ORDER OF PARTIAL DISMISSAL

FINAL OPINION AND JUDGMENT

The Tribunal issued a Proposed Order of Dismissal and Proposed Opinion and

Judgment (POJ)1 on January 16, 2026. The POJ states, in pertinent part, “[t]he parties

have 20 days from the ‘Entered’ date below to notify the Tribunal in writing, by mail or

by electronic filing, if they do not agree with the POJ and to state in writing why they do

not agree with the POJ (i.e., file exceptions to the POJ).”

Neither party has filed exceptions to the POJ.

The Administrative Law Judge (ALJ) considered the testimony and evidence submitted

by the parties and made specific findings of fact and conclusions of law. With regard to

Petitioner’s true cash value claims, the ALJ’s determination that Petitioner did not meet

their burden of going forward with the evidence is supported by the record in this case

and applicable statutory authority. Furthermore, the ALJ considered Petitioner’s claims

related to the subject property’s taxable value (TV) and as noted above, made specific

findings of fact and conclusions of law. The Tribunal finds that the ALJ’s TV

determination is supported by the testimony and evidence and applicable statutory and

case law.

Given the above, the Tribunal adopts the POJ as the Tribunal’s final decision in this

case.2 The Tribunal also incorporates by reference the Findings of Fact and

Conclusions of Law contained in the POJ in this Final Opinion and Judgment. As a

result:

1 Upon review, the Tribunal has determined that the POJ incorrectly identified the POJ as including a

Proposed Order of Dismissal. However, this typographical error indicating a Proposed Order of Dismissal

rather than a Proposed Order of Partial Dismissal was de minimis in nature as it had no impact on the

ALJ’s determination that Petitioner’s valuation claims should be partially dismissed. Specifically, the POJ

expressly stated that “IT IS ORDERED that this case is PARTIALLY DISMISSED with respect to

Petitioner’s valuation claims.” Therefore, the Final Opinion and Judgment is being corrected to reflect the

intent to partially dismiss Petitioner’s valuation claims.

2 See MCL 205.726.

PROPOSED JUDGMENT

The subject property’s taxable value (TV) for the tax years at issue shall be as follows:

Parcel Number: 40001-001-048-10

Year

TV

2024

$24,749

2025

$25,516

This case shall be dismissed with respect to Petitioner’s claims regarding true cash

value (TCV) and state equalized value (SEV).

PROCEDURAL HISTORY

Petitioner was required to protest the subject property’s assessment to the Board of

Review (BOR). Petitioner protested the subject property’s assessment to the 2024

March BOR.

Petitioner filed a petition with the Tribunal on July 25, 2024, and Respondent filed an

answer on October 27, 2024

Page 2

MTT Docket No. 24-003736

The amount of the SEV or TV in dispute, as set forth in the pleadings, for all tax years at

issue is within the jurisdictional limits of the Small Claims Division.1 Further, the

property’s assessment for the subsequent tax year is included in this proceeding.2

ISSUES AND APPLICABLE LAW

The issues in this matter are:

1. Whether the subject property is assessed in excess of 50% of its true cash value

(TCV).

“The petitioner has the burden of proof in establishing the true cash value of the

property.”3

The assessment of real property in Michigan shall not exceed 50% of its TCV.4 “True

cash value” means “the usual selling price . . . .”5 “True cash value” means “fair market

value.”6

The Tribunal is required to make an independent determination of TCV.7 “[T]he tribunal

is not bound to accept either of the parties’ theories of valuation. It may accept one

theory and reject the other, it may reject both theories, or it may utilize a combination of

both in arriving at its determination.”8

The Tribunal is required to select the valuation methodology that is accurate and bears

a reasonable relationship to the property’s TCV.9

2. Whether the TV exceeds the amount provided by MCL 211.27a.

MCL 211.27a provides that a property’s TV is the lesser of the property’s SEV or

capped TV, and a property’s capped TV is, absent a transfer of ownership, determined

mathematically by taking into consideration the prior tax year’s TV, physical losses to

the property, the lesser of the rate of inflation or 5%, and physical additions to the

property, including omitted property (i.e., property not previously assessed).

