Section 4: Explain Your Answer to this Appeal

The 2026 assessment for the subject property was completed in accordance with the General Property Tax Act and Stat Tax Commission (STC)

guidelines. Michigan law requires assessors to use mass appraisal when determining true cash value. For 2026, the valuation was based on the current

land table, the residential cost manual, depreciation schedules, and the Economic Condition Factor (ECF) for the Narrow Lake neighborhood. These

same valuation components were applied uniformly to all properties in the area.

The 2026 assessed value reflects the updated sales study and ECF calculations for the 2024-2025 study period, not the property's 2023 foreclosure

sale or private appraisal. STC guidance prohibits using a single sale or private appraisal to set assessed value, and distressed sales cannot be used to

reduce the neighborhood's valuation model.

Taxable value for 2026 was calculated correctly under MCL 211.27a, increasing only by the inflation multiplier after the 2024 uncapping. This is the

statutory method for determining taxable value and applies equally to all properties.

The land value, building value, ECF, assessed value, and taxable value for 2026 all fall within the expected and legally required ranges. There is no

indication of an error or deviation from STC standards.

ORDER OF PARTIAL DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that Petitioner

is appealing assessments for prior tax years and the Tribunal has no authority over

those assessments under MCL 205.735a, as the petition was not timely filed.1 Further,

the Tribunal also has no authority over those assessments, as the facts alleged do not

establish that the assessments were the result of a clerical error (i.e., “an error of a

transpositional, typographical, or mathematical nature”) or a mutual mistake of fact (i.e.,

“an erroneous belief, which is shared and relied on by both parties”).2 Rather, the facts

alleged indicate a valuation dispute that does not involve the correction of a clerical

error or mutual mistake of fact. Therefore,

IT IS ORDERED that Petitioner’s assessment appeal is PARTIALLY DISMISSED. The

appeal shall continue for the 2026 tax year(s) only.

To: Brookfield Township Board of Review

From: Chad Holt and Kathy Kain, 8767 Narrow Lake Road

Re: Request for review

To whom it may concern:

We are writing to formally request a review of the assessment and taxation of our property

purchased in February 2023.

Attached, you wili find documentation of:

e

A comparison of a similarly priced house (sold the same year) on the opposite side of

the lake. The report includes square footage, sale price, assessed value, and taxable

value comparisons since 2023 for 8767 Narrow Lake Road and 8616 Lake Drive

-

Email correspondence with the previous and current property assessor

The original property appraisal at the time of sale for 8767 Narrow Lake Road

It is our contention that our home was initially appraised and taxed unfairly, and the effects have

made the current assessment and taxation incorrect or unfair in comparison. Any explanation

that purchasing our home through foreclosure at a value much lower than the market value is

not supported by either the homes in the area or the appraisal done at the time of sale. The sale

price of the home declined dramatically due to the market value at the time and it remained on

the market until its worth matched the sales price. The initial appraisal appears to be based on

the highest and first amount the home was listed at. It did not receive an offer until the price

went below $400,000. Opinions that it was worth more than the purchase price seem to be just

that.

We request that the initial assessment reflect the actual market and property values, as

determined by the hired property appraiser. We also request that the following three years be

computed using the correct information to accurately reflect the taxes owed.

Thank you for your time and consideration in reviewing our case.

Hi Chad,

The appraisal completed when the bank sold the home reflects the value of a distressed transaction, not open-market

conditions. Michigan law requires assessed value to be based on arm’s-length market sales, so foreclosure-related

appraisals cannot be used to determine true cash value.

The 2026 assessed value at 8616 Lake Dr is 222,373 and the taxable is 212,592.

Thank you,

Yahoo Mail - Re: Questions

Hi Chad,

When you purchased your home in 2023, the taxable was capped. The year following a sale,

there is uncapping, which brings the home to current market value and the assessed

becomes the taxable for that year. In 2025, the market value decreased which is why your

assessed shows lower. The taxable value cannot be higher than the assessed, so that is why

the taxable value is the same as your assessed for that year. In 2026, there was an increase

in market value, so your assessment went up. Your taxable went up the rate of inflation,

which is 2.7% for 2026. Assessment values will fluctuate depending on market value for the

year, while taxable values can only increase the rate of inflation or 5%, whichever is lower.

I hope this gives you a better explanation.

Thank you,

Jennifer,

Brookfield Township Assessor

We feel that our original uncapping was inconsistent with homes of similar value in our township, and that the current assessment far exceeds our home's market

value. The information provided shows dramatic increases and decreases in our assessment, which do not reflect the real estate market in the area. This

information is being provided to you in table form. There are only a few similar homes on our lake currently on the market that provide a fair comparison. After

learning that our appeal was denied, we have placed our home on the market for the township's determination. There have been zero inquiries or showings since

listing our home for sale, which seems inconsistent with home sales in our area. We are providing all the information that was provided to the township, along

with their decision, for your review. We also feel that the township should be responsible for all fees to get a second opinion.
