Section 4: Explain the Reason for this Appeal

The Assessment Methodology and resulting apportionment is unjust and inequitable.

| do not

agree my property will gain benefit from the special assessment, in fact, part of this project is

disconnecting an illicit pipe that have been using my property without any easement plus

damages in the form of it creating and sustaining a wetland area of over 1 acre. Also, the

method of assessment at the highest rate (commercial as if it has 70% of impermeable surface,

when it only has 15%.) Then tripled as if it is fully improved so that less than 3.37 acres is

treated as 7.08 acres and then taxed at the highest rate has resulted in an extremely high

assessment/apportionment ($9,507.03) plus the damages to correct issues that are no fault or

benefit to my property. Additionally, the Drain Commissioner hid from the entire community and

over 400 stakeholders as to the scope and cost and methodology until they blindsided

everyone with apportionment letters and causing panic and hardship. At that point,

it was too

late to learn and respond effectively. Truly a travesty!

| do not agree my property will gain value from the special assessment. The gross acreage

amount was factually overstated and also overstated due to a 1.19 acre wetland created by|

MDOT illicit water dumping. The extremely complex assessment methodology is not

equitable. The multipliers are excessive and punitive and maxed out on this property. The

benefiting municipalities are not paying an equitable share. Costs to correct MDOT

Roadway illicit water dumping onto this property without any rights to do so should be their

sole cost and not part of this project. The public, landowners in the Tonkin Drain District

and this property owner were deprived a basic right of due process and discovery of the

project scope, growth in cost, and funding apportionment methodology that changed

drastically from the original Determination of Need. What was estimated in 2019 to be a $7,
