Deborah Coklow,

Petitioner,

MICHIGAN TAX TRIBUNAL

SMALL CLAIMS DIVISION

v

MTT Docket No.24-003383

City of Detroit,

Respondent.

ORDER OF DISMISSAL

The Tribunal has considered the file in the above-captioned case and finds that

Petitioner was placed in default on October 17, 2025, for failing to appear at a duly-

scheduled hearing. Even though Petitioner failed to comply with the order, the Tribunal

must consider Grimm v Dep’t of Treasury1 prior to the dismissal of this case. In Grimm,

the Michigan Court of Appeals summarized factors that the Tribunal must consider

before imposing the sanction of dismissal. Those factors are:

(1) whether the violation was wilful or accidental; (2) the party's history of

refusing to comply with previous court orders; (3) the prejudice to the

opposing party; (4) whether there exists a history of deliberate delay; (5)

the degree of compliance with other parts of the court's orders; (6)

attempts to cure the defect; and (7) whether a lesser sanction would better

serve the interests of justice.2

Petitioner’s failure to appear at the hearing and failure to comply with the Order of

Default has established a history of deliberate delay. As a result, giving careful

consideration to the factors involved and considering all options in determining what

sanction is just and proper, the Tribunal finds that dismissal is appropriate, and a lesser

sanction would not be appropriate.

Therefore,

IT IS ORDERED that this case is DISMISSED.

This order resolves all pending claims in this matter and closes this case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision,

ORDER OF DEFAULT

The Tribunal has reviewed the file in this case and finds that Petitioner failed to appear

for the duly-noticed hearing scheduled for October 16, 2025. Thus, this case is subject

to dismissal or a default hearing.1 Prior to dismissal or the scheduling of a default

hearing, however, the Tribunal finds that placing the absent party in default and ordering

an explanation and documentation justifying the absence at the proceeding is

appropriate.2 Therefore,

IT IS ORDERED that the absent party is HELD IN DEFAULT.

IT IS FURTHER ORDERED that the defaulted party shall submit information and

documentation as directed above. The response must be filed with the Tribunal and

served on the opposing party or the opposing party’s authorized representative within

14 days of entry of this order.3

Failure to comply with this order may result in dismissal of this case or the scheduling of

a default hearing, as provided by TTR 237.

ORDER DENYING PETITIONER’S MOTION TO AMEND PETITION

On May 7, 2025, Petitioner filed a motion requesting that the Tribunal permit it to amend

the petition filed in this case. In the motion, Petitioner states that they listed the wrong

parcel number, and the correct parcel number is 06002469 (1197 Longfellow).

Respondent has not filed a response to the motion.

The Tribunal has considered the motion and the case file and finds that “a petition or

answer may only be amended by leave of the tribunal.””1 Nevertheless, “[l]eave to

amend must . . . be freely given when justice so required . . . .”2 The Michigan Supreme

Court has held that “a motion to amend should be granted unless one of the following

particularized reasons exists: (1) undue delay, (2) bad faith or dilatory tactics, (3)

repeated failure to cure deficiencies by amendment previously allowed, (4) undue

prejudice to the opposing party, or (5) futility.”3

Given that the instant motion wasn’t filed until 22 days prior to the May 29, 2025

hearing, which left insufficient time for the filing of a response and issuance of an order

prior to hearing,4 the Tribunal finds undue delay in the filing of the motion. More

importantly, however, just as parties cannot substitute or add wholly new and different

parties by way of a motion to amend,5 Petitioner cannot substitute or add a wholly new

and different parcel of real property to this proceeding. The referenced error is not

merely typographical in nature, as evidenced by the vastly different parcel identification

numbers and street addresses for the properties.6 Consequently, not only is the appeal

of Parcel No. 06002469 barred by the statute of limitations, having not been filed on or

before July 31, 2024, it also appears that Petitioner did not protest that property’s

ORDER FOR DEFAULT HEARING

The Tribunal has considered the file in the above-captioned case and finds that

Respondent was placed in default on June 2, 2025, for failing to appear at a duly-

scheduled hearing. Even though Respondent failed to comply with the Order, the

Tribunal must consider Grimm v Dep’t of Treasury1 prior to scheduling a default hearing.

In Grimm, the Michigan Court of Appeals summarized factors that the Tribunal must

consider before imposing the sanction of dismissal.

Though Grimm was specific to the sanction of dismissal, the cases cited by the Court,

and the reasoning behind its adoption of the factors set forth therein are not so narrow.

The factors apply equally to default judgements, or in the case of the Tribunal

proceedings, the conducting of a default hearing.3 Respondent’s failure to appear at the

hearing and failure to comply with the Order of Default has established a history of

deliberate delay. As a result, giving careful consideration to the factors involved and

considering all options in determining what sanction is just and proper, the Tribunal

finds that the scheduling of a default hearing is appropriate, and a lesser sanction would

not be appropriate.

Therefore,

 SMALL CLAIMS DIVISION

v

MTT Docket No. 24-003383

Respondent.

ORDER OF PARTIAL DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that Petitioner

is appealing assessments for prior tax years and the Tribunal has no authority over

those assessments under MCL 205.735a, as the petition was not timely filed.1 Further,

the Tribunal also has no authority over those assessments, as the facts alleged do not

establish that the assessments were the result of a clerical error (i.e., “an error of a

transpositional, typographical, or mathematical nature”) or a mutual mistake of fact (i.e.,

“an erroneous belief, which is shared and relied on by both parties”).2 Rather, the facts

alleged indicate a valuation dispute that does not involve the correction of a clerical

error or mutual mistake of fact. Therefore,

IT IS ORDERED that Petitioner’s assessment appeal is PARTIALLY DISMISSED. The

appeal shall continue for the 2024 tax year(s) only.