No exhibits were excluded from evidence.

Based on the pleadings and admitted exhibits, Petitioner contends that the assessment

is not accurate with respect to the cement threshold to the cabin, the five-board, split-rail

fence, two eight-by-16-foot carports, and the wood-framed pump house, as detailed

therein.

Based on sworn testimony, Petitioner contends that the additions to the record card

resulted in four inaccuracies to TV. The threshold to the cabin, as shown in Exhibit A, is

a small step. The concrete surrounding the step is covered in moss and plants. It was

part of the original construction in the late 1930s, and it has not been repaired or

modified since. Petitioner purchased the subject property in 1990. There was a popup

for that, as well as two prior ones, and there should not be an additional new charge on

the property record card. Further, the concrete is beyond its life.

Petitioner contends that the fence was constructed in 1992 to replace a wire electric

fence. It is on the card

REPRESENTATION: You may have an attorney or anyone else of your choice represent you at the hearing.

The Tribunal does not recommend or appoint representatives for you and will not pay for your representative.

WITNESSES: You may have anyone join you at the hearing to speak in support of your case. However, the

time to present your case is limited and additional time may not be provided to accommodate witness

testimony.

DOCUMENTATION: Parties are required to submit all documents in support of their contentions to both the

Tribunal and the opposing party at least 21 days before the hearing date even if the documents were

previously submitted to the local Board of Review or the Michigan Department of Treasury. If the

documents are not timely submitted to both the Tribunal and the opposing party, the documents may be

excluded. Documents may be submitted to the Tribunal by mail or through the Tribunal’s electronic filing (e-

filing) system. Documents may be sent to the opposing party by mail or by e-mail, if the parties agree to

submission by e-mail. If sent by mail, the documents must be sent to the opposing party or their authorized

representative at the address identified in the petition or answer for that party or authorized representative,

unless the party or authorized representative filed an appearance or other documentation identifying a different

mailing address. The documents do not need to be resubmitted after the Notice of Hearing if they were

previously submitted to the Tribunal and the opposing party in this case.

If a hearing had previously been scheduled in this case and adjourned, and the adjournment order indicates

that the parties are precluded from submitting any further documentary evidence, no further documentary

evidence will be accepted even if filed and exchanged as indicated above.

INCLUSION OF SUBSEQUENT TAX YEARS: Subsequent tax year assessments are automatically included

in valuation appeals once the assessment has been established for that tax year. For purposes of

administrative efficiency, the Tribunal considers this date April 1st. As such, the parties should submit

documentation and be prepared to discuss subsequent tax year assessments at hearings to be conducted on

or after April 1st in a subsequent year. If the hearing is to be conducted prior to April 1st in a subsequent year,

taxpayers are required to file a new petition and, if necessary, protest the subsequent tax year assessment at

the March Board of Review for that year.

The 2024 taxable value was increased due to the following observed improvements: 641 lineal feet of fencing and two sun-shelters, each being 10x16.

The MBOR adjusted the headlee new&additions from 6,400 to 5,200 (as the sun-shelters were originally priced as carports and the MBOR considered sun shelter

more suitable).

Four specific points were addressed by petitioner:

1. Cement threshold to cabin

There is 72 square feet of concrete at the smaller cabin. It is 4'x18'. While moss covered due to shade from sun, it was observed intact and was included in the

assessment at a depreciated rate.

2. Fencing is assessable real property, as evidenced by their inclusion in the Michigan Assessor's Manual. There is no reliance upon 'Zillow' in Michigan's General

Property Tax Act (Act 206 of 1893). Inclusion of fencing in a property record card is appropriate. Petitioner seeks to 'cherry pick' erroneous record cards and

practices as a means to support their argument. No documentation provided to support "conversations" with Kalkaksa County Equalization Office.

3. Two 10 x 16 sun shelters exist and should be included in the property record card/assessment.

4. The wood framed pump house exists and should be included in the property record card/assessment. The pump house was not considered to be a brand-new

improvement.

Nothing in statute supports the removal of said items from the property record card and/or assessment.
