ORDER GRANTING JOINT STIPULATION FOR ENTRY OF CONSENT JUDGMENT

CONSENT JUDGMENT

The Tribunal has reviewed the Stipulation and finds that it comports with the mandates

of State law.1 As a result, the Tribunal shall enter the parties’ Stipulation. Therefore,

IT IS ORDERED that the Joint Stipulation for Entry of Consent Judgment including all

attachments, terms and conditions is GRANTED and ADOPTED, unless otherwise

indicated.

IT IS FURTHER ORDERED that the officer charged with maintaining the assessment

rolls for the tax years at issue shall correct or cause the assessment rolls to be

corrected to reflect the property’s true cash and taxable values as provided in this

Consent Judgment within 20 days of the entry of the Consent Judgment.2

IT IS FURTHER ORDERED that the officer charged with collecting or refunding the

affected taxes shall collect taxes and any applicable interest or issue a refund as

required by the Consent Judgment within 28 days of the entry of the Consent

Judgment. If a refund is warranted, it shall, unless otherwise indicated, include a

proportionate share of any property tax administration fees paid and of penalty and

interest paid on delinquent taxes. The refund shall also, unless otherwise indicated,

otherwise indicated, bear interest from the date of payment to the date of judgment and

the judgment shall bear interest to the date of its payment. A sum determined by the

Tribunal to have been underpaid shall not bear interest for any time period prior to 28

days after the issuance of this Consent Judgment. Pursuant to MCL 205.737, interest

shall accrue (i) after December 31, 2020, through June 30, 2022, at the rate of 4.25%,

ORDER DENYING JOINT STIPULATION FOR ENTRY OF CONSENT JUDGMENT

The Tribunal has reviewed the case file and finds that a stipulation was filed on

November 28, 2025. On December 2, 2025, the Tribunal issued an order denying this

stipulation because the 2024 stipulated taxable value was not in compliance with MCL

211.27a. However, the order was lacking in that it did not explain that the stipulation

should have also been denied because the stipulation did not include all tax years at

issue in this appeal (2025) or indicate that the parties agree to withdraw tax year 2025.

In that regard, subsequent tax year assessments are automatically included in valuation

and exemption appeals once the assessment has been established for that tax year

unless the Tribunal grants the exclusion of the subsequent tax year.1 For purposes of

administrative efficiency, the Tribunal considers this date April 1st.

On January 13, 2026, the parties filed a stipulation that corrected the 2024 stipulated

taxable value but did not address the 2025 tax year, as explained above. Given this,

the stipulation is not in compliance with MCL 205.737 or TTR 273 and must be denied.

The Tribunal apologizes for the inconvenience that this has caused. Therefore,

IT IS ORDERED that the Joint Stipulation for Entry of Consent Judgment is DENIED.

IT IS FURTHER ORDERED that the previously scheduled hearing shall proceed.

IT IS FURTHER ORDERED that because this Stipulation for Entry of Consent

Judgment is no longer pending before the Tribunal, a new stipulation is required for any

future settlement.

ORDER DENYING JOINT STIPULATION FOR ENTRY OF CONSENT JUDGMENT

The Tribunal has reviewed the case file and the stipulation, filed on November 28, 2025,

Section 5: Explain the Reason for this Appeal

We recieved this new property assessment in January 2024. The Township is claiming

that our home is valued at $414,800. We purchased this home with appraisal in

January 2023 for $360,000. The homes that have sold in this neighborhood with a

similar size are all selling for between $350,000 and $370,000. A home the next street

over with 1000 more square feet and a walkout basement sold for $407,000 last

month-two months after the new assessment. There are no homes in this

neighborhood with our square footage selling for what we have been assessed.

|

supplied the Board of Review examples of 5 homes in our neighborhood that have sold

in the last year in that were in that $350,000-$370,000 range plus our own detailed

appraisal from our home sale, yet the Board of Review stated there was "no supporting

data”.

| beleive that the Township has overreached and is trying to take advantage of

this property being uncapped.
