ORDER GRANTING PETITIONER’S MOTION FOR RECONSIDERATION

ORDER REINSTATING CASE

ORDER HOLDING PETITIONER IN DEFAULT

On July 10, 2026, Petitioner filed a motion requesting that the Tribunal reconsider the

Order of Dismissal entered in this case on June 26, 2026. In the motion, Petitioner

states that the Order of Dismissal improperly claimed that the petition was not filed by

the May 31, 2026 deadline, as the petition filing fee was cashed on May 19, 2026.

Further, this appeal is regarding the 2026 tax year, and listing the 2025 tax year on the

petition was a clerical error.

The Tribunal has considered the motion and the case file and finds that Petitioner has

demonstrated a palpable error relative to the Order of Dismissal that misled the Tribunal

and the parties and that would have resulted in a different disposition if the error was

corrected.1 Specifically, Petitioner timely filed a claim regarding the valuation of the

subject property for the 2026 tax year pursuant to MCL 205.735a. As such, Petitioner’s

valuation claim for the 2026 tax year shall be reinstated.

However, the Tribunal notes that Petitioner attached a copy of an Assessor Denial of

Request for Exemption as Eligible Personal Property (Small Business Taxpayer

Exemption) regarding the subject parcel with the motion. Denials of a claim of

exemption under MCL 211.9o must be appealed to the March Board of Review under

MCL 211.30 before the Tribunal can acquire jurisdiction to review such a denial.2

Petitioner has failed to provide the Tribunal with a copy of the notice giving rise to the

appeal regarding the denial of the exemption (i.e., March Board of Review decision). As

a result, the appeal regarding the denial of the exemption is not properly pending.

Petitioner must provide a copy of the March Board of Review decision within 14 days of

the entry of this order. Therefore,

1 See MCR 2.119(F)(3). A palpable error is one that is “easily perceptible, plain, obvious, readily visible,

noticeable, patent, distinct, or manifest.” Luckow v Luckow, 291 Mich App 417, 426 (2011) (quotation

IT IS FURTHER ORDERED that Petitioner shall file a copy of the March Board of

Review Decision within 14 days of the entry of this order.3 If there is no March Board of

Review Decision, Petitioner shall file documentation indicating as such.

Failure to comply with this order will result in Petitioner being required to file a motion to

set aside the default (with the appropriate filing fee).

IT IS FURTHER ORDERED that Respondent shall file an answer within 28 days of the

entry of this order.

Failure to comply with this order will result in Respondent being held in default.4

A palpable error is one that is “easily perceptible, plain, obvious, readily visible,

noticeable, patent, distinct, or manifest.” Luckow v Luckow, 291 Mich App 417, 426 (2011) (quotation

marks and citation omitted).

Assessor Denial of Request for Exemption as Eligible Personal Property

(Small Business Taxpayer Exemption) MCL 211.90

Issued under the authority of the General Property Tax Act, Public Act 206 of 1893, as amended.

The Assessor is required to deny the Eligible Personal Property (Small Business Taxpayer) Exemption for personal property that is determined not

to meet the eligibility requirements of MCL 211.90. The assessor may deny a claim for exemption for the current year and/or any of the immediately

preceding 3 years.

A denial may only be issued by the assessor when a fully complete and timely filed Form 5076 is received by the local unit of

government where the personal property is located.

Forms that are not timely filed or fully completed are not considered a denial but rather a failure

to properly claim the exemption.

use the best information available to estimate the assessment. A separate Form 5379, Assessor Affidavit to Correct Taxable Value After a Denial

of EPP Granted Pursuant to MCL 211.90 must be filed with the taxpayer each assessment year a denial is entered.)

The Small Business Taxpayer Exemption is being denied for the following reason(s):

The personal property for which the Eligible Personal Property (Small Business Taxpayer) Exemption was claimed was not classified, or would not

have been classified, as commercial personal property or industrial personal property, as defined

in MCL 211.34c, for the assessment year in

The true cash value of the personal property owned, leased or possessed by the taxpayer within the local tax collecting unit was $180,000 or

more. This denial reason applies to the following assessment year(s):

2026

The true cash value of the personal property owned, leased or possessed by a related entity to the taxpayer, when combined with the true cash

value of the personal property which

is owned, leased or possessed by the taxpayer, within the local tax collecting unit was $180,000 or

more.

This denial reason applies to the following assessment year(s):

directly or indirectly, controls, is controlled

Good cause exists to grant reconsideration because:

check payable to the State of Michigan was cashed on May 19, 2026. Also this appeal is

instead.

Randy Ayyar,

Petitioner, MICHIGAN TAX TRIBUNAL

 SMALL CLAIMS DIVISION

v

 MTT Docket No. 26-002464

Township Of Waterford,

Respondent.

ORDER OF DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that:

The petition was not filed by May 31 or the next business day after the Tribunal offices

were closed. See MCL 205.735a(6). As such, and inasmuch as the Tribunal has no

equitable power to waive or otherwise disregard statutory filing requirements and

deadlines, it has no authority to hear the appeal or grant the relief requested. See

Sixarp, LLC v Byron Twp, __Mich__; __NW3d__ (2025).

Therefore,

IT IS ORDERED that the case is DISMISSED.

This order resolves all pending issues and closes the case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Page 2

MTT Docket No. 26-002464

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.
