ORDER SETTING ASIDE RESPONDENT’S DEFAULT

ORDER DENYING JOINT STIPULATION FOR ENTRY OF CONSENT JUDGMENT

ORDER OF DISMISSAL

The Tribunal has reviewed the case file and finds that Petitioner was held in default on

June 12, 2025, for failing to file the correct petition for the issue under appeal and for

failing to pay the petition filing fee. Petitioner failed to respond; thus, the Tribunal issued

an order extending the default, allowing Petitioner an additional 14 days to respond and

further required a copy of the notice giving rise to the appeal, i.e. principal residence

exemption (PRE) denial notice.1 On August 12, 2025, Petitioner filed a motion

requesting the Tribunal set aside their default, a $25.00 filing fee, and an amended

petition indicating the date the denial was issued was June 21, 2024; however,

Petitioner stated the notice was sent to the wrong address. On September 11, 2025,

the Tribunal issued an order placing Petitioner’s motion in abeyance as Petitioner failed

to pay the additional $25.00 filing fee due, as well as failed to file a copy of the PRE

denial notice, and additionally held Respondent in default for failing to file an answer.2

Without the PRE denial notice or an answer from Respondent, the Tribunal was unable

to determine the timeliness of the appeal.3 Respondent then filed their answer which

confirmed that the denial was issued on June 24, 2024, but that the denial was sent to

the wrong address, and a Stipulation was forthcoming. On September 11, 2025, the

parties filed a Joint Stipulation for Consent Judgement, but failed to pay the applicable

$25.00 stipulation filing fee.

The Tribunal has reviewed the stipulation and finds that it has no authority over

Petitioner’s appeal. The pleadings and accompanying documentation indicate that

Petitioner is appealing Respondent’s PRE denial for Parcel No. 68-004-036-009-20 for

the 2024 tax year. The Tribunal has no authority over that parcel under MCL

Court reiterated previous appellate decisions in its reasoning that the Tribunal’s

ORDER HOLDING PETITIONER’S MOTION TO SET ASIDE DEFAULT IN ABEYANCE

ORDER HOLDING RESPONDENT IN DEFAULT

On August 12, 2025, Petitioner filed an amended petition and motion requesting that the

Tribunal set aside the default entered on June 12, 2025.

Respondent has not filed a response to the motion.

The Tribunal has reviewed the file in this case and finds that Petitioner was held in

default for filing the incorrect petition for the issue under appeal and failing to pay the

requisite $25.00 petition filing fee. Petitioner failed to respond, and the Tribunal issued

an Order Extending Time for Petitioner to Cure Default, allowing an additional 14 days

to cure. Now that Petitioner has filed the motion and the amended petition, Petitioner

has partially complied with the Tribunal’s orders. However, Petitioner’s attempt to cure

the default was incomplete. The Order of Default required Petitioner to pay $25.00 for

the filing of the petition and an additional $25.00 for the filing of the motion, totaling

$50.00 due. Petitioner only paid one filing fee of $25.00, not the required $50.00.

Additionally, in the amended petition, Petitioner states they “never received the letter

regarding denial of principal residence,” and that the denial was issued on or around

June 21, 2024. However, without a copy of that notice the Tribunal is unable to

determine the timeliness of the appeal. Thus, the Tribunal must review the answer

required by Respondent.

Further, the Tribunal finds Respondent has failed to file an answer. Tribunal rules state,

“[a]n answer to a petition must be filed with the tribunal within 28 days after the tribunal

serves the notice of docket number on the respondent. Failure to file the answer as

required by this rule may result in the holding of respondent in default, as provided by R

792.10237.”1 As such, Respondent must file an answer within 14 days of the entry of

this order. Small Claims answer forms can be found on our website at

www.michigan.gov/taxtrib. Therefore,

IT IS ORDERED that Petitioner’s Motion to Set Aside Default is held in ABEYANCE.

IT IS FURTHER ORDERED that Respondent is held in DEFAULT.

IT IS FURTHER ORDERED that Respondent must complete the following to cure the

default: file an answer for denial of principal residence exemption. The foregoing must

be filed with the Tribunal within 14 days of the entry of this Order.2

Failure to comply with this order will result in Respondent being required to file a motion

to set aside the default, with the appropriate filing fee.

ORDER EXTENDING TIME FOR PETITIONER TO CURE DEFAULT

The Tribunal has considered the file in this case and finds that it entered an order

holding Petitioner in default on June 12, 2025, because Petitioner filed the wrong

petition for the issue under appeal and failed to pay the required $25.00 petition filing

fee.1 Petitioner filed a Petition for Valuation form but indicated they were appealing the

denial of a Principal Residence Exemption. Petitioner was required to file a Petition for

the Denial of Principal Residence form, indicating the docket number previously

assigned by the Tribunal, and pay the required $25.00 filing fee within 14 days.

Petitioner has had ample time to comply, yet has failed to respond or submit the

required filings. Though the Tribunal finds an extension of time to cure the default

appropriate, Petitioner’s failure to comply with Tribunal orders and its Rules of Practice

and Procedure has established a history of deliberate delay that would justify dismissal

of the case for failure to timely comply with this order.2 Therefore,

IT IS ORDERED that the time for Petitioner to cure the default is EXTENDED.

IT IS FURTHER ORDERED that Petitioner must complete the following to cure the

default: (1) file a Petition for Denial of Principal Residence Exemption, indicating the

docket number previously assigned by the Tribunal and if utilizing the Tribunal’s e-filing

system, file on the assigned docket number as an “amended petition,” (2) pay the

required $25.00 filing fee for the filing of the petition (3) file a Motion to Set Aside

Default, (4) pay the $25.00 fee required for the filing of the motion, and (5) file proof the

motion was were served on Respondent.

The foregoing must be filed with the Tribunal within 14 days of the entry of this order.3

1 The order further stated, “Failure to comply with this order will result in the defaulted party being

required to file a motion to set aside the default (with appropriate filing fee).”

2 See Grimm v Dep’t of Treasury, 291 Mich App 140 (2010).

3 “A submission by mail is considered filed on the date indicated by the United States Postal Service

postmark on the envelope containing the submission. A submission without a postmark or with an illegible

postmark is considered filed on the date the submission is received by the tribunal. A submission by

The Tribunal has reviewed the file in the above-captioned case and finds that:

Petitioner filed the wrong petition for the issue being appealed. See TTR 279. As such,

the petition is not properly pending. Petitioner must complete and return the appropriate

petition for the issue being appealed within 14 days of the entry of this order. The

petition shall note the docket number assigned by the Tribunal and if filed utilizing the

Tribunal’s e-filing system, must be filed on the assigned docket number as an “amended

petition.” Small Claims petition forms can be found on our website at

www.michigan.gov/taxtrib.

Petitioner did not pay the required fee for the filing of the petition. See TTR 271.

Because of this, the appeal is not properly pending. Petitioner must pay the required

fee for the filing of the petition within 14 days of the entry of this order. A filing fee

calculator can be found on our website at www.michigan.gov/taxtrib. Unfortunately, the

payment may not be made via e-filing.

Therefore,

IT IS ORDERED that Petitioner is HELD IN DEFAULT.

IT IS FURTHER ORDERED that the defaulted party shall cure the default, as indicated

above, within 14 days of the entry of this Order.i

Failure to comply with this Order will result in the defaulted party being required to file a

motion to set aside the default (with appropriate filing fee).
