 SMALL CLAIMS DIVISION

v

 MTT Docket No. 25-003779

Township Of Wright,

Respondent.

ORDER OF DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that:

The petition was not filed within 30 days after the July or December board of review

decision. See MCL 205.762a(3). As such, and inasmuch as the Tribunal has no

equitable power to waive or otherwise disregard statutory filing requirements and

deadlines, it has no authority to hear the appeal or grant the relief requested. See

Sixarp, LLC v Byron Twp, __Mich__; __NW3d__ (2025).

Therefore,

IT IS ORDERED that the case is DISMISSED.

This order resolves all pending issues and closes the case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Page 2

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

I certify that a copy of the foregoing was sent on the entry date indicated above to the

Section 5: Explain the Reason for this Appeal

We, Delton and Lydia Van Dyke and our two sons, recently purchased this house/property as it is one of the few homes that came for sale in the last five years

within close proximity to our farm. Currently, our dairy farm is directly across the street of the home. It has been our desire to raise our family on the farm. We are

27 and 25 years old and hope to remain in this house and property for a lifetime. We received a letter in return for our Agricultural Property Form 3676. It is

understandable to see why we received it, but we have a list of reasons we think this denial has been issued in error and are asking for an appeal.

The current house on the dairy farm is used for employee housing as they need a location to live as well, within close proximity, given the nature of dairy farming.

This property is owned by the dairy farmer (Delton and Lydia VanDyke), who will be living in the house as primary residence and will be using the land to support

their farm as well as the storage shed for equipment.

According to the appraisal done by Greenstone Farm Credit Services, this property has a value that reflects over 50% used for agricultural purposes (see appraisal

report).

We are not asking for a tax deduction but are looking for our taxes to be capped at the current taxed value which will not take place under the (Primary Resident

Exemption.)

Uncapping the taxes on this ag zoned property will put an added burden on our small family farm.

Wright Township stresses its support for ag which we appreciate and believe this property qualifies as.

In conclusion, we believe this classification ought to be changed to agriculture, which would be in line with its current use and zoning. Please take time to consider,

as this will greatly affect our family, and our small family farm for years to come. We thank you for the opportunity to place this appeal before you today.
