MTT Docket No. 25-003547

City of Detroit,

Presiding Judge

Respondent.

Patricia L. Halm

ORDER GRANTING PETITIONER’S MOTION TO SET ASIDE DEFAULT

ORDER OF DISMISSAL

On November 19, 2025, Petitioner filed a motion requesting that the Tribunal set aside

the default entered in this case on October 7, 2025. Respondent has not filed a

response to the motion.

The Tribunal has considered the motion and the case file and finds that Petitioner was

held in default for failing to submit a copy of the notice giving rise to the appeal.1

Petitioner failed to respond and the Tribunal entered an order extending the time to cure

the default on November 4, 2025, and the order was corrected on November 6, 2025.

Having now filed a Motion to Set Aside Default that explains Petitioner never received a

decision of the March Board of Review (BOR), Petitioner has complied with the

Tribunal’s orders as required by TTR 237. As such, the Tribunal finds good cause to

grant the motion and set aside the default.

A protest to the March BOR is a prerequisite to invoking the Tribunal’s jurisdiction over

such properties under MCL 205.735a. Further, the Tribunal’s authority to hear an

appeal is limited to a “direct review of a final decision, finding, ruling, determination, or

order of an agency relating to assessment, valuation, rates, special assessments,

allocation, or equalization, under the property tax laws of this state.”2 Petitioner’s

Motion to Set Aside Default states that Petitioner protested the assessment to

Respondent’s March BOR, as required by MCL 205.735a. However, because the BOR

did not issue a final decision, the Tribunal lacks authority to consider Petitioner’s appeal.

Petitioner’s contention that the Tribunal should take jurisdiction over this appeal without

a final decision is an argument in equity. The Tribunal has no equitable power to waive

or otherwise disregard statutory filing requirements and deadlines, and it therefore has

no authority to hear the appeal or grant the relief requested.3

1 Though the initial order also defaulted Petitioner for failure to complete section 7 of the petition, this

reason for default was vacated on November 6, 2025.

2 MCL 205.731(a). (Emphasis added.)

3 See Sixarp, LLC v Byron Twp, __Mich__; __NW3d__ (2025).

Page 2

MTT Docket No. 25-003547

As such, and inasmuch as the Tribunal has no equitable power to waive or otherwise

disregard a statutory filing requirement or deadline,4 it has no authority to grant

Petitioner the relief requested.5 Therefore,

IT IS ORDERED that Petitioner’s Motion to Set Aside Default is GRANTED.

IT IS FURTHER ORDERED that this case is DISMISSED.

This order resolves all pending claims in this matter and closes this case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in

CORRECTED ORDER EXTENDING TIME FOR PETITIONER TO CURE DEFAULT

ORDER VACATING NOVEMBER 5, 2025 NOTICE OF NO ACTION

The Tribunal has considered the file in this case and finds that it entered an order

holding Petitioner in default on October 7, 2025, because Petitioner failed to complete

the petition, specifically section 7, and failed to file a copy of the notice giving rise to the

appeal, i.e., March Board of Review (BOR) results.1 Petitioner was required to cure the

default by filing a completed amended petition. Petitioner was also required to obtain a

copy of the BOR results from Respondent and file a copy of those results with the

Tribunal within 14 days.2 Petitioner failed to respond, and on November 4, 2025, the

Tribunal entered an order extending time to cure the default. The Tribunal erred in the

entry of that order because Petitioner timely responded to the order of default on

October 27, 2025; the response had simply not yet been processed. Having now filed

an amended petition, Petitioner has partially complied with the Tribunal’s orders.

Petitioner failed again, however, to include a copy of the BOR results. Though the

Tribunal finds one final extension of time to cure the default appropriate, Petitioner’s

failure to comply with Tribunal orders and its Rules of Practice and Procedure has

established a history of deliberate delay that would justify the dismissal of the case for

failure to timely comply with this order.3

Further, on November 5, 2025, the Tribunal issued a Notice of No Action in response to

Petitioner’s filing of the amended petition, requiring Petitioner to file a Motion to Set

Aside Default. The Tribunal erred in the entry of that notice because the notice was

sent prematurely. Petitioner’s response was filed prior to the issuance of the order

extending default, and therefore, no motion was yet required.4 Therefore,

IT IS ORDERED that the time for Petitioner to cure the default is EXTENDED.

