PROCEDURAL HISTORY

Petitioner applied to the March Board of Review (BOR) for a charitable exemption under

MCL 211.7o. The BOR denied Petitioner’s exemption because the property was not

being used.

1 The original petition incorrectly lists Rolland J Courser as Petitioner. At hearing, the parties agreed the

correct Petitioner is Courser Community Center Inc. and had no objection to the Tribunal updating the

docket to reflect such.

Page 2

MTT Docket No. 24-003423

Petitioner filed a petition with the Tribunal on May 29, 2024, and Respondent filed its

answer on October 3, 2024.

The amount of the TV in dispute, as set forth in the pleadings, for all tax years at issue

is within the jurisdictional limits of the Small Claims Division.2

ISSUES AND APPLICABLE LAW

The issue in this matter is whether Petitioner’s property qualifies for a property tax

exemption pursuant to MCL 211.7o as a tax-exempt organization.

The petitioner must prove, by a preponderance of the evidence, that it is entitled to an

exemption.3

MCL 211.7o provides, in pertinent part:

 (1) Real or personal property owned and occupied by a nonprofit

charitable institution while occupied by that nonprofit charitable

institution solely for the purposes for which that nonprofit charitable

institution was incorporated is exempt from the collection of taxes

under this act.

Pursuant to R 792.10133, after hearing, the Tribunal must issue a final decision in

writing. Additionally, “[a] written final decision shall include separate sections entitled

“findings of fact” and “conclusions of law.’” Findings of fact “shall include a concise

statement of the underlying supporting facts” that are “based exclusively on the

evidence.”4 Consequently, the Tribunal has not addressed every piece of evidence or

every inference that might lead to a conflicting conclusion and has rejected evidence

contrary to its findings. Furthermore, “[e]ach conclusion of law shall be supported by

authority or reasoned opinion.”5 Accordingly, the Tribunal will outline the summary of

evidence, findings of facts, and conclusions of law, before ultimately rendering

judgment.

No exhibits were excluded from evidence.

Based on the pleadings, admitted exhibits, and sworn testimony, Petitioner contends

that the subject property is tax exempt under MCL 211.7o.

At hearing, Petitioner, Rolland Courser, testified that he purchased the subject property

with the intent to donate the building back to the local community. The subject property

is a former school with a gymnasium and the intent was to transform the building into a

community center. Mr. Courser testified that the former owner of the property was tax-

exempt, and he does not understand why that did not carry over after he purchased the

property.

Mr. Courser testified that he purchased the property in 2020 for approximately $45,000

and received a tax exemption that year and the following year. In 2023, Respondent

revoked the exemption after determining the property was not being used. Mr. Courser

testified that there are often people working at the property, but there are many

problems such as asbestos, break-ins which caused extensive damages, and the

gymnasium roof is leaking.

Kimberly Smith also testified at hearing, stating that the overall project to get the

building back to satisfactory repair was larger than expected and a substianal amount of

money needed to be raised for the repairs. Ms. Smith testified that she had no idea how

many years it was going to take to restore the building. Although there was a lot of initial

enthusiasm from the community, that enthusiasm slowly faded after break-ins and

additional costs. Ms. Smith testified that they initially believed it might take 10 or more

years to come up with the approximately $500,000 that was needed to fully repair and

transform the building into a community center. Ms. Smith testified that they had

fundraisers and community events to raise funds, but those events did not occur at the

subject property.

In the end, there was not enough money readily available to transform the building into

a community center, and the property was deeded back to Mr. Courser in November

2024. Ms. Smith testified

STATE TREASURER

Bulletin 26 of 2017

December 12, 2017

MCL 211.70 Charitable Exemption

TO:

Assessors, Equalization Directors and Interested Parties

FROM:

State Tax Commission

SUBJECT:

MCL 211.70 Charitable Exemption

This Bulletin provides an overview of the charitable exemption provided in MCL 211.70 and the

applicable court cases that need to be considered

in determining whether or not

a claimant

is

eligible to receive the exemption. While this Bulletin provides general information related to the

charitable exemption, individuals may wish to seek legal counsel if they have questions regarding

their specific situation.

