ORDER OF PARTIAL DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that Petitioner

is appealing assessments for prior tax years and the Tribunal has no authority over

those assessments under MCL 205.735a, as the petition was not timely filed.1 Further,

the Tribunal also has no authority over those assessments, as the facts alleged do not

establish that the assessments were the result of a clerical error (i.e., “an error of a

transpositional, typographical, or mathematical nature”) or a mutual mistake of fact (i.e.,

“an erroneous belief, which is shared and relied on by both parties”).2 Rather, the facts

alleged indicate a valuation dispute that does not involve the correction of a clerical

error or mutual mistake of fact. Therefore,

IT IS ORDERED that Petitioner’s assessment appeal is PARTIALLY DISMISSED. The

appeal shall continue for the 2026 tax year(s) only.

Section 4: Issues Being Appealed (check all that apply)

True Cash and Taxable Value

Section 5: Explain the Reason for this Appeal

I have conducted a thorough market research and analysis considering relevant property valuation factors. I queried 13 “like” properties including mine. I listed

several categories such as square footage, number of bedrooms, bathrooms, garages, distance from my property, the cost per square foot gleaned from the purchase

price and date.

Please see the attached spread sheet to help articulate my findings. The information complied will demonstrate my position that my property is overstated in its

valuation.

I would like to point out two discrepancies; 1-The garage is listed as a four-car garage but actually is a large 3 car garage. It is a single and double garage combined I

believe at two separate dates prior to my purchase. 2-There is only 2 full bathrooms, not 3 as listed. There was a toilet in the basement covering drain access but it

was removed in the fall of 2025 after a severe flooding issue in the city.

Also, the Ad Valorem Basis is the vehicle for funding local revenue based on a property’s assessed value. The object is to fund essential community services and

infrastructure. My experience with the Police department’s lack of competencies, inefficient drinking and storm water management.

Section 6: Jurisdictional Issues
