STATE OF MICHIGAN GRETCHEN WHITMER GOVERNOR DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS LANSING MARLON I. BROWN, DPA DIRECTOR MICHIGAN TAX TRIBUNAL · 611 W. OTTAWA ST., LANSING, MI 48933 · 517-335-9760 PO BOX 30232, LANSING, MI 48909 · Other Carriers: 2407 N. GRAND RIVER AVE., LANSING, MI 48906 Mathias El Tribe Trust, Petitioner, MICHIGAN TAX TRIBUNAL SMALL CLAIMS DIVISION v MTT Docket No. 26-002296 City Of Southfield, Respondent. ORDER OF DISMISSAL The Tribunal has considered the file in this case and finds that: The issue in this case is already pending in another case and, as such, this appeal is duplicative and shall be dismissed. Therefore, IT IS ORDERED that the case is DISMISSED. This order resolves all pending issues and closes the case. APPEAL RIGHTS If you disagree with the final decision in this case, you may file a motion for reconsideration with the Tribunal or a claim of appeal with the Michigan Court of Appeals. A motion for reconsideration must be filed with the Tribunal with the required filing fee within 21 days from the date of entry of the final decision. Because the final decision closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing system; it must be filed by mail or personal service. The fee for the filing of such motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless the Small Claims decision relates to the valuation of property and the property had a principal residence exemption of at least 50% at the time the petition was filed or the decision relates to the grant or denial of a poverty or disabled veterans exemption and, if so, there is no filing fee. You are required to serve a copy of the motion on the opposing party by mail or personal service or by email if the opposing party agrees to electronic service, and proof demonstrating that service must be submitted with the motion. Responses to motions for reconsideration are prohibited and there are no oral arguments unless otherwise ordered by the Tribunal. Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

MTT Docket No. 26-002296 Page 2 of 2 the claim is filed more than 21 days after the entry of the final decision, it is an “appeal by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the record on appeal. Page 2
STATE OF MICHIGAN GRETCHEN WHITMER GOVERNOR DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS LANSING MARLON I. BROWN, DPA DIRECTOR This appeal challenges the assessor’s classification and jurisdictional authority regarding Parcel ID 76-24-16-201-019. The property is owned by the Mathias El Tribe Trust and is not privately owned residential property subject to ordinary municipal taxation under MCL 211.34c. The current “Residential” designation was selected solely because it is the classification presently imposed by the assessor and is the subject of this challenge. Selection of that category does not concede that the property is lawfully classifiable under Michigan’s statutory property classification framework. The recorded conveyance instrument expressly identifies the property as tribal trust property held for governmental, cultural, charitable, and community purposes and further reserves protected status, jurisdictional rights, and federal protections associated with the conveyance. The deed additionally states that jurisdiction over matters arising from the instrument is reserved within the Mathias El Tribe Trust and its judicial and administrative bodies. MCL 211.34c contains no classification applicable to tribal trust governmental land. Because classification is the threshold act upon which assessment jurisdiction depends, the assessment, uncapping, and taxation actions are disputed as exceeding lawful authority. This filing is made under special appearance and without waiver of objections to jurisdiction, classification authority, taxing authority, federal preemption, or related protections previously noticed to the assessing authorities. Jurisdictional Issues: List the exemption being appealed: Asserted exclusion from ordinary municipal taxation and assessment authority relating to tribal trust/governmental property improperly classified as residential property. List the Statutory authority for the exemption being appealed: 25 U.S.C. § 177; federal preemption principles; recorded tribal trust conveyance and jurisdictional reservations; disputed applicability of MCL 211.34c classification framework. What action prompted this appeal: 2026 assessment notice classifying the property as “401 Residential,” assigning taxable value, and asserting assessment jurisdiction over property held by the Mathias El Tribe Trust. What entity denied the exemption: The City of Southfield Board of Review Did you protest the assessment at a Board of Review (BOR)? Yes If Yes, check which BOR you attended AND attach the BOR decision: March List the date the denial was issued: 2026-04-02 List the year(s) denied: 2026 Valuation Information for Each Parcel under Appeal Parcel Number: 76-24-16-201-019