A. STATUTORY PROVISION AND THREE-PART TEST

MCL 211.70 of the General Property Tax Act provides an exemption for “[r]eal or personal

property owned and occupied by a nonprofit charitable institution while occupied by that

.

.

.

institution solely for the purposes

for which

that

.

.

.

institution was incorporated.”

In

determining whether a taxpayer is qualified for the exemption, a three-part test is applied:

1.

Is the real estate owned and occupied by the exemption claimant?

.

Is the exemption claimant a nonprofit charitable institution?

3.

Is the buildings and other property thereon occupied by the claimant solely for the

purposes for which the claimant was incorporated?

If all three prongs of the test are met, then

a claimant qualifies for

a charitable institution

exemption.

(2008)

Page 2

Bulletin 26 of 2017

Page 2

MCL 211.70 Charitable Exemption

With regard to the third prong, property may be apportioned for purposes of this exemption.

In

such instances, the exemption

is granted only for that portion of the premises used for the

purpose for which the claimant was incorporated. See McFarlan Home v City of Flint, 105 Mich

App 728 (1981).

Apportionment is only permitted in the case of real property and that the

apportionment must be based on an allocation that grants the exempt status only to the portion

of the premises which is physically occupied “solely” for the exempt charitable purpose.

B. WEXFORD FACTORS

In

Wexford Medical Group

v Cadillac, 474 Mich

192; 713 NW2d 734 (2006) the Michigan

Supreme Court set forth the following six requirements that must be met for a claimant to be a

nonprofit charitable institution:

1.

The claimant must be a nonprofit institution;

2.

The claimant must be organized chiefly, if not solely for charity;

3.

The claimant must not offer

its charity on

a discriminatory basis by choosing who

among the group

it purports to serve deserves its services, but rather must serve any

person who needs the particular type of charity being offered;

4.

The claimant must bring people’s minds or hearts under the influence of education or

religion; relieve people’s bodies from disease, suffering, or constraint; assist people to

establish themselves for life; erect or maintain public buildings or works; or otherwise

lessen the burdens of government;

5.

The claimant may charge for its services as long as its charges are not more than what is

needed for its successful maintenance; and

6.

The claimant need not meet any monetary threshold of charity; rather, if the overall

nature of the claimant is charitable, it is a charitable institution.

C. BARUCH SUPREME COURT DECISION

Wexford factor three was recently defined by the Michigan Supreme Court in Baruch SLS, Inc v

Tittabawassee Twp, 500 Mich 345; 901 NW2d 843 (2017). The Supreme Court created a new

“reasonable relationship” test to be applied when evaluating factor three; “whether the restrictions

or conditions the institution imposes on its charity bear a reasonable relationship to a permissible

charitable goal.” The Supreme Court instructed that this “reasonable relationship” test is to be

construed “quite broadly to prevent unnecessarily limiting the restrictions a charity may choose to

place on its services” noting that other states have employed similar tests. The Supreme Court

further advised “the relationship between the institution’s restriction and its charitable goal need not

be the most direct or obvious. Any reasonable restriction that is implemented to further a charitable

goal that passes factor four is acceptable.” The Supreme Court also stated that the analysis of a

Michigan Supreme Court

Further, the Court’s discussion of the “use” of property is not inconsistent with our

interpretation of the term “occupy.” It is certainly consistent for a charitable institution

to use property on which it maintains a regular physical presence. Use of property is just

one part of occupying it. The two terms are not mutually exclusive; “use” is merely

narrower than “occupy.”

| first heard about the Facebook site “SAVE THE BLANCHARD

ELEMENTARY SCHOOL” in 2019.

