ORDER DENYING PETITIONERS’ MOTION TO SET ASIDE DEFAULT

ORDER OF DISMISSAL

On September 16, 2025, Petitioners filed a motion and paid the applicable motion fee,

requesting that the Tribunal set aside the default entered on August 1, 2025.1

Respondent did not respond to the motion.

On October 30, 2025, the Tribunal issued an order placing Petitioners’ motion in

abeyance and extending the time for Petitioners to cure the default by an additional 14

days, stating that while Petitioners partially complied with Tribunal rules by filing a

Motion to Set Aside Default and paying the fee required for the filing of the motion,2

Petitioners failed to pay the fee required for the filing of the petition. Though Petitioners

timely responded by paying the required petition filing fee on November 8, 2025, the

Tribunal issued a third order extending the time for Petitioners to cure the default. In

that order the Tribunal clarified that although Petitioners had satisfied the requirements

of the initial default, Petitioners had failed to file proper proof evidencing the service of

the petition.3 Petitioners were allowed an additional 14 days to respond, have had

ample time to reply, yet have failed to respond or submit the requested filings. As such,

granting the motion is not warranted.

Furthermore, the Tribunal finds that Petitioners have not complied with the orders

extending default, which stated that “failure to comply with this order may result in the

dismissal of the case” and referenced Grimm v Dep’t of Treasury.4 In Grimm, the

Michigan Court of Appeals summarized factors that the Tribunal should consider before

imposing the sanction of dismissal. Those factors are:

(1) whether the violation was wilful or accidental; (2) the party's history of

refusing to comply with previous court orders; (3) the prejudice to the

opposing party; (4) whether there exists a history of deliberate delay; (5) the

degree of compliance with other parts of the court's orders; (6) attempts to

cure the defect; and (7) whether a lesser sanction would better serve the

interests of justice.5

Here, Petitioners’ failure to comply with multiple orders has established a history of

deliberate delay. As a result, giving careful consideration to the factors involved and

considering all options in determining what sanction is just and proper, the Tribunal

finds that dismissal is appropriate, and a lesser sanction would not be appropriate in

light of Petitioners’ history of noncompliance in this case. Therefore,

IT IS ORDERED that Petitioners’ Motion to Set Aside Default is DENIED.

IT IS FURTHER ORDERED that this case is DISMISSED.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

ORDER EXTENDING TIME FOR PETITIONERS TO CURE DEFAULT

The Tribunal has considered the file in this case and finds that it entered an order

holding Petitioners’ Motion to Set Aside Default in abeyance on October 30, 2025, and

an Order Extending Time for Petitioners to Cure Default. Pursuant to the order,

Petitioners were required to pay the fee required for the filing of the petition within 14

days. Though Petitioners timely responded and submitted the required filing fee, and

thus have cured the initial default, they have not filed a proper proof evidencing service

of the petition, as required by TTR 227.1

Petitioners opted to file their appeal in the Entire Tribunal, which utilizes a formal

hearing process to resolve disputes, and they are therefore required to serve the

petition with “noted docket number” on all six of the following parties-in-interest: (1) the

certified assessor or board of assessors, (2) the township supervisor or clerk, (3) the

county equalization director, (4) the county clerk, (5) the secretary of the local school

board, and (6) the treasurer of this state. The assessor and township supervisor or

clerk must be served by certified mail or personal service; all other parties may be

served by first class mail or personal service. The proof of service filed with the petition

was filed prior to the Tribunal assigning a docket number, and it indicates that only two

of the parties-in-interest were served with the undocketed petition. As such, and

inasmuch as Petitioners are subject to default for proper proof of service, the Tribunal

finds an extension of the current default appropriate.

Petitioners’ appeal qualifies for the Small Claims Division, which utilizes an informal

hearing process to resolve disputes, based on the classification of the property at issue

and amount in dispute. Petitioners may therefore file a written motion requesting to

have the case transferred to the Small Claims Division in lieu of the required proof of

service discussed above. The motion must be accompanied by a completed Small

Claims petition form and the required $50.00 motion fee.

1 The Notice of Docket Number issued on August 1, 2025 stated: “This docket number shall be noted on

the petition and the petition shall be served within 45 days of the issuance of this notice, as required by

TTR 227 and MCL 205.735a, even if the petition as served when filed. A proof of service shall also be

filed with the Tribunal within 45 days of the issuance of this notice evidencing the service of the petition.”

Page 2

MTT Docket No. 25-003075

Therefore,

IT IS ORDERED that the time for Petitioners to cure the default is EXTENDED.

IT IS FURTHER ORDERED that Petitioners must complete the following to cure the

default: File proof evidencing service of the Entire Tribunal petition on all six parties-in-

interest in the manner required by TTR 227. Alternatively, Petitioners may file a motion

requesting to transfer the case to the Small Claims division with Small Claims petition

form and $50.00 motion fee. The foregoing must be filed with the Tribunal within 14

days of entry of this order.2

Failure to comply with this order may result in dismissal of the case, as provided by

ORDER PLACING PETITIONERS’ MOTION TO SET ASIDE DEFAULT IN ABEYANCE

ORDER EXTENDING TIME FOR PETITIONERS TO CURE DEFAULT

On September 16, 2025, Petitioner filed a Motion to Set Aside Default. Respondent has

not filed a response to the motion.

