MTT Docket No. 25-003060 Page 2 of 4 HEARING INFORMATION – PLEASE READ IMMEDIATELY GENERAL INFORMATION: An impartial hearing will be conducted in accordance with the Michigan Tax Tribunal Rules (R 792.10201-R 792.10297) and the Michigan Administrative Procedures Act, MCL 24.201 et seq. The Michigan Rules of Evidence and the Michigan Court Rules may be applicable. Parties are expected to exercise proper respect and courtesy toward other parties, witnesses, and administrative law judges, which includes attending the hearing on time, silencing cell phones, and choosing a quiet, private location to participate in the hearing to limit distractions and ensure minimal background noise. The hearing may be recorded for notetaking purposes, but the recording is not a formal record, unless otherwise provided for by the Tribunal. REPRESENTATION: You may have an attorney or anyone else of your choice represent you at the hearing. The Tribunal does not recommend or appoint representatives for you and will not pay for your representative. WITNESSES: You may have anyone join you at the hearing to speak in support of your case. However, the time to present your case is limited and additional time may not be provided to accommodate witness testimony. DOCUMENTATION: Parties are required to submit all documents in support of their contentions to both the Tribunal and the opposing party at least 21 days before the hearing date even if the documents were previously submitted to the local Board of Review or the Michigan Department of Treasury. If the documents are not timely submitted to both the Tribunal and the opposing party, the documents may be excluded. Documents may be submitted to the Tribunal by mail or through the Tribunal’s electronic filing (e- filing) system. Documents may be sent to the opposing party by mail or by e-mail, if the parties agree to submission by e-mail. If sent by mail, the documents must be sent to the opposing party or their authorized representative at the address identified in the petition or answer for that party or authorized representative, unless the party or authorized representative filed an appearance or other documentation identifying a different mailing address. The documents do not need to be resubmitted after the Notice of Hearing if they were previously submitted to the Tribunal and the opposing party in this case. If a hearing had previously been scheduled in this case and adjourned, and the adjournment order indicates that the parties are precluded from submitting any further documentary evidence, no further documentary evidence will be accepted even if filed and exchanged as indicated above. INCLUSION OF SUBSEQUENT TAX YEARS: Subsequent tax year assessments are automatically included in valuation appeals once the assessment has been established for that tax year. For purposes of administrative efficiency, the Tribunal considers this date April 1st. As such, the parties should submit documentation and be prepared to discuss subsequent tax year assessments at hearings to be conducted on or after April 1st in a subsequent year. If the hearing is to be conducted prior to April 1st in a subsequent year, taxpayers are required to file a new petition and, if necessary, protest the subsequent tax year assessment at the March Board of Review for that year. MOTIONS/REQUESTS: A motion is a written request filed by a party asking the Tribunal to take certain action. The following motions and requests may be filed by either party regarding the scheduled hearing. STATE OF MICHIGAN GRETCHEN WHITMER GOVERNOR DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS LANSING ORLENE HAWKS DIRECTOR The MBOR reduced the percent functional from 100% to 70% for this building to take into account the sloping auditorium floor of the main church room. Following Sales is illegal in Michigan, the sale price was not considered for the Assessed or Taxable values. The Township Sales Study was used to come up with Township ECF's and land values, Grant Township or other County sales were not included in the Township Sales Study, as the petitioner referred to as premium sales. As far as the other concerns of the property as in bathrooms, bedrooms, water damage, etc. all fall under "repair and maintenance" of the building when purchased. The location of the building was there when purchased along with the "neighbors" that were mentioned. As far as not receiving your Change Notice in February, the Town of Mohawk (and other towns in the Keweenaw) only has Post Office Boxes, no home delivery. Petitioner is required to give the correct mailing address to receive their notices/mailings/tax bills. Registered Deeds can be acquired at the Keweenaw County Courthouse, if one was required by the Post Office. In conclusion, the March BOR, gave the petitioner a 30% functional reduction for the church sloping floor. The Sale price was not considered as per "Following Sales" Bulletin of 19 