ORDER REMOVING CASE FROM AUGUST 3 - 14, 2026 PREHEARING GENERAL

CALL

ORDER PLACING CASE ON OCTOBER 16 - 30, 2026 PREHEARING GENERAL

CALL

ORDER PLACING JOINT MOTION TO CONSOLIDATE IN ABEYANCE

On January 30, 2026, the parties jointly filed a motion requesting that the Tribunal sever

this appeal into two appeals because the parcels at issue are not contiguous and then

allow for the consolidation of the severed appeals.

The Tribunal has considered the motions and the case file and finds that the parties

have shown good cause to sever the parcels under appeal into separate dockets.

A

petition may not cover more than one assessed parcel of real property unless the

parcels are contiguous and within a single assessing unit." As a result, the petition filed

on April 30, 2025, is not properly pending.

Page 3

MTT Docket Nos. 25-000849 & 25-003930

The Tribunal also finds that issuing a sua sponte order extending Docket No. 25-000849

to a future Prehearing General Call is appropriate because of the identified procedural

defects and the effect of the potential timing to cure those defects upon the filing

deadlines. Therefore,

IT IS ORDERED that the joint Motion to Sever is GRANTED.

IT IS FURTHER ORDERED that Petitioner's 2025 assessment appeal for Parcel No.

22019029.016L is SEVERED and ASSIGNED to Docket No. 25-003930.

IT IS FURTHER ORDERED that Petitioner is PLACED IN DEFAULT in Docket No. 25-

000849.

IT IS FURTHER ORDERED that Petitioner shall cure the default in Docket No. 25-

000849 by filing an amended petition related solely to Parcel No. 22113599 and proof of

service of that amended petition upon all parties in interest as required by TTR 227(6).

The foregoing shall be filed within 14 days of this order.

IT IS FURTHER ORDERED that Respondent shall file an answer in Docket No. 25-

000849 within 28 days of service of the amended petition as required by TTR 235(1).

IT IS FURTHER ORDERED that Petitioner is PLACED IN DEFAULT in Docket No. 25-

003930.

IT IS FURTHER ORDERED that Petitioner shall cure the default in Docket No. 25-

003930 by filing a petition related solely to Parcel No. 22019029.016L, the required

petition filing fee, and proof of service of that petition upon all parties in interest as

required by TTR 227(6). The foregoing shall be filed within 14 days of entry of this

order. The petition shall note the docket number assigned by the Tribunal and,

if filed

utilizing the Tribunal's e-filing system, must be filed on the assigned docket as a

“Severed Petition.”

IT IS FURTHER ORDERED that Respondent shall file an answer within 28 days of

service of the petition in Docket No. 25-003930 as required by TTR 235(1).

IT 1S FURTHER ORDERED that this case is REMOVED from the August 3 - 14, 2026

IT IS FURTHER ORDERED that this case is PLACED on the October 16 - 30, 2026

Prehearing General Call.

IT IS FURTHER ORDERED that the parties shall file and exchange their valuation

disclosures by June 22, 2026. Valuation disclosures will not be admitted into evidence

unless disclosed and furnished in accordance with this order (even though admissible)

except upon a finding of good cause by the Tribunal.

IT IS FURTHER ORDERED that the parties shall file and exchange their prehearing

statements by June 22, 2026. Witnesses, with the exception of rebuttal witnesses, will

not be allowed to testify unless disclosed in the Prehearing Statement and the

Prehearing Statement is furnished in accordance with this order except upon a finding

of good cause by the Tribunal.

Failure to file the Prehearing Statement will result in

holding a party or parties in default, as provided by TTR 237.

IT IS FURTHER ORDERED that “Pre-Valuation Disclosure” discovery is CLOSED on

June 22, 2026, which means all discovery has been requested, all motions to compel

have been filed, and all requested or ordered discovery has been exchanged by that

date.

Discovery relative to the valuation disclosure prepared for purposes of litigating

this case or the valuation expert that prepared that valuation disclosure is not permitted

during “Pre-Valuation Disclosure” discovery.

Severed Entire Tribunal Property Tax Petition

Petitioner Onesky 8 & Lahser Properties, LLC, by and through its attorneys, Williams

Williams Rattner & Plunkett, PC, states as follows for its Severed Entire Tribunal Property Tax

Petition.

The Parties

1.

Petitioner Onesky 8 & Lahser Properties, LLC, is a Michigan limited liability

company with its registered offices located at 400 Hamilton Row, Ste. 300, Birmingham, MI

48009.

2.

Respondent City of Detroit is a Michigan municipal corporation with its principal

offices located at 2 Woodward Ave., Detroit, Michigan 48226.

