ORDER OF DISMISSAL

The Tribunal has considered the file in this case and finds that Petitioner was placed in

default on May 26, 2026, because Petitioner failed to file copies of the notice giving rise

to the appeal, i.e., March Board of Review (BOR) decisions. On September 8, 2026,

the Tribunal extended the time for Petitioner to cure the default by an additional 14

days, and they have failed to respond. Petitioner has not complied with either order,

and the latter stated that “failure to comply with this order may result in the dismissal of

the case” and referenced Grimm v Dep’t of Treasury.1 In Grimm, the Michigan Court of

Appeals summarized factors that the Tribunal should consider before imposing the

sanction of dismissal. Those factors are:

(1) whether the violation was wilful or accidental; (2) the party's history of

refusing to comply with previous court orders; (3) the prejudice to the

opposing party; (4) whether there exists a history of deliberate delay; (5) the

degree of compliance with other parts of the court's orders; (6) attempts to

cure the defect; and (7) whether a lesser sanction would better serve the

interests of justice.2

Here, Petitioner’s failure to comply with multiple orders has established a history of

deliberate delay. As a result, giving careful consideration to the factors involved and

considering all options in determining what sanction is just and proper, the Tribunal

finds that dismissal is appropriate, and a lesser sanction would not be appropriate in

light of Petitioner’s history of noncompliance in this case.

Therefore,

IT IS ORDERED that this case is DISMISSED.

This order resolves all pending claims in this matter and closes this case.

APPEAL RIGHTS

If you disagree with the final decision in this case, you may file a motion for

reconsideration with the Tribunal or a claim of appeal with the Michigan Court of

Appeals.

A motion for reconsideration must be filed with the Tribunal with the required filing fee

within 21 days from the date of entry of the final decision. Because the final decision

closes the case, the motion cannot be filed through the Tribunal’s web-based e-filing

system; it must be filed by mail or personal service. The fee for the filing of such

motions is $50.00 in the Entire Tribunal and $25.00 in the Small Claims Division, unless

the Small Claims decision relates to the valuation of property and the property had a

principal residence exemption of at least 50% at the time the petition was filed or the

decision relates to the grant or denial of a poverty or disabled veterans exemption and,

if so, there is no filing fee. You are required to serve a copy of the motion on the

opposing party by mail or personal service or by email if the opposing party agrees to

electronic service, and proof demonstrating that service must be submitted with the

motion. Responses to motions for reconsideration are prohibited and there are no oral

arguments unless otherwise ordered by the Tribunal.

Alternatively, you may file a claim of appeal with the Michigan Court of Appeals. If the

claim is filed within 21 days of the entry of the final decision, it is an “appeal of right.” If

the claim is filed more than 21 days after the entry of the final decision, it is an “appeal

by leave.” A copy of the claim of appeal must be filed with the Tribunal to certify the

record on appeal. There is no certification fee.

How to Fix It

The address may be misspelled or may not exist. Try one or more of

the following:



Send the message again following these steps: In Outlook,

open this non-delivery report (NDR) and choose Send Again

from the Report ribbon. In Outlook on the web, select this

NDR, then select the link "To send this message again, click

here." Then delete and retype the entire recipient address. If

prompted with an Auto-Complete List suggestion don't select

it. After typing the complete address, click Send.



Contact the recipient (by phone, for example) to check that

the address exists and is correct.



The recipient may have set up email forwarding to an

incorrect address. Ask them to check that any forwarding

they've set up is working correctly.



Clear the recipient Auto-Complete List in Outlook or Outlook

on the web by following the steps in this article: Fix email

delivery issues for error code 5.1.1 in Office 365, and then

send the message again. Retype the entire recipient address

before selecting Send.

If the problem continues, forward this message to your email admin. If

you're an email admin, refer to the More Info for Email Admins

section below.

Status code: 550 5.1.1

This error occurs because the sender sent a message to an email address outside of

Office 365, but the address is incorrect or doesn't exist at the destination domain. The

error is reported by the recipient domain's email server, but most often it must be fixed

by the person who sent the message. If the steps in the How to Fix It section above

don't fix the problem, and you're the email admin for the recipient, try one or more of

the following:

The email address exists and is correct - Confirm that the recipient address exists, is

correct, and is accepting messages.

