v

MTT Docket No. 25-003159

City of Detroit,

Presiding Judge

Respondent.

Patricia L. Halm

ORDER OF DISMISSAL

The Tribunal has considered the file in this case and finds that it has no authority over

Petitioner’s appeal. Based on the information provided in the petition and

accompanying documentation, Petitioner is seeking a principal residence exemption

(“PRE”) for the 2025 tax year. However, Respondent indicated in their answer, filed

September 10, 2025, “the City of Detroit did not deny the PRE; there was never an

exemption filed with the City of Detroit.” Petitioner is not appealing the denial of a PRE

by the local taxing authority or other authorized agency but rather is attempting to apply

to the Tribunal directly for such an exemption. Pursuant to MCL 205.731, the Tribunal’s

authority is limited to “a proceeding for direct review of a final decision, finding, ruling,

determination, or order of an agency relating to assessment, valuation, rates, special

assessments, allocation, or equalization, under the property tax laws of this state.”1 If

there is no final decision, finding, ruling, determination or order, the Tribunal has no

jurisdiction or authority, and “a court which has determined that it has no jurisdiction

should not proceed further except to dismiss the action.”2 Petitioner was required,

rather, to file a new PRE affidavit for the 2025 tax year with the assessor of the local tax

collecting unit.3 Therefore,

IT IS ORDERED that the case is DISMISSED.

This order resolves all pending claims in this matter and closes this case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

1 MCL 205.731(a).

2 Fox v Board of Regents of the University of Michigan, 375 Mich 238, 243; 134 NW2d 146 (1985).

33 MCL 211.7cc(19) was amended July 11, 2022 to grant assessors sole authority over the processing of

PRE affidavits “for the current calendar year or the immediately preceding 3 calendar years.” Id.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

Alternate Dispute Resolution Options

INFORMAL SETTLEMENT CONFERENCE: Parties have the option of handling this

case through an informal settlement conference. An informal settlement conference

is a meeting between the parties and/or their representatives to discuss the issues in a

case in an effort to settle the case. This process may be an alternative to a hearing with

a judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent

Judgment. Visit the Tribunal’s ADR webpage for more information.

NOTE: The parties may not request an informal settlement conference to discuss an

appeal of a principal residence exemption that was denied by either the Michigan

Department of Treasury or a County. Also, state taxes levied by the Michigan

Department of Treasury, such as income taxes, are not subject to the informal

settlement conference process.

ORDER EXTENDING TIME FOR PETITIONER TO CURE DEFAULT

On August 17, 2025, Petitioner filed a Petition for the Denial for Principal Residence

Exemption (PRE). Additionally, on August 25, 2025, Petitioner paid the $25 petition

filing fee, both in response to the Tribunal’s August 14, 2025 Order of Default.

The Tribunal has considered the response and the case file and finds that Petitioner

was held in default because Petitioner failed to file a Petition for the Denial of PRE,

failed to file a copy of the notice giving rise to the appeal, i.e. PRE Denial, and failed to

pay the requisite petition filing fee.1 Although Petitioner timely responded to the Order

of Default by filing the petition and paying the filing fee, their attempt to cure is

incomplete because Petitioner failed to include a copy of the PRE denial.2 Though the

Tribunal finds an extension of time to cure the default appropriate, Petitioner’s failure to

comply with Tribunal orders and its Rules of Practice and Procedure has established a

history of deliberate delay that would justify the dismissal of the case, for failure to

timely comply with this order.3 Therefore,

IT IS ORDERED that the time for Petitioner to cure the default is EXTENDED.

IT IS FURTHER ORDERED that Petitioner must complete the following to cure the

default: (1) file a copy of the PRE denial, (2) file a Motion to Set Aside Default, (3) pay

the $25.00 fee required for the filing of the motion, and (4) file proof the motion was

served on Respondent. The foregoing must be filed with the Tribunal within 14 days of

the entry of this order.4

1 The order further stated, “Failure to comply with this order will result in the defaulted party being

required to file a motion to set aside the default (with appropriate filing fee).”

2 TTR 279(3).

3 See Grimm v Dep’t of Treasury, 291 Mich App 140 (2010).

commercial delivery service is considered filed on the date the submission is given to the commercial

service for delivery to the tribunal as indicated by the receipt date on the package containing the

submission. A submission by personal service is considered filed on the date the submission is received.

A submission through the tribunal’s e-filing system by 11:59 p.m. on a business day is considered filed on

ORDER SEVERING PRINCIPAL RESIDENCE EXEMPTION APPEAL AND

ASSIGNING IT TO DOCKET NUMBER 25-003159

ORDER HOLDING PETITIONER IN DEFAULT IN DOCKET NO. 25-003159

ORDER HOLDING PETITIONER IN DEFAULT IN DOCKET NO. 25-002948

On June 5, 2025, Petitioner filed their petition and indicated that the issues being

appealed are the true cash and taxable value of Parcel No. 20018345 and the denial of

a Principal Residence Exemption (PRE) for the same parcel.

The Tribunal has considered the petition and the case file and finds that good cause

exists to sever the petition into two separate dockets given the different procedural and

legal issues pertaining to the valuation of the subject property and Petitioner's claim

regarding the denial of the PRE.

However, the Tribunal notes that there are procedural defects that must be corrected

and addressed on both dockets.

Notably, Petitioner did not pay the required fee for the

filing of the petition or submit a copy of the notice giving rise to the appeal for either

issue. While Petitioner checked the box in the fee information section of the petition

indicating that the subject property has a PRE of at least 50% as of the date of filing the

petition, which would result in no required filing fee, Petitioner is also appealing the

denial of the PRE and indicated in Section 5 of the petition that as of filing, the PRE is

0%. Thus, Petitioner is required to pay the filing fee for both petitions. Therefore,

IT IS ORDERED that Petitioner's appeal regarding the denial of the PRE is SEVERED

and ASSIGNED to Docket No. 25-003159.

filing system, must be filed on the assigned docket as a “Severed Petition,” (2) submit a

copy of the PRE denial notice, and (3) pay the $25.00 filing fee for the filing of the

petition.

IT IS FURTHER ORDERED that Petitioner is HELD IN DEFAULT in Docket No. 25-

002948.

IT IS FURTHER ORDERED that Petitioner must complete the following to cure the

default: (1) file a copy of the action taken by the Board of Review, and (2) pay the

required $125.00 fee for the filing of the petition. The foregoing must be filed with the

Tribunal within 14 days of entry of this order."

Failure to comply with this order will result in Petitioner being required to file a motion to

set aside default (with the appropriate filing fee).