As time went on-the

membership grew and grew until it reached over 500 members.(see

cover sheet)

| joined and agreed with them that they had a solid

plan in order to SAVE the school

| attended in the 1960's.

October

25, 2016 The school and four city blocks had been sold to

a Greg & Brenda Schankin for $12,000 October 25, 2016 and was

TAX EXEMPT for no reason that anyone could or would talk about.

They were receiving over $300 per month by CMS Internet for

allowing CMS to place a tower at the school.

ary 16,

2020

| contacted the leaders of the “Save the School”

group (Kim Smith. Tina Murray and Renee Chapman) and decided to

buy the school and donate it to them for their idea of having a

community center.

| was able to buy it for $45,000 (plus fees of apx.

$4,000). |insisted that they set up a 501C3 for tax reasons on my

attorney’s advice. My closing was on January 16, 2020.

December 12, 2024 was the actual date that

| was finally able to

sign the deed over to “THE COURSER COMMUNITY CENTER”. They

had been doing a lot of work (see enclosed pictures) in and around

the building plus: estimates for repairs, getting donations, having

meetings for residents, many fund raising activities, etc., etc., etc.

They did contact the assessor about the “tax exempt” property

Page 5

to give them the deed. We also received the Winter 2024 ($2080.88

paid late $2349.55) tax bill and the Summer tax bill in 2024 ($715.77)

We also received the Winter tax bill ($2128.87) due before

| was able

to get the deed to them. We all thought we were operating under the

tax exempt status!

Now here’s the problem — The total amount of our funds (donations,

can drives, meals, etc.) was $10,248.90. The total property taxes

were $5862.52. Liability insurance was over $1100.00 per year.

Electric bills, dumpsters ($400 each x 4) — we cleared out all the

asbestos as recommended by the hazardous inspection company.

We also discovered that the Gym roof needed replacement

($52,000) and the Rubber roof at over $125,000. We sure could have

used that extra tax money!

I did find out that Blanchard (the assessor and the Rolland Township

Board) showed no help. There had been a number of break ins prior

to my purchase, BUT there were at least five more since

1 boughtitin

2020. Kim even caught three high school age kids and the police got

there in time to catch them, but the Prosecutor’s office declined to

follow through. They did over $30,000 in damage that time.

HEARING INFORMATION – PLEASE READ IMMEDIATELY

GENERAL INFORMATION: An impartial hearing will be conducted in accordance with the Michigan Tax

Tribunal Rules (R 792.10201-R 792.10297) and the Michigan Administrative Procedures Act, MCL 24.201 et

seq. The Michigan Rules of Evidence and the Michigan Court Rules may be applicable. A party is expected to

exercise proper respect and courtesy toward other parties, witnesses and administrative law judges, which

includes attending the hearing on time, silencing cell phones, and dressing in appropriate clothing for in-person

hearings. The hearing may be recorded for notetaking purposes, but the recording is not a formal record,

unless otherwise provided for by the Tribunal.

REPRESENTATION: You may have an attorney or anyone else of your choice represent you at the hearing.

The Tribunal does not recommend or appoint representatives for you and will not pay for your representative.

WITNESSES: You may have anyone join you at the hearing to speak in support of your case. However, the

time to present your case is limited and additional time may not be provided to accommodate witness

testimony.

DOCUMENTATION: Parties are required to submit all documents in support of their contentions to the Tribunal

and the opposing party at least 21 days before the hearing date even if the documents were previously

submitted to the local Board of Review or the Michigan Department of Treasury. If the documents are not

timely submitted to the Tribunal and the opposing party, the documents may be excluded. Documents may be

submitted by mail or through the Tribunal’s e-filing system. Documents may be sent to the opposing party by

mail or by e-mail, if the parties agree to submission by e-mail. If sent by mail, the documents must be sent to

the opposing party or their authorized representative at the address identified in the petition or answer for that

party or authorized representative, unless the party or authorized representative filed an appearance or other

documentation identifying a different mailing address. The documents do not need to be resubmitted after

the Notice of Hearing if they were previously submitted to the Tribunal and the opposing party.

