Section 4: Explain Your Answer to this Appeal

Principal Residence Exemption was denied because property is held in an LLC.

PR Exemption would be granted if the property was held in a Trust.

Why the different treatment, as both are separate entities?

The property is held in an LLC because

| rent it out through AirBnB (less than 15%).

It is an easy way to supplement my fixed retirement income.

LLC status protects me from personal litigation. It's just smart risk management!

| live in this property 100% (24/7/365), even when letted out to an AirBnB guest.

It is my Principal Residence, so

| am petitioning for the PR Exemption, as the code intended.

Judgment. Visit the Tribunal’s ADR webpage for more information.

NOTE: The parties may not request an informal settlement conference to discuss an

appeal of a principal residence exemption that was denied by either the Michigan

Department of Treasury or a County. Also, state taxes levied by the Michigan

Department of Treasury, such as income taxes, are not subject to the informal

settlement conference process.
