Roman Yousof,

Petitioner, MICHIGAN TAX TRIBUNAL

 SMALL CLAIMS DIVISION

v

 MTT Docket No. 24-004136

City Of Birmingham,

Respondent.

ORDER OF DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that:

The issue in this case is already pending in another case and, as such, this appeal is

duplicative and shall be dismissed.

Therefore,

IT IS ORDERED that the case is DISMISSED.

This Order resolves all pending issues and closes the case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

Page 2

MTT Docket No. 24-004136

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

Lansing, MI 48909

Subject: Appeal for Full Principal Residence Exemption (PRE) on Property Located at 275-277 E 14 Mile Rd, Birmingham, MI

To Whom It May Concern:

I am writing to formally appeal the determination of my Principal Residence Exemption (PRE) for the property located at 275-277 E 14 Mile Road in Birmingham,

Michigan. As a 100% disabled Marine Corps veteran, I respectfully assert my eligibility for a full tax exemption on this property under MCL 211.7b, which

provides relief for disabled veterans who own and occupy their principal residence.

The property is a duplex with a single tax identification number. I reside in Unit 277 as my principal residence, occupying over 50% of the building. Unit 275 is

primarily used as a guest residence but is occasionally rented as a short-term rental. Despite the secondary use of Unit 275, the building’s majority use is as my

permanent home, fulfilling the legislative intent of the exemption.

Key Points Supporting My Appeal:

1. Unified Tax Identification Number: The property has a single tax parcel ID, and Michigan law does not require partitioning the exemption for separate units

within a single parcel. Therefore, the exemption should apply uniformly to the entire property.

2. Majority Use as Principal Residence: I occupy Unit 277 as my permanent residence, which constitutes the majority of the property’s use. The occasional short-

term rental of Unit 275 does not alter the primary residential nature of the property.

3. Legislative Intent and Practicality: The intent of the PRE for disabled veterans is to provide comprehensive relief to those who have served. Requiring

apportionment of the exemption contradicts this purpose and creates unnecessary administrative complexities for the taxing authority and property owner.

4. Precedent Favoring Full Exemption: Similar cases involving multi-unit properties with a single tax ID have resulted in the entire property being granted the

exemption when the majority use aligns with the owner’s principal residence.

I have included documentation supporting my claim, including evidence of my 100% disability status, proof of property ownership, and records showing my

primary use of Unit 277 as my residence. I kindly request that you review this appeal and approve the full PRE for the entire property.

Thank you for your attention to this matter. If further information or clarification is needed, please do not hesitate to contact me at 248-880-7531 or

Roman.Yousof@Gmail.com.

Sincerely,

Roman Yousof
