MTT Docket No. 26-001002

Township of Flint,

Respondent.

NOTICE OF FILING

TAKE NOTICE that a Small Claims answer has been filed and the electronic copy of the

answer can be reviewed by utilizing the Docket Lookup on the Tribunal’s website.

Unless Respondent was defaulted, this case is ready to be scheduled for a Small

Claims hearing and will be scheduled in the normal course of scheduling. You will

receive a Notice of Hearing from the Tribunal by e-mail if you have identified an email

address in the petition or other documentation. The Notice of Hearing will inform you of

the date, time, and location of your hearing (note that your hearing will likely be

conducted by telephone). Please read the Notice of Hearing as it includes important

information.

EVIDENCE: Parties are required to submit all evidence to the Tribunal and send a copy

to the opposing party at least 21 days before the hearing date even if the documents

had been submitted to the local Board of Review or the Michigan Department of

Treasury. If the documents are not timely submitted to the Tribunal and served on the

opposing party, the documents may be excluded. Documents may be filed with the

Tribunal by mail or through the Tribunal’s e-filing system. Documents may be sent to the

opposing party by mail or by e-mail, if the parties agree to service by e-mail.

Alternate Dispute Resolution Options

INFORMAL SETTLEMENT CONFERENCE: Parties have the option of handling this

case through an informal settlement conference. An informal settlement conference

is a meeting between the parties and/or their representatives to discuss the issues in a

case in an effort to settle the case. This process may be an alternative to a hearing with

a judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent

Judgment. Visit the Tribunal’s ADR webpage for more information.

NOTE: The parties may not request an informal settlement conference to discuss an

appeal of a principal residence exemption that was denied by either the Michigan

Department of Treasury or a County. Also, state taxes levied by the Michigan

Department of Treasury, such as income taxes, are not subject to the informal

settlement conference process.

MEDIATION: Parties have the option of handling this case through mediation.

Mediation is a voluntary process where a mediator facilitates communication between

the parties, assists in identifying issues, and helps explore solutions to promote a

mutually acceptable settlement. This process may be an alternative to a hearing with a

judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent

Judgment. Visit the Tribunal’s ADR webpage for more information.

ORDER GRANTING PETITIONER’S MOTION TO AMEND PETITION

ORDER UPDATING DOCKET

On August 11, 2026, Petitioner filed a motion requesting that the Tribunal permit it to

amend its petition. In the motion, Petitioner states that the original petition misidentified

the correct Respondent.

Respondent has not filed a response to the motion.1

The Tribunal has considered the motion and the case file and finds that “a petition or

answer may only be amended by leave of the tribunal.”2 Nevertheless, “[l]eave to

amend must . . . be freely given when justice so requires . . . .”3 The Michigan Supreme

Court has held that “a motion to amend should be granted unless one of the following

particularized reasons exists: (1) undue delay, (2) bad faith or dilatory tactics, (3)

repeated failure to cure deficiencies by amendment previously allowed, (4) undue

prejudice to the opposing party, or (5) futility.”4 No such reasons exist in this case, and

the Tribunal is satisfied that granting Petitioner’s motion will facilitate the efficient

administration of justice. Therefore,

IT IS ORDERED that Petitioner’s Motion to Amend Petition is GRANTED.

IT IS FURTHER ORDERED that the docket shall be updated to reflect Flint Township

MOTION TO AMEND THE PETITION

TO IDENTIFY RESPONDENT AS THE TOWNSHIP OF FLINT

NOW COMES Petitioner, WALGREEN CO, through its attorney, PETER ELLENSON,

and states as follows in support of this Motion to Amend Petition pursuant to TR 221(1):

1.

Petitioner is a party in interest with respect to the property taxes for the subject

parcel, number 07 17 576 082.

2.

In Petitioner’s original Petition, in the box captioned “Taxing Authority”,

Petitioner wrongly identified Respondent as City of Flint.

3.

This Tribunal docketed the case as “Walgreen Co v City of Flint.” (Petitioner has

modified the caption of this pleading to reflect the correct respondent.)

4.

The parcel is located in the Township of Flint and therefore the correct

Respondent is the Township of Flint.

Page 2

5.

Petitioner’s original petition provided the correct parcel number and address for

the property under appeal, and in all other respects provided correct, identifying information and

complied with this Tribunal’s rules.

6.

This Motion is filed to correct the error in the original Petition.

7.

Petitioner is filing, with this Motion, a proposed, Amended Small Claims Property

Tax Petition.

8.

Leave to Amend is to be freely granted when justice requires. TR 221(1).

9.

There will be no prejudice to the Respondent by granting this Motion and

allowing the Petition to be Amended.

WHEREFORE, Petitioner respectfully requests that this Honorable Tribunal grant this

Motion to Amend The Petition, accept the proposed Amended Petition into its records, notify the

Township of Flint and otherwise process the Amended Petition according to its usual procedures.

Respectfully submitted,

/s/ Peter Ellenson
