STATE OF MICHIGAN GRETCHEN WHITMER GOVERNOR DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS LANSING MARLON I. BROWN, DPA DIRECTOR MICHIGAN TAX TRIBUNAL · 611 W. OTTAWA ST., LANSING, MI 48933 · 517-335-9760 PO BOX 30232, LANSING, MI 48909 · Other Carriers: 2407 N. GRAND RIVER AVE., LANSING, MI 48906 Matthew Michael Schrauben, Petitioner, MICHIGAN TAX TRIBUNAL SMALL CLAIMS DIVISION v MTT Docket No. 26-002314 Township Of Crystal, Respondent. ORDER OF DISMISSAL The Tribunal has considered the file in this case and finds that: The issue in this case is already pending in another case and, as such, this appeal is duplicative and shall be dismissed. Therefore, IT IS ORDERED that the case is DISMISSED. This order resolves all pending issues and closes the case. APPEAL RIGHTS If you disagree with the final decision in this case, you may file a motion for reconsideration with the Tribunal or a claim of appeal with the Michigan Court of Appeals. A motion for reconsideration must be filed with the Tribunal with the required filing fee within 21 days from the date of entry of the final decision. Because the final decision closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing system; it must be filed by mail or personal service. The fee for the filing of such motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless the Small Claims decision relates to the valuation of property and the property had a principal residence exemption of at least 50% at the time the petition was filed or the decision relates to the grant or denial of a poverty or disabled veterans exemption and, if so, there is no filing fee. You are required to serve a copy of the motion on the opposing party by mail or personal service or by email if the opposing party agrees to electronic service, and proof demonstrating that service must be submitted with the motion. Responses to motions for reconsideration are prohibited and there are no oral arguments unless otherwise ordered by the Tribunal. Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If
Page 2
MTT Docket No. 26-002314 Page 2 of 2 the claim is filed more than 21 days after the entry of the final decision, it is an “appeal by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the record on appeal. There is no certification fee. By: /s/ Patricia L. STATE OF MICHIGAN GRETCHEN WHITMER GOVERNOR DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS LANSING MARLON I. BROWN, DPA DIRECTOR 2 of 3 MMT Docket No. 26-002199 Property Tax Appeal – Assessment Uniformity and Equity Review I respectfully request a review of the assessed value assigned to my property located at 2667 S. Shore Drive, Crystal, Michigan 48818, in Crystal Township, Montcalm County. My concern is not solely the value assigned to my property, but rather the lack of uniformity when compared to neighboring waterfront properties with superior characteristics. The Michigan property tax system is intended to assess similar properties in a fair and equitable manner. Based on the assessment records of adjacent properties, my property appears to be assessed disproportionately higher than comparable neighboring homes. My property has approximately 25 feet of Crystal Lake frontage, a 480-square-foot basement, was purchased in 1986, and was remodeled in 2008. The property is currently assigned an estimated market value of $334,400, an assessed value of $164,900, and a taxable value of $105,880. The neighboring Smith property has approximately 30 feet of lake frontage and a significantly larger 682-square-foot basement. Despite having more lake frontage and a larger home footprint, the property is assessed at $146,200 with a taxable value of $73,293. The neighboring Kitchenmaster property has approximately 35 feet of lake frontage and the same 480-square-foot basement size as my property. Despite having 10 additional feet of lake frontage, the property has a comparable assessed value of $167,400. These neighboring properties possess equal or superior characteristics, including greater lake frontage and, in the case of the Smith property, a larger basement area. Given these differences, I believe my property's assessment is disproportionately high relative to comparable properties in the immediate area. I presented these concerns during the local review process; however, no adjustment was made. I am therefore requesting that the Michigan Tax Tribunal review the assessment for uniformity and equity and determine whether my property has been assessed consistently with similarly situated neighboring waterfront properties. Thank you for your consideration. Matthew Michael Schrauben Jurisdictional Issues: Did you protest the assessment at a Board of Review?
