STATE OF MICHIGAN GRETCHEN WHITMER GOVERNOR DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS LANSING MARLON I. BROWN, DPA DIRECTOR MICHIGAN TAX TRIBUNAL · 611 W. OTTAWA ST., LANSING, MI 48933 · 517-335-9760 PO BOX 30232, LANSING, MI 48909 · Other Carriers: 2407 N. GRAND RIVER AVE., LANSING, MI 48906 Robert L Hartmann, Petitioner, MICHIGAN TAX TRIBUNAL SMALL CLAIMS DIVISION v MTT Docket No. 26-000369 Township Of Casco, Respondent. ORDER OF DISMISSAL The Tribunal has reviewed the file in the above-captioned case and finds that: Petitioner failed to protest the assessment to Respondent’s March Board of Review, as required by MCL 205.735a. As such, and inasmuch as the Tribunal has no equitable power to waive or otherwise disregard statutory filing requirements and deadlines, it has no authority to hear the appeal or grant the relief requested. See Sixarp, LLC v Byron Twp, __Mich__; __NW3d__ (2025). Therefore, IT IS ORDERED that the case is DISMISSED. This order resolves all pending issues and closes the case. APPEAL RIGHTS If you disagree with the final decision in this case, you may file a motion for reconsideration with the Tribunal or a claim of appeal with the Michigan Court of Appeals. A motion for reconsideration must be filed with the Tribunal with the required filing fee within 21 days from the date of entry of the final decision. Because the final decision closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing system; it must be filed by mail or personal service. The fee for the filing of such motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless the Small Claims decision relates to the valuation of property and the property had a principal residence exemption of at least 50% at the time the petition was filed or the decision relates to the grant or denial of a poverty or disabled veterans exemption and, if so, there is no filing fee. You are required to serve a copy of the motion on the opposing party by mail or personal service or by email if the opposing party agrees to electronic service, and proof demonstrating that service must be submitted with the motion. Responses to motions for reconsideration are prohibited and there are no oral arguments unless otherwise ordered by the Tribunal.

There is no certification fee. By:___________________________________ Patricia L. STATE OF MICHIGAN GRETCHEN WHITMER GOVERNOR DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS LANSING ORLENE HAWKS DIRECTOR South Haven Michigan 49090 Taxing Authority (City or Township) Township Of Casco (ALLEGAN) County Allegan Section 4: Issues Being Appealed (check all that apply) True Cash and Taxable Value Section 5: Explain the Reason for this Appeal I am protesting the assessed value and True Cash Value (TCV) of my property on the grounds of overassessment, as the current valuation exceeds fair market value in violation of MCL 211.27. 1. Recent Arm’s-Length Comparable Sale (Most Probative Evidence) The property located at 7251 Beverly Drive (Parcel 03-02-430-010-00) sold in February 2026 for $755,000 in an arm’s-length transaction. This is the most relevant comparable due to: Immediate proximity (adjacent property) Similar lot size, use, and improvements Recent sale date reflecting current market conditions My property is currently assessed at a True Cash Value (TCV) of approximately $1,099,306, which exceeds this verified market transaction by over 40%. 2. Price Per Square Foot Analysis Comparable Sale (03-02-430-010-00): $755,000 ÷ 3,293 sq ft = ~$229/sq ft Subject Property (03-02-430-009-00): $1,099,306 ÷ 3,225 sq ft = ~$341/sq ft My property is being assessed at approximately 49% higher $/sq ft than a nearly identical neighboring home that just sold. This substantial premium is not supported by: Property characteristics Location differences Market evidence This clearly indicates the current assessment materially exceeds market value. 3. Lack of Superior Characteristics My property is not superior to the comparable sale: Smaller lot size Comparable living area Similar location and utility There is no market-based justification for a higher valuation than the recent sale. 4. Michigan Assessment Standard (50% Rule) Under Michigan law, assessed value must not exceed 50% of TCV. Market Value (supported by sale): ~$755,000 Indicated Assessed Value: ~$377,500 Current Assessed Value: $638,200 This confirms the property is significantly overassessed. 5. Reliance on Outdated Market Data Prior assessments appear to rely on older sales reflecting peak market conditions (e.g., 2022), which are less indicative of value as of tax day compared to the February 2026 transaction. Section 6: Jurisdictional Issues Year(s) you are appealing: 2025 Did you protest the assessment at a Board of Review (BOR)? No If Yes, check which BOR you attended AND upload the BOR decision: If No, check the applicable reason(s): Assessment Change Notice was not sent to Petitioner
