ORDER GRANTING JOINT STIPULATION FOR ENTRY OF CONSENT JUDGMENT

CONSENT JUDGMENT

The Tribunal has reviewed the Stipulation and finds that it comports with the mandates

of State law.1 As a result, the Tribunal shall enter the parties’ Stipulation. Therefore,

IT IS ORDERED that the Joint Stipulation for Entry of Consent Judgment including all

attachments, terms and conditions is GRANTED and ADOPTED, unless otherwise

IT IS FURTHER ORDERED that the officer charged with maintaining the assessment

rolls for the tax years at issue shall correct or cause the assessment rolls to be

corrected to reflect the property’s true cash and taxable values as provided in this

Consent Judgment within 20 days of the entry of the Consent Judgment.2

IT IS FURTHER ORDERED that the officer charged with collecting or refunding the

affected taxes shall collect taxes and any applicable interest or issue a refund as

required by the Consent Judgment within 28 days of the entry of the Consent

Judgment. If a refund is warranted, it shall, unless otherwise indicated, include a

proportionate share of any property tax administration fees paid and of penalty and

interest paid on delinquent taxes. The refund shall also, unless otherwise indicated,

separately indicate the amount of the taxes, fees, penalties, and interest being

refunded. A sum determined by the Tribunal to have been unlawfully paid shall, unless

otherwise indicated, bear interest from the date of payment to the date of judgment and

the judgment shall bear interest to the date of its payment. A sum determined by the

Tribunal to have been underpaid shall not bear interest for any time period prior to 28

ORDER OF PARTIAL DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that Petitioner

is appealing assessments for prior tax years and the Tribunal has no authority over

those assessments under MCL 205.735a, as the petition was not timely filed.1 Further,

the Tribunal also has no authority over those assessments, as the facts alleged do not

establish that the assessments were the result of a clerical error (i.e., “an error of a

transpositional, typographical, or mathematical nature”) or a mutual mistake of fact (i.e.,

“an erroneous belief, which is shared and relied on by both parties”).2 Rather, the facts

alleged indicate a valuation dispute that does not involve the correction of a clerical

error or mutual mistake of fact. Therefore,

IT IS ORDERED that Petitioner’s assessment appeal is PARTIALLY DISMISSED. The

appeal shall continue for the 2025 tax year(s) only.

July 22, 2025

Subject: Letter of Explanation Regarding Property Appraisal: 317 South St. Ypsilanti, MI

Parcel Number: 1111-11-09-192-008

MTT Docket No. 25-002312

To Whom it May Concern,

I am writing to provide clarification regarding the attached appraisal for 317 South St.

Ypsilanti, MI 48198 (a single parcel), which has been backdated to reflect a value as of

December 31, 2024. I am currently contesting the property taxes (the assessed, and

therefore the taxable value) for both 2024 and 2025, having purchased the property in

September 2023.

The appraisal value of $100,000 closely aligns with the true cash value of $90,000 at

the time of purchase. It is important to note that this appraisal does not fully account for

several improvements I have made since acquiring the property but prior to the appraisal.

Upon purchase, the yard was significantly overgrown with brush and trees, and I have since

invested considerable effort in clearing and maintaining the space, which has greatly

enhanced the property's condition and insurability.

Additionally, I have painted one side of the house to secure and maintain an

insurance policy, with exterior painting continuing throughout this year. I also addressed a

significant roof leak that had damaged the plaster ceiling and parts of the stairwell walls

leading to the basement. These repairs, including replastering much of the stairwell, were

finally completed in April 2024 and have substantially improved the home's condition.

Furthermore, I repainted one bathroom prior to the appraisal.

Given the proximity of the appraisal value to the original purchase price, despite

these significant improvements, I believe the appraisal supports the claim that the true cash

value of the property in 2023 was approximately $90,000. Therefore, I respectfully request

that the assessed and taxable value reflect these facts rather than relying solely on average

sales data from the broader area at the time of reassessment.

I believe it is important to consider the condition of the property when determining

its value, as condition and value are closely linked. A property's worth is influenced by more

than just square footage and the number of bathrooms—it reflects the overall state and

improvements made.

Thank you for your attention to this matter. I appreciate your consideration and am

True Cash and Taxable Value

Section 5: Explain the Reason for this Appeal

I purchased 317 South St. in September 2023 for $90,000. The seller did not have a mortgage or any leins on the house - it was not a distressed sale. The true cash

value of the house was determined to be $90,000 because of the poor overall condition of the house and how its condition is directly related to its true cash value.

Our real estate broker did not feel it would be easy to obtain a mortgage due to its condition, he suggested a cash purchase instead.

When i submitted photos detailing the condition of the house to the 2025 March Board of Review as a way of justifying its true cash value, they denied my petition

due to a lack of evidence.

Section 4: Issues Being Appealed (check all that apply)

Section 6: Jurisdictional Issues

Year(s) you are appealing:

2024, 2025

Did you protest the assessment at a Board of Review (BOR)? Yes

If Yes, check which BOR you attended AND upload the BOR decision: March

If No, check the applicable reason(s):

Did you request a Poverty Exemption at the BOR?

If Yes, check which BOR considered your application AND upload the BOR decision:

 March  July  December

If No, explain why:

Section 7: Valuation Information *Use the multiple parcel form for additional, contiguous parcels.
