v.

Township Of South Haven, Respondent.

MTT Docket No. 26-002633

RESPONDENT RESPONSE TO ORDER OF DEFAULT

AND NOTICE OF CORRECT SERVICE ADDRESS

Respondent, Township Of South Haven, submits this response to the Order of

Default entered September 30, 2026, to explain the service address error and

identify the correct address for future service.

1. Petitioner's proof of service states that the petition was mailed on August 14,

2026, to the South Haven Township assessor and clerk at 539 Phoenix Street,

South Haven, Michigan 49090. A copy of that proof of service is attached as

Exhibit A.

2. The address of 539 Phoenix Street is the address of the City of South Haven, a

separate municipal entity. It is not the address of South Haven Township. Mailing

documents to the City address did not direct those documents to the Township

offices.

3. The failure to timely answer resulted from this City/Township address mix-up.

Respondent brings the discrepancy to the Tribunal's attention promptly after

learning of the default and intends to defend this appeal on its merits.

4. The correct Township mailing address is:

South Haven Charter Township

Attention Assessor and Clerk

09761 Blue Star Memorial Highway

South Haven, MI 49090

Assessor email: Assessor@Southhaventwpmi.gov

5. Respondent acknowledges that the Order requires an answer to be filed and

served, with proof of service filed, within 14 days of entry. This response explains

the address discrepancy and does not replace the required answer. Respondent

requests that the Tribunal recognize the default as cured upon timely completion

of those requirements and update its service records to reflect the correct

Township address.

Respectfully submitted,

MICHIGAN TAX TRIBUNAL

Property Tax Consultants for 9921 Blue Star Realco LLC,

v

MTT Docket No.

South Haven Township,

PETITION

Petitioner, 9921 Blue Star Realco LLC, through their agent, Property Tax Consultants, petitions this

Tribunal as follows:

1.

Petitioner is 9921 Blue Star Realco LLC, whose principal office or address is 09921 Blue Star

Hwy, South Haven, MI 49090.

Respondent, South Haven Township, establishes levies and collects the property taxes on the

subject property.

The property identification is # 80-17-015-091-00, and the subject property address is 09921

Blue Star Hwy, South Haven, MI 49090. The property is classified as commercial, real property.

Petitioner’s Property is presently used for commercial. Petitioner believes that Petitioner’s

Property was originally designed to be used for commercial.

The property is located in Van Buren County and the school districts of South Haven Public and

the Van Buren Intermediate School District and Lake Michigan College.

This matter involves issues relating to the true cash and taxable values for the parcel referenced

above for the 2026 tax year.

For tax year 2026, Respondent’s Board of Review determined an assessed value of $618,800 a

state equalized value of $618,800 and a taxable value of $618,800.

Petitioner appealed at the 2026 March Board of Review and the requested relief was denied.

The 2026 values set by the respondent are invalid and unlawful as they exceed the amount

allowed by Michigan law and the Michigan Constitution and do not reflect the true cash value of

the fee simple interest as of the applicable tax date.

Petitioner contends the true cash value of the subject property is $612,500 which would yield a

state equalized value of $306,250 and the taxable value is $306,250. The amount in contention is
