 SMALL CLAIMS DIVISION

v

 MTT Docket No. 25-002978

City Of Lansing,

Respondent.

ORDER OF DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that:

Petitioner failed to protest the assessment to Respondent’s March Board of Review, as

required by MCL 205.735a. As such, and inasmuch as the Tribunal has no equitable

power to waive or otherwise disregard statutory filing requirements and deadlines, it has

no authority to hear the appeal or grant the relief requested. See Sixarp, LLC v Byron

Twp, __Mich__; __NW3d__ (2025).

Therefore,

IT IS ORDERED that the case is DISMISSED.

This order resolves all pending issues and closes the case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Page 2

MTT Docket No. 25-002978

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

Letter of Appeal - SEV Dispute for 3322 Turner St, Lansing, MI

To the Michigan Tax Tribunal,

I am submitting this appeal to formally dispute the State Equalized Value (SEV) assigned to my

property located at 3322 Turner St, Lansing, MI 48906, for the 2025 tax year. The City of Lansing

has assigned an SEV of $33,900, which implies a true cash value (TCV) of $67,800. However, this

valuation significantly exceeds the actual market value of the property.

I purchased the subject property in an arms-length transaction on November 5, 2024, for a total

price of $45,000. Importantly, this price included a substantial amount of non-realty personal

property, such as appliances, furniture, and two movable sheds. A detailed breakdown is included in

Exhibit A. The total value of the personal property is estimated at $3,325, resulting in an adjusted

real estate-only value of approximately $41,675.

Comparable sales in the area support this valuation. As shown in Exhibit B, multiple similar

properties sold between $34,000 and $46,000 in the same general timeframe. These properties are

comparable in size, condition, and class to the subject property. The photos provided in Exhibit C

further demonstrate the condition of the property at the time of purchase, which justifies the

market-based price paid.

Based on this evidence, I respectfully request that the SEV for the 2025 tax year be adjusted to

$20,750, reflecting a more accurate and fair market value of the real property.

Thank you for your consideration.

Sincerely,

3. Commentary

The real estate-only portion of the sale is estimated to be $41675, based on a reasonable

fair-market valuation of the included personal property. This adjusted value more accurately reflects

the true cash value of the property as defined in MCL 211.27 and supports the Petitioner's

The appellant is requesting a reduction of the 2025 State Equalized Value (SEV) for the property at 3322 Turner St, Lansing, MI, currently assessed at $33,900

(TCV $67,800). The property was purchased in November 2024 for $45,000, which included $3,325 in personal property (e.g., appliances, furniture, sheds),

resulting in a real estate-only value of $41,675. Comparable sales and property condition evidence support a lower SEV. The petitioner requests the SEV be adjusted

to $20,838 to reflect the fair market value
