ORDER OF DISMISSAL

The Tribunal has considered the file in this case and finds that Petitioner was placed in

default on January 6, 2025, because Petitioner failed to file a Valuation Petition form

and failed to file a copy of the March Board of Review Decision. Although Petitioner

responded on January 14, 2025, their attempt to cure was incomplete and on January

31, 2025, the Tribunal extended the time for Petitioner to cure the default by an

additional 14 days. Petitioner has failed to respond. Petitioner has not complied with

either order, and the latter stated that “failure to comply with this Order shall result in the

dismissal of the case . . .” and referenced Grimm v Dep’t of Treasury.1 In Grimm, the

Michigan Court of Appeals summarized factors that the Tribunal should consider before

imposing the sanction of dismissal. Those factors are:

(1) whether the violation was wilful or accidental; (2) the party's history of

refusing to comply with previous court orders; (3) the prejudice to the

opposing party; (4) whether there exists a history of deliberate delay; (5)

the degree of compliance with other parts of the court's orders; (6)

attempts to cure the defect; and (7) whether a lesser sanction would better

serve the interests of justice.2

Here, Petitioner’s failure to comply with multiple orders has established a history of

deliberate delay. As a result, giving careful consideration to the factors involved and

considering all options in determining what sanction is just and proper, the Tribunal

finds that dismissal is appropriate, and a lesser sanction would not be appropriate in

light of Petitioner’s history of noncompliance in this case.

Therefore,

IT IS ORDERED that this case is DISMISSED.

This Order resolves all pending claims in this matter and closes this case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

ORDER EXTENDING TIME FOR PETITIONER TO CURE DEFAULT

The Tribunal has considered the file in this case and finds that Petitioner was held in

default because they did not file a Petition or submit a copy of the notice giving rise to

the appeal. Petitioner failed to respond to the Order of Default, and the Tribunal

entered an order extending the time to cure on January 6, 2025. Though Petitioner filed

a response on January 14, 2025, they have failed to cure the default. In order to appeal

to the Tribunal, Petitioner is required to file a Small Claims Petition Form. Forms are

available on the Tribunal’s website at https://www.michigan.gov/taxtrib/small-

claims#scforms. It appears from the submitted appeal letter that Petitioner is disputing

the property’s assessment, and they would therefore be required to file the “Petition for

Valuation Appeal.”

Petitioner is also required to file a copy of the notice giving rise to the appeal, which in a

valuation appeal, is the March Board of Review Decision. As it should be outlined in the

assessment notice referenced by Petitioner, a protest to the March Board of Review

must be made in such disputes before the Tribunal can acquire jurisdiction over the

appeal.1 Further, because Petitioner failed to respond to the original Order of Default,

Petitioner must file a Motion to Set Aside Default and proof that the motion was served

on Respondent. Motion forms are available on the Tribunal’s website at the same

location referenced above.

The Tribunal is unable to defer the time to cure the default as requested in Petitioner’s

response, particularly in the absence of a properly filed motion requesting an extension.

As noted in TTR 225: “All requests to the tribunal requiring an order in a contested case,

including stipulated requests, must be made by written motion that is signed and filed

with the tribunal and accompanied by the appropriate fee, unless otherwise ordered by

the tribunal.”2 Petitions, motions, and other submissions may be filed using the

Tribunal’s e-filing system, however, which is available on the website at

https://efiling.apps.lara.state.mi.us/Account/Login.aspx?ReturnUrl=%2f&rg=1.

MTT Docket No. 24-004152

Though the Tribunal finds one final extension of time to cure the default appropriate,

Petitioner’s failure to comply with Tribunal orders and its Rules of Practice and

Procedure has established a history of deliberate delay that would justify dismissal of

the case for failure to timely comply with this Order.3 Therefore,

IT IS ORDERED that the time for Petitioner to cure the default is EXTENDED.

IT IS FURTHER ORDERED that Petitioner must complete the following to cure the

default: (1) file a Small Claims Petition Form, (2) file a copy of the March Board of

Review Decision, (3) file a Motion to Set Aside Default, and (4) file proof the Motion to

Set Aside Default was served on Respondent. The foregoing must be filed with the

Tribunal within 14 days of the entry of this Order.4

Failure to comply with this Order may result in dismissal of the case, as provided by

| am writing to let you know why

| did not receive notice giving rise.

| am not familiar with the tax system in the USA, and found the information on line to write to

ask for tax relief.

| wrote a letter and thought someone would call me so

| could explain my situation, which is

how it works in Canada, where

| am from. {am now a dual citizen of both the USA and Canada

since

| received my citizenship in 2023.

Needless 0 say,

| find the tax system here very high.

Every year my taxes go up, as

| stated in

my first letter to Munday Township on March 4, 2020.

Nothing was done to give us relief. We don’t utilize all of the “extra” charges on our tax bill and

every year the list gets longer and more expensive for us....which we cannot afford.

At this rate we will lose our home..and as

| stated in my letter, other people with bigger homes

pay less.

| was told

| have to apply to set aside motion for default?

| don't know what that is, and my

husband and I, being 80 year old, don’t think we understand any of this.

All we want is to

keep our home affordable, and as we are pensioners, we can't afford a lawyer.

Please, someone, call us to help us understand this situation. We are in Texas for the winter in

a trailer park, and will be back home in April. Can we defer this until then?

Do we have to pay for a deferral?

Thank you

Re: Parcel Number 15-35-5-1-006

We received our tax assessment for 2024.

In 2017 when I purchased this property, it was $58,200.

In 2018 it went to:

64,400

In 2019

it went to:

69,800

In 2020 it went to:

73,200

In 2021 it went to:

76,700

In 2022 it went to:

81,000

In 2023 it went to:

88,600

In 2024 it went to:

94,300

My taxes have gone up so much that we are paying almost $3000.00 a year now.

That is hard for us. We are both 80 years old now and live on my husbands pension.

($24,000 per year) I do not have a pension as T immigrated from Canada in 2017.

We have not done anything to change the house or upgrade it in anyway.

It is the same as

when we bought it in 2017.

I know a person who lives on Wise St., in Rankin, just up the street from Mundy

Township Office. They have a huge addition on the Back of their house and extends to

behind their attached garage on the house which almost doubles the size of their house.

Also they have a 30x40 foot and about 17ft high, big garage, in the back yard. Yet they

pay less taxes than we do... Why??

Why are our taxes going up so much every year? We have a smaller house with no other

buildings on the property, and as I mentioned , we have not done anything inside or

outside of the house since we bought it. At this rate, we will not be able to afford to keep

our home. What can we do to stop the increases every year or to lower them?

Any help would be appreciated.

MICHIGAN TAX TRIBLINAL
