Daniel S. Carlson Business Trust v City of Farmington Hills, MTT Docket No. 25-002827,

32781 West Eleven Mile Road, Farmington Hills, MI, Parcel ID No. 23-22-126-064

Dear Sir/Madam,

In accordance with the Notice of Telephone Hearing issued on September 15, 2026, we are sub

mitting this letter and the attached evidence as it relates to the above-referenced case currently

pending in the Small Claims Division of the Michigan Tax Tribunal (the “Tribunal”).

1. Introduction

For tax year 2025, the Respondent City of Farmington Hills valued the property in question, 32781

West Eleven Mile Road, Farmington Hills, MI (the “Property”), at an Assessed Value of $568,580,

which translates to a True Cash Value of $1,137,160. Petitioner, however, contends that the True

Cash Value and Assessed and Taxable Values of the Property as of December 31, 2024, are

$905,000 and $452,500, respectively.1

To support Petitioner’s contention of value, the Petitioner notes the following, which are addressed

in more detail below:



The Property sold at an arm’s length transaction a mere 36 days before the valuation date

at a purchase price of $900,000.



The Property was appraised less than half a year after the valuation date a value of

$925,000.



A significant portion of the Property is functionally obsolete because it consists of an ex

hibit hall originally designed to display taxidermy hunting trophies and host events, all of

which requires a large amount of utility expense to heat and maintain and is not desirable

in a single-family home.



At the time of purchase, the Property had significant deferred maintenance which was not

noted in the Respondent’s records. To date, Petitioner has expended $300,000 in necessary

repairs and maintenance and expects to spend nearly $200,000 more in the near future.

Petitioner arrived at the $905,000 TCV utilizing the Respondent’s published assessed value growth

rate of 4.89%. See Exhibit 1, excerpt from Respondent’s annual disclosure to its bondholders.

Increasing the $900,000 purchase price over 36 days to the valuation date provides a value of

$904,340. Decreasing the appraised value from the 2025 appraisal of $925,000 utilizing this same

1

The Petition to the Tribunal alleged Petitioner’s contention of TCV at $900,000. For the reasons stated in this

letter, the Petitioner has revised that to $905,000.

Page 2

Page 2

rate of increase shows a value on valuation date of $904,760. These are, for all intents and pur

poses, identical and can be rounded to a TCV of $905,000 with Assessed and Taxable Values of

$452,500 each.

2. The Best Estimate of True Cash Value is the Price at Which the Subject Property Was

Sold in an Arm’s Length Transaction Which Closed on November 25, 2024.

The selling price of a piece of property is not presumptively the true cash value of that property.

MCL 211.27(6). However, the Tribunal, depending on the circumstances of particular cases, can

give greater or lesser reliance on a sale reasonably near to tax day in determining true cash value.

For example, in WCY Realty v Fairhaven Twp, 2012 Mich App LEXIS 1550 (August 7, 2012)

(Exhibit 2), the Petitioner challenged the Tax Tribunal’s partial reliance on its purchase price of

the property in question in determining the 2006 taxable value for the property. Petitioner claimed

that it purchased the property at a 2004 auction after having been “duped” by the seller into pay

ing for a “waterfront paradise,” but instead received a “duck-hunting swamp.” Id. at *1. The Court

of Appeals affirmed, holding that the Tax Tribunal had not accepted the purchase price as “con

clusive of the property’s TCV” but had properly considered it along with other relevant evidence

in determining a valuation judgment. Id. at *11-*12.

On the other hand, the Tribunal rejected reliance on a purchase price, and was affirmed by the

Court of Appeals in so doing, in Sullivan v City of Grosse Pointe Farms, 2014 Mich App LEXIS

1715 (2014) (Exhibit 3). In that case the evidence showed that the sale occurred

Summary of Analysis: Daniel S Carlson Docket No: 25-002827

32781 West Eleven Mile

Farmington Hills MI 48336

The subject is located near the central quadrant of the city of Farmington Hills which

borders the city of Farmington. The comparable properties are all located in the city of

Farmington Hills. The subject’s neighborhood is bound by Eleven Mile to the north,

Orchard Lake Road to the east, Ten Mile Road to the south, and Farmington Road to the

west.

The subject property was built in 1920. Additions were built in 1983 and 1990. The

subject property has a 1 story style design. The subject property is reported to have 5

bedrooms with 5.5 baths. The subject property does have a finished basement.

The subject property sits on an approximately 2.76-acre site. The property has an

inground pool, deck, carport and paver patios.

The homeowner is stating they believe their fair market value is $900,000. Since the

property sold in 2024 the taxable value became uncapped in 2025. Thus the 2025

Assessed and Taxable values are equal. The property sold in a non-arms length

transaction in 2026 to related parties in 2025. Thus, the property became uncapped for

the 2026 assessment year as well.

MARKETING AND EXPOSURE PERIOD

The subject property was originally marketed in early 2024 for $1,590,000. The listing

price was substantially reduced to $999,900 in August of 2024 before being reduced

again to $950,000 in October of 2024 before selling for $950,000. The property was

purchased by Ferris State University in 2019 for a reported price of $1,100,000. The

property was sold a short time after for $715,000 in 2020. The 2024 purchase in our

opinion was not a totally arms-length transaction due to the over 75% reduction from

the original listing price and the fact seller obtain the property for a favorable price

from a university in 2020 and had substantial equity after 4 years of ownership.

