OTTAWA ST., LANSING, MI 48933 · 517-335-9760 PO BOX 30232, LANSING, MI 48909 · Other Carriers: 2407 N. GRAND RIVER AVE., LANSING, MI 48906 David Turner, MICHIGAN TAX TRIBUNAL Petitioner, SMALL CLAIMS DIVISION v MTT Docket No. 25-003077 Buchanan Township, Presiding Judge Respondent. Jason C. Grinnell ORDER DENYING PETITIONER’S MOTION FOR RECONSIDERATION On December 5, 2025, Petitioner filed a motion requesting that the Tribunal reconsider the Order of Dismissal (order) entered in this case on December 3, 2025. In the motion, Petitioner states that they learned in July that the 2024 form was not accepted. They sought to file it, but it was rejected at that time. The Tribunal has considered the motion and the case file and finds that Petitioner has failed to demonstrate a palpable error relative to the Order of Dismissal that misled the Tribunal and the parties and that would have resulted in a different disposition if the error was corrected.1 The Tribunal properly concluded that it has no authority over Petitioner’s appeal because Petitioner is not appealing the denial of a Board of Review decision as required by MCL 211.7b. Although Petitioner contends that Respondent erred in its failure to act on Petitioner’s 2024 exemption submission, the Michigan Supreme Court recently reaffirmed that the Tribunal lacks any equitable authority to assume jurisdiction in cases presenting potential due-process violations when the statutory requirements for filing an appeal under MCL 205.735a have not been met, and that jurisdiction in such cases may only be vested upon the Tribunal by a judicial body with powers of equity.2 Further, Petitioner did not file a Motion to Set Aside default and proof of service of that motion as required by the Tribunal’s November 5, 2025 order. Therefore, IT IS ORDERED that Petitioner’s Motion for Reconsideration is DENIED. This order resolves all pending claims in this matter and closes this case. 1 See MCR 2.119(F)(3). A palpable error is one that is “easily perceptible, plain, obvious, readily visible, noticeable, patent, distinct, or manifest.” Luckow v Luckow, 291 Mich App 417, 426 (2011) (quotation marks and citation omitted). 2 Sixarp, LLC v Byron Twp, __Mich__ (2025). See also Federal-Mogul Corp v Dep’t of Treasury, 161 Mich App 346 (1987), Elec Data Sys Corp v Flint Twp, 253 Mich App 538 (2002), and VanderWerp v Plainfield Twp, 278 Mich App 624 (2008), noting that the Tribunal’s powers are limited to those authorized by statute and do not include powers of equity.

GRAND RIVER AVE., LANSING, MI 48906 David Turner, MICHIGAN TAX TRIBUNAL Petitioner, SMALL CLAIMS DIVISION v MTT Docket No. 25-003077 Buchanan Township, Presiding Judge Respondent. Patricia L. Halm ORDER SETTING ASIDE RESPONDENT’S DEFAULT ORDER OF DISMISSAL The Tribunal has considered the file in this case and finds that Petitioner was placed in default on October 7, 2025, because Petitioner did not file a copy of the notice giving rise to the appeal, i.e. Disabled Veterans Exemption denial notice. On October 11, 2025, Respondent filed their answer yet failed to fully complete the answer form. On November 5, 2025, the Tribunal issued an order holding Respondent in default and extended the time for Petitioner to cure the default by an additional 14 days. On November 7, 2025, Respondent filed a completed answer form and thus complied with the Tribunal’s orders as required by TTR 237. As such, the Tribunal finds good cause to set aside Respondent’s default. However, Petitioner failed to respond and has not complied with either order, and the latter stated that “failure to comply with this Order may result in the dismissal of the case” and referenced Grimm v Dep’t of Treasury.1 In Grimm, the Michigan Court of Appeals summarized factors that the Tribunal should consider before imposing the sanction of dismissal. Those factors are: (1) whether the violation was wilful or accidental; (2) the party's history of refusing to comply with previous court orders; (3) the prejudice to the opposing party; (4) whether there exists a history of deliberate delay; (5) the degree of compliance with other parts of the court's orders; (6) attempts to cure the defect; and (7) whether a lesser sanction would better serve the interests of justice.2 Here, Petitioner’s failure to comply with multiple orders has established a history of deliberate delay. As a result, after giving careful consideration to the factors involved and considering all options in determining what sanction is just and proper, the Tribunal finds that dismissal is appropriate, and a lesser sanction would not be appropriate in light of Petitioner’s history of noncompliance in this case. Therefore, IT IS ORDERED Respondent’s default is SET ASIDE. 1 Grimm v Dep’t of Treasury, 291 Mich App 140 (2010). 2 Id. at 149.

Halm ORDER EXTENDING TIME FOR PETITIONER TO CURE DEFAULT ORDER HOLDING RESPONDENT IN DEFAULT The Tribunal has considered the file in this case and finds that it entered an order holding Petitioner in default on October 7, 2025, because Petitioner failed to file a copy of the notice giving rise to the appeal, i.e., Disabled Veterans Exemption denial notice.1 Petitioner was required to cure the default by filing a copy of the notice within 14 days. Petitioner has had ample time to comply, yet has failed to respond or submit the required filings. Though the Tribunal finds an extension of time to cure the default appropriate, Petitioner’s failure to comply with Tribunal orders and its Rules of Practice and Procedure has established a history of deliberate delay that would justify dismissal of the case for failure to timely comply with this order.2 Further, the Tribunal finds that Respondent filed an answer on October 11, 2025, however Respondent failed to properly complete the answer form.3 Respondent must complete the answer by providing all information required by each applicable section, specifically section 2, and return the completed answer within 14 days of the entry of this order.4 Therefore, IT IS ORDERED that the time for Petitioner to cure the default is EXTENDED. IT IS FURTHER ORDERED that Petitioner must complete the following to cure the default: (1) file a copy of the Disabled Veterans Exemption denial notice, (2) file a Motion to Set Aside Default, and (3) file proof the motion was served on Respondent. The foregoing must be filed with the Tribunal within 14 days of the entry of this order.5 1 The order further stated, “Failure to comply with this order will result in the defaulted party being required to file a motion to set aside the default (with appropriate filing fee).” 2 See Grimm v Dep’t of Treasury, 291 Mich App 140 (2010). 3 TTR 281. 4 Information on Tribunal rules can be found on our website at www.michigan.gov/taxtrib 5 “A submission by mail is considered filed on the date indicated by the United States Postal Service postmark on the envelope containing the submission. ) STATE OF MICHIGAN GRETCHEN WHITMER DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS MARLON I. BROWN, DPA GOVERNOR LANSING DIRECTOR Section 4: Explain Your Answer to this Appeal Petitioner did not apply or file form 5107 "Affidavit for Disabled Veterans Exemption” along with supporting documentation in 2024. Petitioner's wife did call in July of 2025. She stated that because their tax bill displayed "PROPERTY PRE: 100" she must have misunderstood that to mean the Disabled Veterans Exemption had been applied for and granted for the 2024 tax year, Petitioner then discovered that the 2025 Disabled Veterans Exemption had not yet been applied for. Petitioner then applied for the 2025 Disabled Veterans Exemption and was approved. The form 5107 submitted by the petitioner as supporting evidence for this 2024 appeal was never received at the Township. Once again, the petitioner did not file the form 5107 "Affidavit for Disabled Veterans Exemption" along with supporting documentation in 2024. An exemption was not applied for; therefore, an exemption was never denied. This was not a clerical error or a mutual mistake of fact. The exemption was not applied for in 2024.
