answer can be reviewed by utilizing the Docket Lookup on the Tribunal’s website.

Unless Respondent was defaulted, this case is ready to be scheduled for a Small

Claims hearing and will be scheduled in the normal course of scheduling. You will

receive a Notice of Hearing from the Tribunal by e-mail if you have identified an email

address in the petition or other documentation. The Notice of Hearing will inform you of

the date, time, and location of your hearing (note that your hearing will likely be

conducted by telephone). Please read the Notice of Hearing as it includes important

information.

EVIDENCE: Parties are required to submit all evidence to the Tribunal and send a copy

to the opposing party at least 21 days before the hearing date even if the documents

had been submitted to the local Board of Review or the Michigan Department of

opposing party, the documents may be excluded. Documents may be filed with the

Tribunal by mail or through the Tribunal’s e-filing system. Documents may be sent to the

Alternate Dispute Resolution Options

INFORMAL SETTLEMENT CONFERENCE: Parties have the option of handling this

case through an informal settlement conference. An informal settlement conference

is a meeting between the parties and/or their representatives to discuss the issues in a

case in an effort to settle the case. This process may be an alternative to a hearing with

a judge and may result in the parties’ filing a Joint Stipulation for Entry of Consent

Judgment. Visit the Tribunal’s ADR webpage for more information.

NOTE: The parties may not request an informal settlement conference to discuss an

appeal of a principal residence exemption that was denied by either the Michigan

Department of Treasury or a County. Also, state taxes levied by the Michigan

Department of Treasury, such as income taxes, are not subject to the informal

settlement conference process.

Section 4: Explain Your Answer to this Appeal

Per MCL 211.7cc (5), " An owner or a land contract vendor, bank, credit union, or other lending institution that files a conditional rescission form shall annually

verify to the assessor of the local tax collecting unit on or before December 31 that the property for which the principal residence exemption is retained is not

occupied other than by the person who claimed the exemption under this section immediately preceding the foreclosure or forfeiture, is for sale, is not leased

except as otherwise provided in this section, and is not used for any business or commercial purpose. If an owner or a land contract vendor, bank, credit union, or

other lending institution does not annually verify by December 31 that the property for which the principal residence exemption is retained is not occupied other

than by the person who claimed the exemption under this section immediately preceding the foreclosure or forfeiture, is for sale, is not leased except as

otherwise provided in this section, and is not used for any business or commercial purpose, the assessor of the local tax collecting unit shall deny the principal

residence exemption on that property. "

Petitioner timely filed and received conditional rescission of principal residence exemption for 2025 tax year. Petitioner submitted second year annual verification

for 2026 on March 2nd, 2026. The deadline for annual verification is December 31st of preceding year, therefore a notice of denial was processed on March 3rd,

2026.

Section 5: Explain the Reason for this Appeal

My home for sale, located at 2076 S Long Lake Rd in Fenton, qualifies for a Conditional Rescission of Principle Residence Exemption (PRE). This home is a

primary residence that has been unoccupied and for sale since October 2024.

The PRE form was not timely filed due to contractual obligation with a buyer that fell through. This person was attempting to purchase the home under

fraudulent pretenses. We are currently in a legal battle with this individual. I attempted to file my PRE form with the City of Fenton on March 1st, 2026 with this

explanation and they denied my form submission.

After speaking with the Assessor, I met with the Board of Review and was able to reduce my assessed value to a more realistic cash value but they still denied

my PRE form. I am hoping for a reconsideration toward an exception of my late filing due to unforeseen circumstances. My PRE form for 2025 was timely filed

and accepted. Since this is a second year PRE form, the grace period does not apply.