SALES COMPARISON ANALYSIS

 2025

To support the city’s contention of the 2025 assessed value the comparable sales

analysis is discussed below. Comparable sales took place between January 31, 2023,

and April 17, 2025. The 2023 sales were included due to the lack of 2024 sales of

similar style houses. Comparables 3 and 6 sold after December 31, 2024, but are

included in the analysis because the sales conditions are similar to December 31, 2024.

All of the comparables warrant adjustments for effective age. The subject property was

built in 1920 with additions in 1983 and 1990. All of the comparables were built

between 1964 to 1994. The comparable properties warrant downward adjustments for

the subject’s inferior location on the main street. The adjustment is limited along this

section of West Eleven Mile Road.

Comparable 1 warrants adjustment for improvements in market conditions, differences

in land value, building effective age, building square footage, number of bathrooms,

garage square footage, porches, basement square footage and finish and location.

Comparable 2 warrants adjustment for improvements in market conditions, differences

in land value, building effective age, building square footage, number of bathrooms,

garage square footage, porches, basement square footage and finish and location.

Comparable 3 warrants adjustment for improvements in market conditions, differences

in land value, building effective age, building square footage, number of bathrooms,

garage square footage, porches, basement square footage and finish and location.

Comparable 4 warrants adjustment for improvements in market conditions, differences

in land value, building effective age, building square footage, number of bathrooms,

garage square footage, porches, basement square footage and finish and location.

Comparable 5 warrants adjustment for improvements in market conditions, differences

Claims hearing and will be scheduled in the normal course of scheduling. You will

receive a Notice of Hearing from the Tribunal by e-mail if you have identified an email

address in the petition or other documentation. The Notice of Hearing will inform you of

the date, time, and location of your hearing (note that your hearing will likely be

conducted by telephone). Please read the Notice of Hearing as it includes important

information.

EVIDENCE: Parties are required to submit all evidence to the Tribunal and send a copy

to the opposing party at least 21 days before the hearing date even if the documents

had been submitted to the local Board of Review or the Michigan Department of

Treasury. If the documents are not timely submitted to the Tribunal and served on the

opposing party, the documents may be excluded. Documents may be filed with the

Tribunal by mail or through the Tribunal’s e-filing system. Documents may be sent to the

opposing party by mail or by e-mail, if the parties agree to service by e-mail.

Users who file documents with the Michigan Tax Tribunal are advised that filed

documents are public records and will appear for public viewing on the Tax

Docket Lookup. Users who file documents are responsible for ensuring sensitive or

personal identifying information is withheld or redacted. See TTR 209. If a user wishes

to file a document for consideration by the Michigan Tax Tribunal and prevent its

publication on the Tax Docket Lookup, the user MUST file a Motion for Protective Order

under MCR 2.302(C)(8). If a Protective Order is issued, documents covered by the

Order will not be published. Documents filed prior to the issuance of a Protective Order

will be published.

The responsibility for excluding or redacting personal identifying information (PII) from

all documents filed with or offered to the Tribunal rests solely with the parties and

their attorneys. The Tribunal is not responsible for or required to review, redact, or

screen documents at the time of filing for PII whether filed electronically or on paper. A

party, representative, or interested person (i.e. third party not part of an appeal) may

request that the Tribunal redact PII contained in a previously-filed document by

submitting a Request for Redactions. The Request for Redactions form will be

available on the Entire Tribunal and Small Claims pages of our website.

Alternate Dispute Resolution Options

INFORMAL SETTLEMENT CONFERENCE: Parties have the option of handling this

case through an informal settlement conference. An informal settlement conference

is a meeting between the parties and/or their representatives to discuss the issues in a

case in an effort to settle the case. This process may be an alternative to a hearing with

a judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent

Judgment. Visit the Tribunal’s ADR webpage for more information.

NOTE: The parties may not request an informal settlement conference to discuss an

appeal of a principal residence exemption that was denied by either the Michigan

Department of Treasury or a County. Also, state taxes levied by the Michigan

Department of Treasury, such as income taxes, are not subject to the informal

settlement conference process.

MEDIATION: Parties have the option of handling this case through mediation.

Mediation is a voluntary process where a mediator facilitates communication between

the parties, assists in identifying issues, and helps explore solutions to

True Cash and Taxable Value

Section 5: Explain the Reason for this Appeal

Assessed value is greatly in excess of market value as reflected in November, 2024 sale of property at arms length, information contained in Respondent's sales

studies, and appraisal.

Board of Review appears to have erroneously failed to consider appeal despite timely submission by property owner. Board of Review references "letter of

authorization not received" despite the fact that Petition to Board of Review was signed by property owner.

Due to the fact that the property has been sold on land contract to Daniel Carlson and Pamela Carlson, husband and wife, as of May 5,2025, Mr. and Mrs. Carlson

are also filing a Petition regarding this propery.

Section 4: Issues Being Appealed (check all that apply)

Section 6: Jurisdictional Issues
