments, was the closest in effective age and sold the closest to my appraisal date which led me to believe that its adjusted sale price is the best indication of value for the subject properties. My opinion of value for the subject properties is $290,000 each.

BROWN, DPA GOVERNOR LANSING DIRECTOR Section 4: Explain Your Answer to this Appeal The 2025 assessed values do not exceed 50% of the subject properties market values based on comparable sales. Both properties had new duplexes built on them in 2022. According to the building permits filed by the petitioner, the estimated cost of construction of the duplexes were $200,000 each. This does not include land value. The petitioner submitted two properties as comparables to the March Board of Review. The subject properties are duplexes consisting of 2,415 square feet each. The comparable properties the petitioner used were 3 and 4 units. The 3 unit built in 2021 has 4,422 square feet, and the 4 unit built in 2022 has 6,024 square feet. Neither of these properties have sold. They were built and are owned by the developer to be used as rentals. The comparable sales used to support the 2025 assessed values are duplexes similar in size that have sold within the last few years. STATE OF MICHIGAN GRETCHEN WHITMER GOVERNOR DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS LANSING ORLENE HAWKS DIRECTOR Saginaw Michigan 48638 Taxing Authority (City or Township) Township Of Saginaw (SAGINAW) County Saginaw Section 4: Issues Being Appealed (check all that apply) Taxable Value Only (calculation) Section 5: Explain the Reason for this Appeal After reviewing the assessed and taxable value and comparing it to similar properties in the area, I believe that the proposed assessment is significantly overvalued. In support of my claim, I have provided comparisons of newly constructed multi-unit properties in the region, including their values per square foot. Specifically, I have focused on properties that were built in recent years to present an accurate reflection of current market trends. The construction difference in our unit compared to the comparable units is significant. Our unit is pole barn framed on a slab. The construction value is less than the other comparable units which were foundation built with frame construction. Here is what I believe should be assessed to our property. Utilizing the lowest square foot value of the comparable new multi-family properties, which comes to $35.36 per square foot. Applying this to my duplex, which has a total of 2,415 square feet, the value would be $35.36 x 2,415 = $85,394. When considering this the assessed and taxable value of the property would be $85,394 this would make the entire property at a market value of $170,788.00. I respectfully request that the Board reconsider the assessed and taxable value of my property, taking into account the comparisons and analysis provided. I believe this revised valuation more accurately reflects the current market conditions for similar new construction duplexes in Saginaw County. Thank you for your time and attention to this matter. Section 6: Jurisdictional Issues Year(s) you are appealing: 2025 Did you protest the assessment at a Board of Review (BOR)? Yes If Yes, check which BOR you attended AND upload the BOR decision: March If No, check the
