STATE OF MICHIGAN GRETCHEN WHITMER GOVERNOR DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS LANSING MARLON I. BROWN, DPA DIRECTOR MICHIGAN TAX TRIBUNAL · 611 W. OTTAWA ST., LANSING, MI 48933 · 517-335-9760 PO BOX 30232, LANSING, MI 48909 · Other Carriers: 2407 N. GRAND RIVER AVE., LANSING, MI 48906 Demitri Jordan, MICHIGAN TAX TRIBUNAL Petitioner, SMALL CLAIMS DIVISION v MTT Docket No. 26-000721 City of Grand Blanc, Presiding Judge Respondent. Patricia L. Halm ORDER OF DISMISSAL The Tribunal has considered the file in this case and finds that it has no authority over Petitioner’s appeal. The petition and accompanying documentation indicate that Petitioner is seeking a disabled veteran’s exemption for the 2025 tax year. However, the answer and accompanying documentation filed on July 13, 2026, indicates that Petitioner did not file an affidavit requesting the exemption in that year, and MCL 211.7b unambiguously requires the filing of an affidavit prior to December 31 of the calendar year for which the exemption is claimed: “To obtain the exemption, an individual . . . must file an application . . . with the assessing officer for the local assessing unit after January 1 and before December 31 of the calendar year for which the exemption is claimed.” Further, while MCL 211.53b does provide July and December boards of review with authority to correct qualified errors for the current and immediately preceding tax year, including “an error made by the local tax collecting unit in the processing of a timely filed exemption affidavit,” and “a delay in the determination by the United States Department of Veterans Affairs that a veteran is permanently and totally disabled as a result of military service and entitled to veterans' benefits at the 100% rate,” Petitioner did not appear before Respondent’s July or December Board of Review or appeal an action taken by any such board. As such, and inasmuch as the Tribunal has no equitable power to waive or otherwise disregard a statutory filing requirement or deadline, it has no authority to grant Petitioner the relief requested. Therefore, IT IS ORDERED that the case is DISMISSED. This order resolves all pending claims in this matter and closes this case. APPEAL RIGHTS If you disagree with the final decision in this case, you may file a motion for reconsideration with the Tribunal or a claim of appeal with the Michigan Court of Appeals.
Page 2
MTT Docket No. 26-000721 Page 2 of 2 A motion for reconsideration must be filed with the Tribunal with the required filing fee within 21 days from the date of entry of the final decision. Because the final decision closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing system; it must be filed by mail or personal service. The fee for the filing of such motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless the Small Claims decision relates to the valuation of property and the property had a principal residence exemption of at least 50% at the time the petition was filed or the decision relates to the grant or denial of a poverty or disabled veterans exemption and, if so, there is no filing fee. You are required to serve a copy of the motion on the opposing party by mail or personal service or by email if the opposing party agrees to electronic service, and proof demonstrating that service must be submitted with the motion. Responses to motions for reconsideration are prohibited and there are no oral arguments unless otherwise ordered by the Tribunal. Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If the claim is filed more than 21 days after the entry of the final decision, it is an “appeal by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the record on appeal. There is no certification fee. Entered: August 7, 2026 By: /s/ Patricia L. Tribunal Petition Statement (Disabled Veteran Exemption — MCL 211.7b) Statement of Facts: Petitioner is a veteran of the United States Armed Forces who has been determined by the U.S. Department of Veterans Affairs to be 100% permanently and totally disabled, effective March 5th, 2019. Petitioner became the owner of the subject property, located at 12951 Croftshire Dr. Grand Blanc, Mi. 48439 in March 2025. Since acquiring the property, Petitioner has continuously occupied the property as his principal residence. Petitioner timely applied for the disabled veteran exemption under MCL 211.7b upon becoming aware of the exemption. The local assessing authority denied the exemption for the 2025 tax year, stating that the exemption could not be granted because it was not filed by December 2025 and/or could not be applied retroactively. No formal written denial notice specifying a statutory basis for denial was provided to Petitioner. Applicable Law MCL 211.7b provides that real property used and owned as a homestead by a disabled veteran who is rated by the U.S. Department of Veterans Affairs as permanently and totally disabled shall be exempt from the collection of taxes. The statute does not impose a strict requirement that the exemption be filed only at a December Board of Review nor does it prohibit the granting of the exemption for a tax year in which all eligibility requirements are satisfied. Argument Petitioner satisfies all statutory requirements for the disabled veteran exemption under MCL 211.7b for the 2025 tax year. Specifically, Petitioner: Is a veteran rated 100% permanently and totally disabled by the VA; Owned the subject property during the 2025 tax year; and
Page 2
Occupied the property as his principal residence during the 2025 tax year. The Respondent’s denial is based solely on an administrative limitation regarding timing of filing and/or an assertion that the exemption cannot be applied retroactively. Such a limitation is not supported by the plain language of MCL 211.7b. To the extent Respondent relies on a December filing requirement or a prohibition on “backdating,” such requirements are administrative practices and do not override the statutory entitlement to exemption when all conditions are met. Petitioner has been a qualified disabled veteran since 2019. The only change in 2025 was the acquisition and occupancy of the subject property. Denial of the exemption under these circumstances is inconsistent with the intent and language of MCL 211.7b. Relief Requested Petitioner respectfully requests that the Tribunal: Grant the disabled veteran exemption under MCL 211.7b for the 2025 tax year; Order the correction of the property tax assessment and any applicable refund; and Grant any further relief deemed appropriate.