Synchronize your directories - If you have a hybrid environment and are using

directory synchronization make sure the recipient's email address is synced correctly in

both Office 365 and in your on-premises directory.

Errant forwarding rule - Check for forwarding rules that aren't behaving as expected.

Forwarding can be set up by an admin via mail flow rules or mailbox forwarding address

settings, or by the recipient via the Inbox Rules feature.

Mail flow settings and MX records are not correct - Misconfigured mail flow or MX

record settings can cause this error. Check your Office 365 mail flow settings to make

sure your domain and any mail flow connectors are set up correctly. Also, work with your

domain registrar to make sure the MX records for your domain are configured correctly.

For more information and additional tips to fix this issue, see Fix email delivery issues for

error code 550 5.1.1 in Office 365.

ORDER EXTENDING TIME FOR PETITIONER TO CURE DEFAULT

On May 29, 2026, Petitioner filed copies of the notice of assessments for Parcel Nos.

19030-140-000-006-00 and 19030-140-000-005-00 in response to the Tribunal’s May

26, 2026 Order of Default.

The Tribunal has considered the response and the case file and finds that Petitioner

was held in default because they failed to file copies of the notice giving rise to the

appeal, i.e., March Board of Review (BOR) decisions.1 Although Petitioner timely

responded to the Order of Default, their attempt to cure is incomplete because

Petitioner failed to file copies of the March BOR decisions for the parcels under appeal.

However, on August 12, 2026, Respondent submitted their answer to the petition,

including the March BOR decision for Parcel No. 19030-140-000-006-00, thus curing

that portion of the default. To cure the remaining default, Petitioner must file a copy of

the BOR decision for Parcel No. 19030-140-000-005-00 or alternatively provide the

Tribunal with a written explanation as to why a BOR decision does not exist with respect

to Parcel No. 19030-140-000-005-00, within 14 days of entry of this order. Though the

Tribunal finds an extension of time to cure the default appropriate, Petitioner’s failure to

comply with Tribunal orders and its Rules of Practice and Procedure has established a

history of deliberate delay that would justify dismissal of the case for failure to timely

comply with this order.2 Therefore,

IT IS ORDERED that the time for Petitioner to cure the default is EXTENDED.

IT IS FURTHER ORDERED that Petitioner must complete the following to cure the

default: (1) file a copy of the BOR decision for Parcel No. 19030-140-000-005-00 or

alternatively provide the Tribunal with a written explanation as to why a BOR decision

does not exist, (2) file a Motion to Set Aside Default, and (3) file proof the motion was

served on Respondent. The foregoing must be filed with the Tribunal within 14 days of

1 The order further stated: “Failure to comply with this order will result in the defaulted party being

required to file a motion to set aside the default (with appropriate filing fee).”

| purchased the subject property in April 2025 for a purchase price of $348,000.00. The

property consists of two adjoining parcels: one vacant parcel and one parcel improved with a

residential dwelling. An independent appraisal completed in September 2025 established a

combined true cash value of $379,000.00 for both parcels.

As a result of the transfer of ownership in April 2025, the taxable value of the property is

subject to uncapping for the 2026 tax year pursuant to Proposal A and Section 27a of the

General Property Tax Act. The vacant land appraised at $38,000.00, with the remaining value

of $341,000.00 is attributable to the parcel improved with the residential dwelling.

Based on this allocation, the resulting taxable values are $170,500.00 for the residential parcel

and $19,000.00 for the vacant parcel. In accordance with Proposal A and Michigan property

tax law,

and applicable uncapped taxable value and adjust the assessed and taxable values of the

subject parcels to accurately reflect their true cash value as of the applicable valuation date.

Section 5: Explain the Reason for this Appeal

| purchased the subject property in April 2025 for a purchase price of $348,000.00. The

property consists of two adjoining parcels: one vacant parcel and one parcel improved with a

residential dwelling.

In accordance with Proposal A and Michigan property

tax law,

| respectfully request that the Board of Review consider the purchase price, appraisal,

and applicable uncapped taxable value and adjust the assessed and taxable values of the

subject parcels to accurately reflect their true cash value as of the applicable valuation date.