22019029.016L

Page 2

2

The Subject Property

3.

Petitioner owns property identified as Parcel No. 22019029.016L, commonly

known as 21651 W 8 Mile Road, Detroit, Michigan 48219 (the “Subject Property”).

4.

To the best of Petitioner’s knowledge, the Subject Property was designed for, and

is presently used for, retail purposes.

5.

The Subject Property is located in Wayne County and is within the Detroit

Community Schools Public School District.

The 2025 Property Tax Assessment

6.

Respondent possesses jurisdiction to assess and collect property taxes for the

Subject Property.

7.

For the 2025 tax year, Respondent classified the Subject Property as commercial

real property.

8.

For the 2025 tax year, Respondent established the Subject Property’s assessment

for property taxes in the following amounts:

True Cash Value

Assessed Value

Taxable Value

$1,516,800

$758,400

$738,407

9.

Petitioner contends that a lawful assessment of the Subject Property for the 2025

tax year cannot exceed the following amounts:

True Cash Value

Assessed Value

Taxable Value

$940,000

$470,000

$470,000

10.

The amounts in dispute therefore are as follows:

True Cash Value

Assessed Value

Taxable Value

$576,800

$288,400

$268,407

11.

This Petition presents issues involving the Subject Property’s valuation for

property tax assessment purposes. Petitioner does not believe that this Petition presents any

Page 3

3

issues arising out of “additions” or “losses” as the General Property Tax Act, MCL 211.1 et seq.

(the “GPTA”), defines those terms, but reserves its right to assert issues involving losses should

information supporting such issues become available.

12.

The Subject Property’s 2025 assessment (a) violates the Michigan Constitution,

the GPTA, and other Michigan law, (b) is based on erroneous principles and information, (c) is

based on the misapplication of valuation principles, and (d) otherwise violates Petitioner’s rights.

13.

Petitioner does not assert that the Subject Property’s 2025 assessment is not

uniform aside from the lack of uniformity resulting from Respondent overestimating the Subject

Property’s values.

Conclusion and Request for Relief

WHEREFORE, Petitioner respectfully requests that this honorable Tribunal enter

judgment revising the Subject Property’s 2025 assessment to amounts that do not exceed the

values set forth in Paragraph 9 and granting Petitioner all other relief to which it is entitled under

Michigan law.

petition may not cover more than one assessed parcel of real property unless the

parcels are contiguous and within a single assessing unit.1 As a result, the petition filed

on April 30, 2025, is not properly pending.

Further, and as indicated in the parties’ motion, consolidation may be appropriate under

MCR 2.505. However, consideration of that motion is premature prior to the filing of

pleadings and defenses in the cases’ respective amended petitions and answers. The

Motion to Consolidate shall be placed in abeyance.

IT IS FURTHER ORDERED that Petitioner’s 2025 assessment appeal for Parcel No.

The foregoing shall be filed within 14 days of entry of this

order. The petition shall note the docket number assigned by the Tribunal and, if filed

utilizing the Tribunal’s e-filing system, must be filed on the assigned docket as a

“Severed Petition.”2

IT IS FURTHER ORDERED that Respondent shall file an answer within 28 days of

service of the petition in Docket No. 25-003930 as required by TTR 235(1).

IT IS FURTHER ORDERED that this case is REMOVED from the August 3 - 14, 2026

Prehearing General Call.

IT IS FURTHER ORDERED that this case is PLACED on the October 16 - 30, 2026

Prehearing General Call.

2 Alternatively, the petition may be downloaded from the Tribunal’s website and mailed to the Tribunal via

United States Postal Service at: Michigan Tax Tribunal, PO BOX 30232, Lansing, MI 48909. The petition

may also be delivered to the Tribunal via overnight carrier (UPS, FedEx, or DHL) at: Michigan Tax

IT IS FURTHER ORDERED that the parties shall file and exchange their valuation

unless disclosed and furnished in accordance with this order (even though admissible)

except upon a finding of good cause by the Tribunal.

IT IS FURTHER ORDERED that the parties shall file and exchange their prehearing

statements by June 22, 2026. Witnesses, with the exception of rebuttal witnesses, will

holding a party or parties in default, as provided by TTR 237.

June 22, 2026, which means all discovery has been requested, all motions to compel

have been filed, and all requested or ordered discovery has been exchanged by that

date. Discovery relative to the valuation disclosure prepared for purposes of litigating

October 16, 2026, which means all discovery has been requested, all motions to compel

have been filed, and all requested or ordered discovery has been exchanged by that

date.