The Tribunal has considered the motion and the case file in this case and finds that

Petitioners were held in default on August 1, 2025, for failing to pay the required petition

filing fee. Petitioners failed to respond, and the Tribunal entered an order extending the

time to cure on September 9, 2025. Having now filed a Motion to Set Aside Default and

having paid the $50.00 motion filing fee, Petitioners have partially complied with the

Tribunal’s orders. Petitioners failed, however, to pay the petition filing fee. Though the

Tribunal finds one final extension of time to cure the default appropriate, Petitioners’

failure to comply with Tribunal orders and its Rules of Practice and Procedure has

established a history of deliberate delay that would justify dismissal of the case for

failure to timely comply with this order.1 Therefore,

IT IS ORDERED that Petitioners’ Motion to Set Aside Default is held in ABEYANCE.

IT IS FURTHER ORDERED that the time for Petitioners to cure the default is

EXTENDED.

IT IS FURTHER ORDERED that Petitioners must pay the petition filing fee to cure the

default. The foregoing must be filed with the Tribunal within 14 days of entry of this

order.2 A filing fee calculator can be found on our website at www.michigan.gov/taxtrib.

ORDER EXTENDING TIME FOR PETITIONERS TO CURE DEFAULT

The Tribunal has considered the file in this case and finds that it entered an order

holding Petitioners in default on August 1, 2025, because Petitioners failed to pay the

requisite Entire Tribunal petition filing fee.1 The order further indicated that if the

intention was to file in the Small Claims division, Petitioners shall file a Small Claims

petition and a copy of the notice giving rise to the appeal (i.e., notice of action taken by

Board of Review). Information on Tribunal rules, filing fees and Small Claims petition

forms can be found on our website at www.michigan.gov/taxtrib.

Petitioners were required to cure the default within 14 days; they have had ample time

to comply and have failed to respond or submit the required filings. Though the Tribunal

finds an extension of time to cure the default appropriate, Petitioners’ failure to comply

with Tribunal orders and its Rules of Practice and Procedure has established a history

of deliberate delay that would justify the dismissal of the case for failure to timely comply

with this order.2

Therefore,

IT IS ORDERED that the time for Petitioners to cure the default is EXTENDED.

IT IS FURTHER ORDERED that if Petitioners wish to remain in the Entire Tribunal

Division, Petitioners must complete the following to cure the default:

(1) pay the required filing fee for the filing of the Entire Tribunal petition, (2) file a Motion

to Set Aside Default, (3) pay the $50.00 fee required for the filing of the motion.

Unfortunately, the payment of the required filing fee may not be made via e-filing.

IT IS FURTHER ORDERED that if Petitioners intended to file in the Small Claims

Division, Petitioners must complete the following to cure the default:

1 The order further stated: “Failure to comply with this order will result in the defaulted party being

required to file a motion to set aside the default (with appropriate filing fee).”

2 See Grimm v Dep’t of Treasury, 291 Mich App 140 (2010).

(1) file a Small Claims Petition for Valuation Appeal, (2) file a Motion to Set Aside

Default; and (3) pay the $50.00 fee required for the filing of the motions and the $125.00

filing fee for the filing of the petition, if applicable.3

IT IS FURTHER ORDERED that the petition shall note the docket number assigned by

the Tribunal and if filed utilizing the Tribunal’s e-filing system, must be filed on the

assigned docket number as an “Amended Petition.”

IT IS FURTHER ORDERED that upon entry of the amended Small Claims petition, if

any, the Tribunal shall issue a Small Claims Notice of Docket.

The foregoing must be filed with the Tribunal within 14 days of entry of this order.

Failure to comply with this order may result in the dismissal of the case, as provided by

ORDER OF DEFAULT

The Tribunal has reviewed the file in the above-captioned case and finds that:

Petitioner did not pay the required fee for the filing of the Entire Tribunal petition. See

TTR 223. Because of this, the appeal is not properly pending. Petitioner must pay the

required fee for the filing of the petition within 14 days of the entry of this order. A filing

fee calculator can be found on our website at www.michigan.gov/taxtrib. Unfortunately,

the payment may not be made via e-filing.

If you intended to file in the Small Claims division, please file a Small Claims petition

and a copy of the notice giving rise to the appeal (i.e., notice of action taken by Board of

Review, uncapping notice, PRE denial notice, final assessment notice, etc.). The

petition shall note the docket number assigned by the Tribunal and if filed utilizing the

Tribunal’s e-filing system, must be filed on the assigned docket number as an “amended

petition.” Small Claims petition forms can be found on our website at

www.michigan.gov/taxtrib.

Therefore,

IT IS ORDERED that Petitioner is HELD IN DEFAULT.

IT IS FURTHER ORDERED that the defaulted party shall cure the default, as indicated

above, within 14 days of the entry of this order.i

Failure to comply with this order will result in the defaulted party being required to file a

motion to set aside the default (with appropriate filing fee).
