Mary N Overman,

Petitioner, MICHIGAN TAX TRIBUNAL

 SMALL CLAIMS DIVISION

v

 MTT Docket No. 25-003085

Township Of Bloomfield,

Respondent.

ORDER OF DISMISSAL

The Tribunal has reviewed the file in the above-captioned case and finds that:

Petitioner did not protest the special assessment at the hearing held for the purpose of

confirming the special assessment roll, as required by MCL 205.735a. As such, and

inasmuch as the Tribunal has no equitable power to waive or otherwise disregard

statutory filing requirements and deadlines, it has no authority to hear the appeal or

grant the relief requested. See Sixarp, LLC v Byron Twp, __Mich__; __NW3d__ (2025).

Therefore,

IT IS ORDERED that the case is DISMISSED.

This order resolves all pending issues and closes the case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

Section 4: Explain Your Answer to this Appeal

The special assessment district was correctly and legally established and the assigned

amount is not substantially or unreasonably disproportionate to the value that accrues to

the land as a result of the improvements.

Moreover, as there was no protest by Petitioner or its representative at the hearing held

to confirm the special assessment roll, the Tribunal lacks jurisdiction over this appeal.

Petitioner's appeal must, therefore, be dismissed.

Section 4: Explain the Reason for this Appeal

The amount of the special roads assessment is excessive, and puts a financial burden

on Mary, whom is a 93 year old retired teacher on a fixed income. The roads project will

not bring a proportionate increase to the value of the home. Data from Zillow and other

real estate databases actually shows that homes in the first two sections of Bloomfield

Village have decreased in value since the roads project was completed in their area and

the cost was assessed. These homes in Bloomfield Village are similar to Mary's home,

and it is projected that Mary will experience a decrease in value as well.

336 N GLENGARRY RD

BLOOMFIELD HILLS, MI 48301

RE: 336 N GLENGARRY RD - Parcel Number 1927430015

Dear Property Owner:

On May 12, 2025 the Bloomfield Township Board of Trustees confirmed the assessment roll for Special

Assessment District No. 428, known as the "Gold" Village Area Road Paving Project. Bloomfield Village

Association has a website with all of the information about the project, https://www.villageroads.org/.

This letter serves as your invoice for this Special Assessment with the amount to be paid in full

without interest before July 15, 2025. The Special Assessment allocated to your property is $50,736.52.

If you choose not to pay in full at this time, we can bill you in fifteen (15) annual instaliments, including

interest, beginning on December 1, 2025. See the reverse side for an illustration.

of what the annual payments

may look like. Importantly, in accordance with state law, the annual special assessment is assumable by the

buyer of a property.

The Township intends to pay the cost of the $7,610,478 project by issuing bonds after July 15, 2025.

Any assessment which has not been paid by July 15, 2025, will bear interest until paid, at a rate not to exceed

one percent (1%) above the average rate of interest borne by the bonds. The interest rate will be determined

after the bonds are sold. As a point of reference, the rate on last year's SAD was 4.7%, though this year’s could

be higher.

Please be aware that financial assistance is available to homeowners who qualify through our Special

Assessment Deferment Program. Please see the enclosed flyer for more information.

Please make checks payable to Bloomfield Township and put your Parcel Number on your check when

making a payment to ensure proper processing. Do not hesitate to contact my office at 248-433-7705 if you

Section 5: Jurisdictional Issues

No