of 1997. Also, I am questioning if this petition was "timely filed"? There is no "date stamp" on the petition and no "postmarked" envelope included with the petition. It states on the MTT website it was downloaded on July 31st, but I did not receive a "Notice of Docket Number" until October 2nd. So I checked for a "Date Stamp" or "postmarked envelope" and there is neither on this petition. Section 5: Jurisdictional Issues IF PETITIONER IS APPEALING THE TRUE CASH AND/OR TAXABLE VALUES Did Petitioner protest the assessment at a Board of Review (BOR)? STATE OF MICHIGAN GRETCHEN WHITMER GOVERNOR DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS LANSING ORLENE HAWKS DIRECTOR Mohawk Michigan 49950 Taxing Authority (City or Township) Township Of Allouez (KEWEENAW) County Keweenaw Section 4: Issues Being Appealed (check all that apply) True Cash and Taxable Value Section 5: Explain the Reason for this Appeal I feel the assessment is too high, even after an adjustment from the Board of Review. At the Board meeting I was told that the assessor's processes involved taking exterior measurements, using existing property records, and entering information from those sources into a formula, and somehow averaging this result with other properties for a final, total assessment. They also stated they were concerned with being in accord with Michigan state law. The township board was very polite and let me speak at some length. While of course I agree with wishing to be in accord with state law, I disagree with the assessment, and feel it is too high. Transaction History: Before my purchase, there was no sale by the original owners since the church's construction in 1904, and the property was never taxed. I understand uncapping, but this was a completely new evaluation of the property: there was no prior anchor or tax record. The property was listed for sale in 2022 for approximately $120,000 and remained on the market for many months before the asking price was reduced to approximately $100,000. During this time the property was available for viewings, with visible signage, listed regionally and globally via online listings at UPMLS, and how I came to be aware of the property in the first place. In the autumn of 2023 the owners reduced the price again, to $69,900, after about a year on the market. I purchased this property (using a trust) at this price. This was an arms-length deal between two undistressed, uncoerced, unhurried, and unrelated parties on the free, open market: the market decided the price. I understand the sale price is not the only factor in making an assessment. However I believe in this case it is the pricipal factor, the best factor, and that the sale price was reasonable. If the assessment was correct, the seller should have had no problem in selling the property at the original asking price of $120,000 with a potentially global audience of buyers, and more than ample time in a high demand market - but that was not the case. I believe the sale price should 'anchor' any assessment rather than being insubstantial. More details of the math are below. Comparable properties against which to potentially average: The Property is a 120 year old church that has seen some tough times, and is in a less desirable location. I believe that the assessment has averaged on a purely square foot basis against other residential property across all of Keweenaw County. This county covers areas I would describe as 'premium' (Copper Harbor, or Lac La Belle near Mt. Bohemia Ski Resort, or idyllic lakeshore properties, for example), all the way to properties which are simply ruins of century old mining structures and mine tailings: there is a wide range. Any average, I believe, should be averaged against like properties - averaging this property with premium comparables is really not a fair comparison. What other recently sold properties are an old churches with similar attributes? I imagine there are none. Therefore the true cash value of the property should be anchored by the arm's length deal on the free, open market. Condition of property: As I said, this is an old building, built about 1904 and is not a standard residence. While there is some historical water damage, the roof is in good condition, and the siding is good enough, but the internals of the building are problematic. The adjustment made by the board was based on the sloped floor of the main 'sanctuary' area which takes up the vast majority of the square footage. The only bathroom is tiny (3.5' x 6'), with 1 toilet and a sink, running only cold water. Upon purchase the kitchen sink did not drain, and in fact was not at all linked into the existing sewer line, it ran directly into the ground. The gas furnace had a water outlet draining into a hole in the floor of the utility room. The main fuse box of the property had rain water draining directly into it from a leaky 'periscope' and meter system. There is an electrical
