MICHIGAN TAX TRIBUNAL | SMALL CLAIMS DIVISION MTT Docket No. 25-003145 RECEIVED Petitioner Valuation Disclosure and 0 CT 07 2006 Documentary Evidence 65368 Eby Road, Cassopolis, Michigan 49031 | Tax years 2025 and 2026 MICHIGAN Tax TRIBUNAL fecppndent PouKat and ( October 21, 2026 23:003145 | 9:45 a.m. Eastern Knust Family Revocable Trust Township of Porter Requested determination Parcel Township 2025 Petitioner Requested TCV | TCV AV and SEV | 14-120-055-086-01 | | | Home parcel $647,200 $550,000 $275,000 14-120-055-088-19 Back-lot parcel $69,200 $45,000 $22,500 Combined $716,400 $595,000 $297,500 For 2025, Petitioner requests combined true cash value of $595,000, allocated $550,000 to the home parcel and $45,000 to the back-lot parcel. Because the 2024 transfer uncapped taxable value for 2025, Petitioner requests assessed value, state equalized value, and taxable value consistent with one-half of the determined true cash value, subject to the Tribunal's statutory calculation. For automatically added tax year 2026, Petitioner contends that the same true cash values remain appropriate because there was no known material physical change to the property. Taxable value for 2026 should be calculated from the Tribunal-determined 2025 taxable value under the applicable statutory limitation. If the Tribunal concludes the present evidence is insufficient for 2026, Petitioner requests that the added year be severed rather than the 2025 claim delayed. Summary of position The $865,000 transaction was not a sale of taxable real estate alone. The executed agreement covered two parcels and expressly included all interior furnishings then present in the home (excluding clothing, personal pictures, books, and games), a 2012 Landau pontoon and trailer, a golf cart, lawn equipment, a floating raft, pier sections, a boat lift, a gazebo, outdoor furniture, a garage refrigerator, and miscellaneous tools. The separately executed boat bill of sale documents $10,000 for the boat, motor, and trailer. No contemporaneous allocation was made for the remaining personal property. Petitioner does not contend that the entire $270,000 difference between the all-in consideration and the
Page 2
MICHIGAN TAX TRIBUNAL | SMALL CLAIMS DIVISION MTT Docket No. 25-003145 Basis of value conclusion Petitioner considered the executed transaction documents, the Township assessments and property record cards, physical attributes of the subject, and owner-compiled sales of competing lake properties near the relevant December 31, 2024 valuation date. The eight dated comparable sales range from $345,000 to $699,000, with a median of $487,000. The subject is larger and newer than most of the sales, while the transactions differ materially in lake, frontage, site utility, condition, and the amount of personal property conveyed. The sales are therefore used as qualitative market brackets rather than as mechanically interchangeable price-per-square-foot indicators. After considering those differences, Petitioner concludes $550,000 for the improved lakefront parcel and $45,000 for the secondary back-lot parcel, or $595,000 combined. Transaction facts SEE TRL EE TREE | $865,000 for both parcels and all included property under the executed Buy and Sell One negotiated consideration Agreement. Parcel Nos. 14-120-055-086-01 and 14-120-055-088-19 are identified in the [Rbjreatestate nace ls agreement and Addendum 1. Addendum 1 expressly includes all interior furnishings then present in the home, | Substantial included personal excluding clothing, personal pictures, books, and games. It also includes the pontoon property and trailer, golf cart, lawn equipment, floating raft, outdoor furniture, refrigerator, tools, and other items. Boat package documentation Signed July 24, 2024 bill of sale: $7,000 boat, $2,000 motor, and $1,000 trailer. The parties did not allocate the balance of the $865,000 among the home parcel, No full allocation back lot, furnishings, and other included items. Treatment of the $865,000 transaction The transaction remains relevant market evidence, but it requires adjustment because the purchase agreement proves that the consideration purchased more than the taxable real estate. The $10,000 boat-package allocation is directly documented. The balance of the non-realty is not assigned a retrospective item-by-item value in this disclosure. Instead, Petitioner relies on the comparable-sales evidence to conclude the value of the real estate itself. The payment of real-estate transfer tax on the gross consideration does not create an appraisal allocation among the assets conveyed. Petitioner did not use a closing allocation to reduce transfer tax. 2026 added tax year The Tribunal automatically added 2026 because the hearing was scheduled after April 1, 2026. The subject has not undergone a known material physical change supporting a higher true cash value.