If a hearing had previously been scheduled in this case and adjourned, and the adjournment order indicates

that the parties are precluded from submitting any further documentary evidence, no further documentary

evidence will be accepted even if filed and exchanged, as indicated above.

Inclusion of Subsequent Tax Years: Subsequent tax year assessments are automatically included in a

valuation appeal once the assessment has been established for that tax year unless the Tribunal grants the

exclusion of the subsequent tax year. For purposes of administrative efficiency, the Tribunal considers this

date April 1st. As such, the parties should be prepared to discuss all additional assessments at hearings to be

conducted on or after April 1st. If the hearing is to be conducted prior to April 1st, taxpayers would be required to

file a new petition and, if necessary, protest the subsequent tax year assessment at the March Board of

Review for that tax year.

MOTIONS/REQUESTS: A motion is a written request filed by a party asking the Tribunal to take certain action.

The following motions and requests (including subpoenas) may be filed by either party regarding the scheduled

hearing. Motions and requests may be submitted by mail or through the Tribunal’s “e-filing” system, if available.

If a motion or request is not granted or the Tribunal has not notified you that it has been granted, you are

required to attend the hearing.

1. Motion to Adjourn: A party may request the hearing be rescheduled (i.e. adjourned). The motion must be

submitted to the Tribunal and the opposing party at least 28 days before the hearing unless there are

emergency circumstances. The emergency circumstances must be detailed to justify the granting of what

would otherwise be considered a late motion. A $25 fee is required for the filing of the motion unless the case

involves the valuation of property and the property at issue had a principal residence exemption of at least 50%

at the time the petition was filed, for the tax years at issue, or the sole issue being appealed relates to a

This abandoned school property was transferred from Mr Courser to the Courser

Community Center in 2021 , with the intention to refurbish the building and turn it into a

community center. They obtained their 501c3 and applied for exemption. It was granted

and continued through the 2022 assessment/tax year. It was assessed on the 2023 roll

when the township saw no movement toward using it for the charitable intentions. The

2023 non-exempt status was not appealed.

Since 2021 the building has fallen into even more disrepair and there has been little or

no movement to make it usable. The organization has not been occupying or using the

building for their charitable mission and cannot predict when the situation will change.

The Township decided to continue assessing the parcel on the 2024 assessment roll for

this reason.

This property (The Blanchard Elementary School) was purchased and donated to become the focal community center,

It was

registered and recognized by the IRS as a charitable 501C3 tax exempt non profit organization. (copy enclosed)

The local assessor (Denise Hall) in 2023 determined that the "mission statement” required by the IRS and the state of Michigan was

not being followed (or used) as she felt it should be based on some research she had done. We disagree! It's been completely

operated by volunteers and all expenses depend on tax exempt donations. We started with the following problems that MUST be

completed prior to having any use of the buildings:

1. needs new roof ($52,000 for the Gym) {$135,000 for the flat roof}

2. break-ins (all windows broken, toilet fixtures broken) ($40,000) kids were arrested

3. asbestus inspection - DONE -we paid over $5000 to make sure it was safe

4. heafing system does not function and needs to be repaired

We have been working day in and day out on these items along with applying for grants, but there are nol a loi of people that can

made these large donations and now the township wants us to pay thousands in taxes! while the previous owner paid NOTHING for

over 8 years or moreli!

We are and have been using the ball park area for local children to play baseball and soccer. We keep it mowed.

Section 5: Explain the Reason for this Appeal

1. needs new roof ($52,000 for the Gym) {$135,000 for the flat roof}

2. break-ins (all windows broken, toilet fixtures broken) ($40,000) kids were arrested

3. asbestus inspection - DONE -we paid over $5000 to make sure it was safe

4. heafing system does not function and needs to be repaired