1 The order further stated, “Failure to comply with this order will result in the defaulted party being

required to file a motion to set aside the default (with appropriate filing fee).”

2 A complete list of Tribunal rules and forms can be found online at www.michigan.gov/taxtrib.

3 See Grimm v Dep’t of Treasury, 291 Mich App 140 (2010).

4 Although the issuance of the November 5, 2025 Notice of No Action was erroneous, upon completion of

this order a motion will be required to set aside the default.

Page 2

MTT Docket No. 25-003547

IT IS FURTHER ORDERED that Petitioner must complete the following to cure the

default: (1) file a copy of the March BOR results, (2) file a Motion to Set Aside Default,

and (3) file proof the motion was served on Respondent. The foregoing must be filed

with the Tribunal within 14 days of the entry of this order.5

IT IS FURTHER ORDERED the November 5, 2025 Notice of No Action has been

VACATED.

ORDER EXTENDING TIME FOR PETITIONER TO CURE DEFAULT

The Tribunal has considered the file in this case and finds that it entered an order

holding Petitioner in default on October 7, 2025, because Petitioner failed to complete

the petition, specifically section 7, and failed to file a copy of the notice giving rise to the

appeal, i.e., March Board of Review (BOR) results .1 Petitioner was required to cure the

default by filing a completed amended petition and obtain a copy of the March BOR

results from Respondent and file a copy of those results with the Tribunal within 14

days.2 Petitioner has had ample time to comply, yet has failed to respond or submit the

required filings. Though the Tribunal finds an extension of time to cure the default

appropriate, Petitioner’s failure to comply with Tribunal orders and its Rules of Practice

and Procedure has established a history of deliberate delay that would justify the

dismissal of the case for failure to timely comply with this order.3 Therefore,

IT IS ORDERED that the time for Petitioner to cure the default is EXTENDED.

IT IS FURTHER ORDERED that Petitioner must complete the following to cure the

default: (1) file a completed amended petition, specifically completing section 7, (2) file a

copy of the March BOR results, (3) file a Motion to Set Aside Default, and (4) file proof

the motion was served on Respondent.

IT IS FURTHER ORDERED that the petition shall note the docket number previously

assigned by the Tribunal, and if filing utilizing the Tribunal’s e-filing system, file as an

“Amended Petition.”

The foregoing must be filed with the Tribunal within 14 days of the entry of this order.4

1 The order further stated, “Failure to comply with this order will result in the defaulted party being

required to file a motion to set aside the default (with appropriate filing fee).”

ORDER OF DEFAULT

The Tribunal has reviewed the file in the above-captioned case and finds that:

Petitioner did not submit a copy of the notice giving rise to the appeal (i.e., notice of

action taken by Board of Review, uncapping notice, PRE denial notice, final assessment

notice, etc.), as required by TTR 279. As such, Petitioner must submit the notice within

14 days of the entry of this order.

Furthermore, Petitioner failed to complete section(s) 7 of petition. See TTR 279. As

such, the petition is not properly pending. Petitioner must complete the petition by

providing all information required by each applicable section and return the completed

petition within 14 days of the entry of this order. The petition shall note the docket

number assigned by the Tribunal and if filed utilizing the Tribunal’s e-filing system, must

be filed on the assigned docket number as an “amended petition.” Small Claims petition

forms can be found on our website at www.michigan.gov/taxtrib.

Therefore,

IT IS ORDERED that Petitioner is HELD IN DEFAULT.

IT IS FURTHER ORDERED that the defaulted party shall cure the default, as indicated

above, within 14 days of the entry of this order.i

Failure to comply with this order will result in the defaulted party being required to file a

motion to set aside the default (with appropriate filing fee).
