ORDER OF DISMISSAL

The Tribunal has considered the file in this case and finds that Petitioner was placed in

default on July 7, 2026, because they did not file a copy of the notice giving rise to the

appeal.1 On August 5, 2026,2 the Tribunal extended the time for Petitioner to cure the

default by an additional 14 days, and they have failed to respond. Petitioner has not

complied with either order, and the latter stated that “failure to comply with this Order

may result in the dismissal of the case” and referenced Grimm v Dep’t of Treasury.3 In

Grimm, the Michigan Court of Appeals summarized factors that the Tribunal should

consider before imposing the sanction of dismissal. Those factors are:

(1) whether the violation was wilful or accidental; (2) the party's history of

refusing to comply with previous court orders; (3) the prejudice to the

opposing party; (4) whether there exists a history of deliberate delay; (5)

the degree of compliance with other parts of the court's orders; (6)

attempts to cure the defect; and (7) whether a lesser sanction would better

serve the interests of justice.4

Here, Petitioner’s failure to comply with multiple orders has established a history of

deliberate delay. As a result, giving careful consideration to the factors involved and

considering all options in determining what sanction is just and proper, the Tribunal

finds that dismissal is appropriate, and a lesser sanction would not be appropriate in

light of Petitioner’s history of noncompliance in this case.

Therefore,

1 The Tribunal August 5, 2026 Order Extending Time for Petitioner to Cure Default clarified that Petitioner

had, in fact, filed an amended petition which included the required multiple parcel information. However,

the amended petition had simply not yet been processed at the time the July 7, 2026 Order of Default

was entered.

2 On the same date, the Tribunal held Respondent in default for failing to file an answer to the petition.

Although Respondent was provided with fourteen days in which to file an answer, Respondent has not

filed an answer as of the entry of this order.

3 Grimm v Dep’t of Treasury, 291 Mich App 140 (2010).

IT IS ORDERED that this case is DISMISSED.

This order resolves all pending claims in this matter and closes this case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

ORDER EXTENDING TIME FOR PETITIONER TO CURE DEFAULT

ORDER HOLDING RESPONDENT IN DEFAULT

On August 1, 2026, Petitioner filed documentation in response to the Tribunal’s July 7,

2026 Order of Default.

The Tribunal has considered the response and the case file and finds that Petitioner

was held in default because they failed to file a multiple parcel attachment to petition

form and failed to file a copy of the notice giving rise to the appeal, i.e., March Board of

Review (BOR) decision.1 Upon further review, it was determined that the Tribunal erred

in the entry of that order because on May 7, 2026, Petitioner filed an amended petition

which included the required multiple parcel information, the amended petition had

simply not yet been processed. Consequently, to remedy the default, Petitioner needed

only to provide a copy of the March BOR decision. Although Petitioner responded to

the Order of Default, albeit untimely, his attempt to cure is incomplete because

Petitioner again failed to file a copy of the March BOR decision. Petitioner must obtain

a copy of the March BOR decision from Respondent and file a copy of the decision with

the Tribunal.2 Though the Tribunal finds an extension of time to cure the default

appropriate, Petitioner’s failure to comply with Tribunal orders and its Rules of Practice

and Procedure has established a history of deliberate delay that would justify dismissal

of the case for failure to timely comply with this order.3

Further, the Tribunal finds that Respondent has failed to file an answer.4 Respondent

must file an answer within 14 days of the entry of this order. Small Claims answer

forms can be found on our website at www.michigan.gov/taxtrib.

Therefore,

1 The order further stated, “Failure to comply with this order will result in the defaulted party being

required to file a motion to set aside the default (with appropriate filing fee).”

2 A list of Tribunal rules are available online at www.michigan.gov/taxtrib.

default: (1) file a copy of the March BOR decision, (2) file a Motion to Set Aside Default,

and (3) file proof the motion was served on Respondent. The foregoing must be filed

with the Tribunal within 14 days of the entry of this order.5

IT IS FURTHER ORDERED that Respondent is held in DEFAULT.

IT IS FURTHER ORDERED that Respondent must do the following to cure the default:

file an answer. The foregoing must be filed with the Tribunal within 14 days of the entry

of this order.

Actual Property value / Taxable value is not nearly as high as the city now says it is. We bought the two adjoining properties in March of 2023. They were then

listed for sale for $159,900. They were then appraised by the bank at $173,000. We foolishly overpaid at $178,000 to make sure we got it, not knowing about

some of its serious problems. The previous owner's SEV on both lots was then $52,400. (X 2 = $104,800) As expected, upon the home's sale the property tax cap

came off, as allowed by Proposal A. So, our 2024 SEV on both lots was then raised to $77,700. (X 2 = $155,400) Understandable. However, in 2025, rather than

obeying Proposal A and limiting our rise in valuation to only 5% a year as it allows, the city raised it by almost 23%, from $77,700 (X 2 =$155,400) to $95,200 (X 2 =

$190,400). We should have contested that big rise then. But as new homeowners we were not aware of the short time we had to do so. Because of our big

property tax increase, we had to refinance in March of 2025. At that time the Bank reappraised the property at $179,000. That was up only $6,000 in two years.

That was about 3.5 %, or less than 2% a year. 2% a year, not 23%. We complained to the bank appraiser, and she told us that property values in this part of town

have gone up very little in value the last few years. Then in 2026 the combined assessment on both of our adjoining lots was $101,000 (X 2 = $202,000). From our

first new buyer assessment, following our home's purchase and the removal of the Proposal A property tax cap in 2024, the city has raised our assessment from

$77,700 (X 2 = $155,400) to $101,000 (X 2 = $202,000). That is a 30% increase in two years, far more than the 5% a year limit they were allowed by Proposal A to

raise our valuation. And it is far more than this property has actually risen in value in the last two years according to the bank appraiser last year.

Section 4: Issues Being Appealed (check all that apply)

True Cash and Taxable Value, Uncapping of Taxable Value

Section 5: Explain the Reason for this Appeal

We bought this house and its adjacent lot in 2023. it was then appraised by the bank at $173,000. (We foolishly overpaid 178,000 for it, not knowing it needed a new

furnace and other repairs.) The previous Proposal A property tax cap came off the following year and as expected in 2024 our property tax tax went way up

requiring us to refinance the hose in 2025. At that time it was appraised at $179,000., having risen in value according to the bank appraiser only about $3,000 a year.

However, after a gig 48% bump in valuation in 2024, due to the property tax cap coming off after the change in ownership, the tax appraiser raised its valuation 23%

from 2024 to 2025. Then he raised its valuation another 7% from 2025 to 2026. 1994's "Proposal A" forbids tax assessors from raising assessed values more than

5% a year. I am requesting that you lower 2025's valuation to reflect a bump of only 5% from 2024's valuation and that you lower 2026's valuation to reflect a bump

of only 5% over the corrected 2025's valuation. Also to be considered is the fact that this property is not worth $202,000 as the assessor now maintains. It was

appraised last year by the bank at only $179,000 and the neighborhood has since gotten worse. We would be lucky today to sell it for what we foolishly overpaid for

it three years ago, $178,000