RECEIVED OCT 05 2076 MICHIGAN TAX TRIBUNAL Porter Township Administration Offices Porter Township POBOX517 UNION, MI. 49130-0817 (269) 641-2375 FAX # (269) 641-2571 DATE: Wednesday, September 30, 2026 FROM: Kevin Harris, Assessor - Respondent REGARDING: Evidence Packet for MTT Docket #: 25-003145 PETITIONERS: Knust Family Revocable Trust PARCEL NUMBER(S): 14-120-055-086-01 & 14-120-055-088-19 HEARING DATE/TIME: October 21, 2026 To whom it concerns, Enclosed is the evidence to be submitted for the referenced hearing. The evidence packet includes the following: ¢ A per dollar square foot analysis of Shavehead Lake frontage home sales indicating a range of between $270 to $320 per square foot. (EXHIBIT A) * A per front foot analysis of backlot sales adjacent to Shavehead Lake indicating a range of $950 to $1200 per front foot. (EXHIBIT B) e The property transfer affidavit (PTA) that was filed with the Assessor’s office indicating a sales price of $865,000 on July 24™ 2024 for both parcels under appeal. (EXHIBIT C) e The deed that was filed with the Cass County Register of Deeds corroborating the sales price listed on the PTA. (EXHIBIT D) Using the home sales on Shavehead Lake indicates a range of value between $675,000 to $800,000 for the improved lot (14-120-055-086-01) and the value range for the backlot (14-120-055-088-19) would be between $71,000 to $90,000. Collectively this would indicate a value range of $746,000 to $890,000 for both parcels. In my opinion, considering the purchase price of $865,000 and this analysis, the derived 2025 value of $716,400 for both parcel is a reasonable estimate of the true cash value. Kevin Harris

NOTICE OF FILING TAKE NOTICE that a Small Claims answer has been filed and the electronic copy of the answer can be reviewed by utilizing the Docket Lookup on the Tribunal’s website. Unless Respondent was defaulted, this case is ready to be scheduled for a Small Claims hearing and will be scheduled in the normal course of scheduling. You will receive a Notice of Hearing from the Tribunal by e-mail if you have identified an email address in the petition or other documentation. The Notice of Hearing will inform you of the date, time, and location of your hearing (note that your hearing will likely be conducted by telephone). Please read the Notice of Hearing as it includes important information. EVIDENCE: Parties are required to submit all evidence to the Tribunal and send a copy to the opposing party at least 21 days before the hearing date even if the documents had been submitted to the local Board of Review or the Michigan Department of Treasury. If the documents are not timely submitted to the Tribunal and served on the opposing party, the documents may be excluded. Documents may be filed with the Tribunal by mail or through the Tribunal’s e-filing system. Documents may be sent to the opposing party by mail or by e-mail, if the parties agree to service by e-mail. Users who file documents with the Michigan Tax Tribunal are advised that filed documents are public records and will appear for public viewing on the Tax Docket Lookup. Users who file documents are responsible for ensuring sensitive or personal identifying information is withheld or redacted. See TTR 209. The Tribunal is not responsible for or required to review, redact, or screen documents at the time of filing for PII whether filed electronically or on paper. A party, representative, or interested person (i.e. third party not part of an appeal) may request that the Tribunal redact PII contained in a previously-filed document by

Alternate Dispute Resolution Options INFORMAL SETTLEMENT CONFERENCE: Parties have the option of handling this case through an informal settlement conference. An informal settlement conference is a meeting between the parties and/or their representatives to discuss the issues in a case in an effort to settle the case. This process may be an alternative to a hearing with a judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent Judgment. Visit the Tribunal’s ADR webpage for more information. NOTE: The parties may not request an informal settlement conference to discuss an appeal of a principal residence exemption that was denied by either the Michigan Department of Treasury or a County. Also, state taxes levied by the Michigan Department of Treasury, such as income taxes, are not subject to the informal settlement conference process. MEDIATION: Parties have the option of handling this case through mediation. Mediation is a voluntary process where a mediator facilitates communication between the parties, assists in identifying issues, and helps explore solutions to promote a mutually acceptable settlement. This process may be an alternative to a hearing with a judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent Judgment. Section 5: Explain the Reason for this Appeal
The subject properties are over assessed by Porter Township. The 2025 Taxable Value
(TV) is $323,600.00 and the assessed value (SEV) is $323,600.00 for a True Cash
Value (TCV) of $647,200.00.
A contiguous unimproved parcel has a Taxable Value
(TV) is $34,600.00 and the assessed value (SEV) is $34,600.00 for a True Cash Value
(TCV) of $69,200.00. Attached is comparable data that supports the appeal. We will
submit additional evidence of comparable properties adjusted to support our petition and
prove the properties are over assessed.
Petitioner contends that several items of personal property that were a component of the
sales price has negatively affected the TV and the SEV for these properties. Some of
those items of personal property purchased were: 1. pontoon boat; 2. pier; 3. boat lift; 4
golf cart; 5. all home furnishings; 6. all garage contents and tools.
